The Leeward Planning Commission met in regular session at 9:31 a.m. in the West Hawaii Civic Center, Council Chambers, Building A, 74-5044 Ane Keohokalole Highway, Kailua-Kona, Hawaii, with Chairperson Barbara DeFranco presiding. This meeting was streamed live on YouTube. COMMISSIONERS PRESENT: Barbara DeFranco, Zaheva Knowles, Michael Dela Cruz, and Mahina Paishon Duarte. ABSENT AND EXCUSED: Clement"CJ" Kanuha III. ALSO PRESENT: Suzanna Tiapula, Esq. (Counsel to the Commission), Jean Campbell, Esq. (Counsel to the Planning Department), Zendo Kern (Planning Director), Christian Kay (Planner), Jessica Andrews (Planner), Clinton Mercado (Planner), Tracie Camero (Planner), Janice Hata (Zoom Host), Maija Jackson (Planning Program Manager), and Melissa Dacayanan-Salvador (Commission Secretary). Approximately twelve public members were in the audience. A quorum was present. Chairperson DeFranco called the meeting to order and introduced Commissioners and staff. APPROVAL OF MINUTES At 9:33 a.m. the Commission took up the minutes of the June 15, 2023, Leeward Planning Commission meeting. No corrections were offered. It was moved by Commissioner Paishon- Duarte and seconded by Commissioner Dela Cruz that the minutes be approved as submitted. A voice vote was taken, and the motion carried with all in favor. STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS At 9:36 a.m. Chairperson DeFranco explained the procedure for testifying and Planning Commission Rule 1-5 regarding decorum. Testifiers were given the options of speaking at this time or later at the time the specific agenda item was called to order. APPLICANT: KAUPULEHU LAND LLC (PL-SLU-2022-000008) Application for a State Land Use Boundary Amendment from Agricultural to Rural for 2.653 acres of land. The subject property is located at 64-983 Mamalahoa Highway, approximately one mile east of its intersection with Kawaihae Road, Pu`ukapu Homesteads, South Kohala, Hawaii, TMK: (3) 6-4-024:027 (por.). 2. APPLICANT: KAUPULEHU LAND LLC (PL-REZ-2022-000039) Application for a Change of Zone from an Agricultural-5 acre (A-5a) zoning district to a Neighborhood Commercial-10,000 square feet(CN-10) zoning district for 2.325 acres of land and from an Agricultural-5 acre (A-5a) zoning district to a Residential Agricultural- 0.5 acre (RA-0.5) zoning district for 3.024 acres of land. The subject property is located at 64-983 Mamalahoa Highway, approximately one mile east of its intersection with Kawaihae Road, Pu`ukapu Homesteads, South Kohala, Hawaii, TMK: (3) 6-4-024:027. At 9:34 a.m. Chairperson DeFranco announced Unfinished Business Items No. 1 KAUPULEHU LAND LLC (PL-SLU-2022-000008), and No. 2 KAUPULEHU LAND LLC (PL-REZ-2022- 000039) has been deferred to a later date. APPLICANT: JOAN HUNZIKER(PL-SPP-2023-000036) Application for a Special Permit to allow the establishment of a three-bedroom bed and breakfast operation within an existing dwelling on approximately 1.001 acres of land in the State Land Use Agricultural District. The subject property is located at 75-495 Nani Kailua Drive, approximately 0.25 miles east(mauka) of its intersection with Hienaloli Road, Pua`a 3rd — `Auhaukea`e 1st, North Kona, Hawaii, TMK: (3) 7-5-012:091. A roll call vote was taken, and the motion carried with four ayes (Paishon-Duarte, Dela Cruz, Knowles, and DeFranco), no noes, and one absent and excused (Kanuha) [TIMESTAMP 1:17:57]. The hearing ended at 10:49 a.m. At 10:49 a.m. Chairperson DeFranco called a recess [TIMESTAMP 1:18:25], and she called the meeting back to order at 10:58 a.m. [TIMESTAMP 1:27:01]. 4. APPLICANT: HAMAKUA HEALTH CENTER INC. DBA HAMAKUA-KOHALA HEALTH (PL-SPP-2023-000038) Application for a Special Permit to establish a transitional clinic and workforce housing, including accessory structures and uses on 4.321 acres of land in the State Land Use Agricultural District. The subject property is located at 54-3793 Akoni Pule Highway, at the northwestern corner of its intersection with Maluhia Road, Ohanaula and Honopueo, North Kohala, Hawai`i, TMK: (3) 5-4-005:011 (por). 5. APPLICANT: HAMAKUA HEALTH CENTER INC. DBA HAMAKUA-KOHALA HEALTH (PL-USE-2023-000010) Application for a Use Permit to establish a permanent medical clinic and caretakers' residence, including accessory structures and uses on 1.322 acres of land in the Single Family Residential-15,000 square feet(RS-15) zoning district. The subject property is located at 54-3793 Akoni Pule Highway, at the northwestern corner of its intersection with Maluhia Road, Ohanaula and Honopueo, North Kohala, Hawaii, TMK: (3) 5-4-005:011 (por). The Commission took up these two items simultaneously at 10:58 a.m. with approximately eleven public members in the audience. [TIMESTAMP 1:27:03]. A roll call vote was taken, and the motion carried with four ayes (Paishon-Duarte, Dela Cruz, Knowles, and DeFranco), no noes, and one absent and excused (Kanuha) [TIMESTAMP 2:28:27]. Action on Item #5 PL-USE-2023-000010: It was moved by Commissioner Dela Cruz and seconded by Vice Chair Knowles that the application for Use Permit, Docket No. PL-USE-2023- 000010, be approved based on the Planning Director's recommendation[TIMESTAMP 2:28:57]. A roll call vote was taken, and the motion carried with four ayes (Dela Cruz, Knowles, Paishon- Duarte, and DeFranco), no noes, and one absent and excused (Kanuha) [TIMESTAMP 2:29:21]. The hearing ended at 12:00 p.m. At 12:01 p.m. Chairperson DeFranco called a recess [TIMESTAMP 2:30:10], and she called the meeting back to order at 12:10 p.m. [TIMESTAMP 2:38:50] A moment of silence was taken to reflect on the tragedy that was currently happening on our Hawai`i Islands, in Lahaina and the families being impacted. 6. APPLICANT: WDC PROPERTIES, LLC (PL-SPP-2023-000040) Application for a 10-year time extension to Condition No. 4 (life of the permit) of Special Permit No. 538 to extend the life of the permit to June 30, 2035. Special Permit No. 538 was most recently amended in 2015 to allow the continued use of a heliport and related facilities on a 9.8-acre portion of a larger 13.007-acre property until June 30, 2025. The subject property is located at 68-690 Waikoloa Road on the southeast corner of its intersection with Queen Ka`ahumanu Highway, Por. Waikoloa, South Kohala, Hawaii, TMK: (3) 6-8-001:043 (por.). Action: It was moved by Vice Chair Knowles and seconded by Commissioner Dela Cruz that the application for a ten (10)year time extension to Condition No. 4 (Life of the Permit) of Special Permit No. 538 be granted.
