HomeMy WebLinkAboutPD Background Report (PL-SPP-2023-000060)BMakuaLaniSPP.3.15.24 COUNTY OF HAWAII PLANNING DEPARTMENT BACKGROUND REPORT MAKUA LANI CHRISTIAN ACADEMY (FORMERLY KONA CHRISTIAN ACADEMY) AMENDMENT TO SPECIAL PERMIT NO. 549 (PL -SPP -2023-000060) MAKUA LANI CHRISTIAN ACADEMY (FORMERLY KONA CHRISTIAN ACADEMY) is requesting to amend Condition No. 9 of Special Permit No. 549 to allow an increase in the maximum enrollment from 180 to 210 students, as well as to expand the permit area by 1.916 acres. Special Permit No. 549 allowed the establishment of a church and primary school facilities and related improvements on approximately 5.087 acres of land in the State Land Use Agricultural District. The subject properties are located at 74-4907 and 74-4889 Palani Road, approximately 0.4 miles south of its intersection with Mamalahoa Highway, Papa`akoko and Honokohau 1st and 2nd, North Kona, Hawaii, TMK: (3) 7-4-006:037 and 046. APPLICANT'S REQUEST 1. Applicant's Request: The applicant is requesting an amendment to Special Permit No. 549 (SPP 549), which allowed the establishment of a church and primary school facilities and related improvements, to include the following: • Amend Condition No. 9 of SPP 549 to allow an increase in the maximum enrollment from 180 to 210 students. The condition currently states "The primary school shall be limited to an enrollment of 180 students. " • Add the adjacent 1.916 -acre property, TMK (3) 7-4-006:046 (Parcel 46) to the permit area, for educational uses, thereby increasing the permit area to a total of approximately 7.003 acres. • Construct a 960 -square foot modular building on Parcel 46 to accommodate 2 new elementary school classrooms. • Construct a 225 -square foot bathroom building and new septic system on Parcel 46 to serve the new classrooms. 2. Reason for Request: The applicant was recently gifted the ownership of Parcel 46 and would like to use it for educational purposes, together with the existing primary school campus on TMK (3) 7-4-006:037 (Parcel 37), originally permitted under SPP 549. The -1- request to increase the maximum school enrollment is due to an increase in demand and to accommodate the return of 5th graders to the school campus. Over the past two years the school shifted 5th graders to the Makua Lani High School campus so that total enrollment did not exceed the maximum allowed by SPP 549. However, the applicant notes that 5th graders are more developmentally suited to be part of the elementary school campus as opposed to part of the middle school and high school campus. 3. Parking: Parcel 46 has two existing parking lots that will provide 4 parking stalls to be used by teachers during school hours. According to the applicant, the parking lots will also be used on Sundays by Grace Church. 4. Hours of Operation: The school is open Monday through Friday, 7:00 AM to 4:00 PM, with students in attendance on weekdays from 7:30 AM to 2:45 PM, except Wednesdays when students leave at 12:30 PM. 5. Landowner: Makua Lani Christian Academy. 6. Supportive Information: The applicant has submitted the attached in support of the request. (Planning Department Exhibit 1 — Special Permit Application dated September 22, 2023) BACKGROUND INFORMATION 7. April 16, 1984: Effective date of SPP 549, approved by the Planning Commission to establish a church and related improvements on Parcel 37. 8. September 1, 1992: Effective date of an amendment to SPP 549, to allow the establishment of a primary school, with a maximum enrollment of 60 students. 9. July 6, 1995: Effective date of an amendment to SPP 549, to allow an increase in the maximum enrollment from 60 to 120 students. 10. February 17, 1998: Effective date of a State Land Use Boundary Amendment (SLUBA) for TMK (3)7-4-006:038 (Parcel 38), including what is currently Parcel 46, from Agricultural to Rural and a Change of Zone (Ordinance 98-8) from Agricultural -5 acres (A -5a) to Residential -Agricultural -.5 acres (RA -.5a). 11. September 30, 1998: Effective date of Special Permit No. 1010, to allow the establishment of a church and related facilities (Grace Community Church) on Parcel 38, a portion of which is now Parcel 46. WA 12. October 26, 1998: Effective date of an amendment to SPP 549, to allow an increase in the maximum enrollment from 120 to 180 students. 