AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, DIVISION 4, SECTION 24-278 OF THE HAWAII COUNTY CODE 1983 (2016 EDITION,AS AMENDED), RELATING TO PEDESTRIANS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. The purpose of this amendment is to improve safety upon that portion of Waipi`o Valley Road running from the Waipi`o Valley lookout to a point near its entry upon the valley the floor. SECTION 2. Chapter 24, article 10, division 4, section 24-278, schedule 26, Roads closed to pedestrian traffic, subsection(a), Hamakua, of the Hawai`i County Code 1983 (2016 Edition, as amended), is amended by adding the following to be appropriately designated and to read as follows: Waipi`o Valley Road;fr i paint approximately nine hundred thirty feet northwest of Road and extending approximately nine thousand three hundred feet in the northwestern direction. This restriction shall not apply: In case of emergency. To owners, lessees, and residents of Waipi'o Valley. To Native Hawaiian cultural practitioners in exercise of their traditional and customary rights. SECTION 3. New material is underscored. In printing this ordinance, the underscoring need not be included. SECTION 4. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end;the provisions of this ordinance are declared to be severable.
