Failing Opposition Testimony From: iav failino To: WPCtestimonv Subject: Expression of Opinon RE: Punaluu Development Permit Date: Tuesday, March 5,2024 3:50:46 PM Attachments: To Whom it May Concern Punaluu.docx To whom it may concern, Please note the following: To Whom it May Concern, County Of Hawaii, State of Hawaii March 5, 2024 My name is Jay Failing, long term 35 year resident of Hawaii. I own land, near Pahala, in Wood Valley, where I farm, that being An orchard. I treasure the remoteness of the area, of Kau, and put up with The inconvenience of Remote because it is rare, and needed, for me, my needs, In particular. Most likely for others as well. It is Why we set aside National Parks, And wilderness lands, and Special Use Management Lands. I am writing to express Firm opposition to the Proposed Development at Punaluu Area of Kau. We note law is based upon precedents, which in time, establish the law itself, if I am not mistaken. Time and again, Residents of the Kau area have spoken as aligned majority, in firm opposition to prior efforts to Develop, in particular Resorts, or concentrated housing, in a resort context. The impact will alter a pristine area, which is enjoyed by those who live in Kau area, and those who visit the area. Once the Natural order and ambiance is disturbed, it often does not return ever to it's prior state. In that way Punaluu, has through precedent, established itself as a special and limited use area. The intrinsic value is directly related to limiting the uses which disturb this state of being. Development is contrary to this limited use already established. Therefore, as you who serve the local and state populace, I expect you to protect Punaluu, area. Those visitors who desire resort settings have the whole South Kohala Coast and Kona, Hilo, developed areas to play in. The proposed development, after I reviewed the extent, is in direct conflict with the above described, Limited use status. We have seen wonderful areas of the United States, and indeed, Hawaii become Altered in pursuit of Profit, over Pono. As our Reprentatives, hear me now, and represent the special Mana of this rare jewel of our Sacred Island and in particular Kau. In the event you override our clear Wishes, I would be glad to join any legal counter effort to further block the development. I am trusting you will act as True stewards of our Lands, and Protect this limited use area for the future. Respectfully, Jay C Failing Farmer, Designer and Draftsman. 808.896.8441 To Whom it May Concern, County Of Hawaii, State of Hawaii March 5, 2024 My name is Jay Failing, long term 35 year resident of Hawaii.
