HomeMy WebLinkAbout2022-01-21 - HB1872_HOUSE OF REPRESENTATIVES THIRTY-FIRST LEGISLATURE,2022 STATE OF HAWAII A BILL FOR AN ACT RELATING TO SUSTAINABILITY. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII: 1 SECTION 1.Section 183D-2,Hawaii Revised Statutes,is 2 amended to read as follows: 3 “~183D-2 Powers and duties of department.The department 4 shall: 5 (1)Manage and administer the wildlife and wildlife 6 resources of the State; 7 (2)Enforce all laws relating to the protecting,taking, 8 hunting,killing,propagating,or increasing the 9 wildlife within the State and the waters subject to 10 its jurisdiction; 11 (3)Recognize that: 12 (A)Game mammals and game birds can provide a 13 sustainable food source that merit quality 14 habitats with sufficient food,water,and refuge 15 to support viable populations sufficient for 16 hunting; 2022-0738 HB SMA.doc Page2 H.B.NO./87~ 1 (B)Proper management of game populations in 2 appropriate areas minimizes their impacts and 3 provides benefits,such as the reduction of grass 4 fire fuel and weed control to important watershed 5 areas,and contribute to native Hawaiian 6 traditional and customary practices and the 7 resources those practices rely upon;and 8 (C)The State’s unique relationship with the ocean 9 requires careful consideration and management of 10 land and ocean activities that prioritize the 11 public trust responsibilities of the State, 12 including the conservation of natural resources 13 for future generations and the protection of 14 native Hawaiian traditional and customary 15 practices pursuant to article XI,section 1,and 16 article XII,section 7,of the Hawaii State 17 Constitution; 18 [-(-a-)-](4)Establish and maintain wildlife propagating 19 facility or facilities; 20 [-(-4-)-](5)Subject to the provisions of title 12,import 21 wildlife for the purpose of propagating and 2022-0738 HB SMA.doc 2 Page3 H.B.NO./87~ 1 disseminating the same in the State and the waters 2 subject to its jurisdiction; 3 [-(-S-H (6)Distribute,free of charge,as the department 4 deems to be in the public interest,game for the 5 purpose of increasing the food supply of the State; 6 provided that when in the discretion of the department 7 the public interest will not be materially interfered 8 with by so doing,the department may propagate and 9 furnish wildlife to private parties,upon such 10 reasonable terms,conditions,and prices as the 11 department may determine; 12 [-(-64-](7)Ascertain,compile,and disseminate,free of 13 charge,information and advice as to the best methods 14 of protecting,propagating,and distributing wildlife 15 in the State and the waters subject to its 16 jurisdiction; 17 [-(-v-)-](8)Gather and compile information and statistics 18 concerning the area,location,character,and increase 19 and decrease of wildlife in the State; 20 [-(-8-)-](9)Gather and compile information concerning 21 wildlife recommended for release in different 2022-0738 HB SMA.doc 3 Page4 H.B.NO./37k 1 localities,including the care and propagation of 2 wildlife for protective,productive,and aesthetic 3 purposes and other useful information,which the 4 department deems proper; 5 [—(-9-)-](10)Have the power to manage and regulate all lands 6 which may be set apart as game management areas, 7 public hunting areas,and wildlife sanctuaries; 8 [(10)1 (11)Pursuant to section l83D-65 of this chapter, 9 destroy predators deemed harmful to wildlife; 10 [(11)](12)Formulate,and from time to time recommend to 11 the governor and legislature,such additional 12 legislation necessary or desirable to implement the 13 objectives of title 12;and 14 [(12)1 (13)Preserve,protect,and promote public hunting.” 15 SECTION 2.(a)No later than July 1,2023,each 16 department,office,or agency of the State shall update its 17 rules and policies to integrate the local hunting and fishing 18 industries into any food security or sustainability strategies 19 that the department,office,or agency employs. 20 (b)The updated rules and policies shall be consistent 21 with section l83D-2,Hawaii Revised Statutes. 2022-0738 HB SMA.doc 4 Page5 H.B.NO./37~ 1 SECTION 3.The head of each principal department of the 2 State shall submit to the legislature a report on the progress 3 of that department and any agency administratively attached to 4 that department in implementing section 2 of this Act,no later 5 than twenty days prior to the convening of the regular sessions 6 of 2023 and 2024.The report shall include the department’s 7 findings and recommendations,including any proposed 8 legislation. 9 SECTION 4.Statutory material to be repealed is bracketed 10 and stricken.New statutory material is underscored. 11 SECTION 5.This Act shall take effect upon its approval. 12 INTRODUCED BY: JAN 212022 2022-0738 I-lB SMA.doc 5 H.B.NO./I7~Z Report Title: State Departments;Gaming and Fishing Resources;Conservation; Sustainability;Food Security;Rules and Procedures;Report Description: Requires the Department of Land and Natural Resources to recognize that game mammals and game birds provide a food source and play a role in native Hawaiian traditional and customary practices and that striking the right balance between the management of game mammal and game bird populations and sustainability of their natural habitats to reduce negative impacts to important watershed areas is a priority and that the State’s unique relationship with the ocean requires careful consideration and management of land and ocean activities that prioritize the public trust responsibilities of the State. Requires each department,office,or agency of the State to update its rules and policies to integrate the local hunting and fishing industries into any food security or sustainability strategies that department,office,or agency employs.