13. April 9, 2009: Final Subdivision Approval granted for Subdivision No. 09-000878, to subdivide Parcel 37, thereby creating Lot 4-A (5.002 acres) and Lot 4-B (3,713 square feet) and designating Drainage Easement "A" (200 square feet). Lot -4-B was intended to provide a 10 -foot -wide addition to the Palani Road Right -of -Way, however it still needs to be dedicated to the County and recorded with the Bureau of Conveyances. (Planning Department Exhibit 2 — SUB 09-000878 dated April 9, 2009) 14. July 24, 2009: Permit to Work Within the County Right -Of -Way issued by DPW, for Palani Road widening and construction of turn lane, installation of water line, water meter and service lateral. (Planning Department Exhibit 3 — DPW Permit dated July 24, 2009) 15. July 20, 2011: Final Subdivision Approval granted for Subdivision No. 10-000981, to subdivide Parcel 38 into 4 lots, including Parcel 46 and Lot 5-A-2, a roadway -widening lot. Change of Zone Ordinance 98-8 included a requirement that in conjunction with Final Subdivision Approval, a roadway section fronting Parcel 46 along Palani Road shall provide for the future road widening of Palani Road to an 80 -foot -wide right-of-way and shall be subdivided and dedicated to the County upon its completion. As such, Lot 5-A-2 still needs to be dedicated to the County and recorded with the Bureau of Conveyances. (Planning Department Exhibit 4 — SUB 10 -000981 -Revised dated July 20, 2011) STATE & COUNTY PLANS 16. State Land Use District: Parcel 37 is designated Agricultural and Parcel 46 is designated Rural. 17. General Plan Land Use Pattern Allocation (LUPAG) Map: The General Plan LUPAG map classifies both subject properties as urban expansion (UE). The UE designation allows for a mix of high density, medium density, low density, industrial, industrial -commercial and/or open designations in areas where new settlements may be desirable, but where the specific settlement pattern and mix of uses have not yet been determined. 18. County Zoning: Parcel 37 is zoned Agricultural -5 acres (A -5a) and Parcel 46 is zoned Residential -Agricultural -.5 acres (RA -.5a). -3- 19. Kona Community Development Plan (KCDP): The KCDP, originally adopted by the Hawaii County Council on September 25, 2008 and most recently amended on September 18, 2019, identifies the preferred land use pattern for the Kona districts. The subject properties are located in the Kona Urban Area but are not located in a Transit -Oriented Development (TOD) area. 20. Special Management Area (SMA): The subject properties are not within the County's Special Management Area and are located approximately 3.2 miles from the nearest shoreline. DESCRIPTION OF SUBJECT PROPERTIES AND SURROUNDING AREA 21. Subject Properties: Parcel 37, a 5.078 -acre, rectangular shaped property, is improved with a church, school buildings, a single-family dwelling used by the pastor and related improvements, as permitted under SPP 549. Parcel 46, a 1.916 -acre, irregularly shaped property is improved with a driveway and two parking lots, with the remainder of the property consisting of grass, trees, and ornamental plants. 22. Surrounding Zoning/Land Uses: Properties situated immediately adjacent to the subject properties are zoned Agricultural (A -5a and A -la) and Family -Agricultural (FA -2a), with uses consisting of residential dwellings, a church, small-scale agriculture and vacant lands. 23. U.S.D.A. Soil Type: Soils on the subject properties are classified Nap6`opo`o-Honuaulu complex, with 10 to 20 percent slopes. 24. Land Study Bureau's Detailed Land Classification System: Soils within the subject properties are classified as "C" or "Fair" and "E" or "Very Poor" for agricultural productivity. 25. Agricultural Lands of Importance to the State of Hawai'i (ALISH): Classified as "Other" Agricultural Lands. 26. Flood Insurance Rate Map (FIRM): The subject properties are classified as Flood Zone "X," (Area of Minimal Flood Hazard) according to the FEMA Flood Insurance Rate Mapping system. 27. Flora/Fauna Resources: No formal flora/fauna study was submitted with the application. Parcel 46 was previously cleared for the construction of a driveway and parking lots to serve Grace Community Church and Parcel 37 was previously cleared for construction of a church, primary school and related improvements. According to the applicant, vegetation se on the subject properties consists of elephant grass, ohia trees, silver oak trees, jacaranda, areca palms, monstera, avocado trees and royal palm trees and animal species present include feral pigs, chicken and mongoose. There are no known endangered species of plants or animals on the subject properties. 