Pursuant to Section 25-2-43(b) of the Hawaii County Code, I am submitting Bill 140, enclosed for your comment and recommendation. I also request that you forward the same to the Environmental Management Commission for its comment and recommendation. Bill 140 was referred for comment and recommendation to the Director of Environmental Management and the Environmental Management Commission by the Hawaii County Council's Policy Committee on Infrastructure and Assets on March 19, 2024. STATE OF HAWAI`I BILL NO. 14U AN ORDINANCE AMENDING CHAPTER 20 OF THE HAWAI`I COUNTY CODE 1983 (2016-EDITION, AS AMENDED), RELATING TO SOLID WASTE FACILITIES. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`I0 SECTION 1. Purpose. The purpose of this ordinance is to ensure all Hawaii County residents equitable access to essential waste disposal and recycling services by mandating a consistent and minimum level of operation at all Hawaii County transfer. stations. Recognizing the critical role these facilities play in public health and environmental preservation, this ordinance aims to ensure that no community is disproportionately affected by a lack of access to waste disposal or recycling services. SECTION 2. Chapter 20, article 2, division 1, of the Hawaii County Code 1983 (2016 Edition, as amended) is amended by adding a new section to be appropriately designated and to read as follows: "Section 20- - SWD facilities; minimum days of operation. Any SWD facility used for the disposal, collection, and transfer of household solid waste shall be operated and open to the public for such purposes no less than two days a week." SECTION 3. New material is underscored. In printing this ordinance, the underscoring need not be included. SECTION 4. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable. SECTION 5. This ordinance shall take effect upon its .approval.
