Aloha Chairman Lin,
I am writing to express my concerns regarding the proposed regulations under Hawaii Bill
121. As a resident deeply invested in the well-being of our community, I believe it is crucial to
address the potential inequities and enforcement challenges that may arise from the current
draft of the bill.
Firstly, the requirement for property owners to provide affidavits confirming all improvements
on their property are properly permitted could place an undue burden on many, especially
given the historical challenges with the permitting process in Hawaii County. This
requirement seems to disproportionately affect those who may have made minor, unpermitted
improvements to their homes over the years. Therefore, I urge the Planning Commission to
recommend the removal of the affidavit requirement to ensure fairness and avoid penalizing
homeowners for systemic inefficiencies.
Additionally, the bill's restrictions on where hosts live in relation to their guests could
transform neighborhoods and infringe on private property rights. It is my belief that as long as
the owner resides in the same building, on the same parcel, or on an adjacent parcel, it is an
overreach to dictate where they can and cannot sleep. I request that the Planning Commission
recommend the removal of these restrictions to preserve the character of our neighborhoods
and respect the rights of property owners.
Lastly, the proposed regulations could significantly impact the availability of alternative
accommodations such as tiny homes, tents, and trailers. These accommodations often provide
affordable and unique lodging options for visitors and residents alike. I recommend that the
Planning Commission advocate for clarity and support for these alternative accommodations
to ensure they remain a viable option within our community.
In conclusion, I respectfully request that the Planning Commission consider these concerns
and recommend adjustments to Bill 121 that prioritize fairness, enforceability, and the