28. Archaeological/Cultural/Historical Resources: No archaeological and cultural study was conducted of Parcel 46 as it has been impacted by ground -disturbing activities associated with previous development of the access drive and parking lots. The subject site is not adjacent and/or proximate to the shoreline, therefore gathering of marine life and coastal access for Native Hawaiian gathering and fishing rights is not an issue. The applicant states that there are no known archeological or cultural resources or customary native Hawaiian rights being practiced on the property. 29. Public Access: There is no known public access to the mountains or the shoreline that runs through the subject properties. PUBLIC UTILITIES AND SERVICES 30. Access/Parking: Access to the subject properties is from Palani Road, a County owned and maintained road with a 20 -foot -wide pavement within a variable -width right-of-way. The 2 existing access points include one right -turn -only access point, providing ingress, and a second access point with full turn movements, providing ingress and egress. According to the Department of Public Works (DPW), since Palani Road is an existing collector road, no additional access points are recommended for the proposed use. The applicant notes that there are 2 existing parking lots located on Parcel 46 which will provide 4 parking stalls to be used by teachers. 31. Traffic: A Traffic Impact Analysis Report (TIAR) was submitted with the last application to amend SPP 549, dated August 13, 1998. At the time, the TIAR was reviewed by DPW who recommended that a consolidated access drive be established with a left turn storage area on Palani Road. Subsequently, the Planning Commission requested submittal of a joint TIAR, to address cumulative traffic concerns from developments occurring on both the main school property, parcel 37, and on an adjacent property then identified as TMK (3) 7-4-006:038. A joint TIAR was submitted to the Planning Department, recommending a consolidated access drive to serve both developments, installation of a flashing signal facing south bound on Palani Road, and construction of a left-hand storage pocket. Irbil Conditions of approval were included with the 1998 permit amendment, some as new conditions and some carried over from the previous 1995 permit amendment, to address traffic concerns, as follows: • Condition No. 6: The applicant, its successors or assigns shall construct a left hand turn storage lane/pocket at a location to be determined by Department of Public Works after review of the revised traffic report. • Condition No. 7: The applicant shall submit a maintenance agreement in accordance with and approved by the Department of Public Works, to clear and maintain the vegetation in the right of way along Palani Road for sight distance purposes, prior to securing Final Plan Approval. • Condition No. 8: The applicant shall install flashing lights along Palani Road, in accordance with and meeting the requirements of the Department of Public Works, prior to the issuance of a certificate of occupancy for any expansion. Regarding Condition No. 6, according to DPW, a permit to work within the county right- of-way was issued on July 24, 2009, for a project that included construction of a left -hand - turn storage lane and widening of Palani Road, providing a joint access point to the subject properties. However, DPW has noted that according to their records, the permit never received final inspection. Regarding Condition No. 7, by letter dated July 19, 1999, the Planning Department informed the applicant that a letter addressing compliance with this condition was forwarded to DPW for review, however no response indicating DPW approval has been found in Planning Department records. Regarding Condition No. 8, in comments dated March 21, 2024, DPW notes there are no records regarding installation of flashing lights on Palani Road and recommends that the applicant establish a school zone to include installation of flashing beacons on the approach to the academy with standard school signage, meeting with the approval of DPW, Traffic Division. 32. Water: According to the Department of Water Supply (DWS), each of the subject parcels is currently served by an existing 5/8 -inch meter which is limited to one unit of water, equivalent to an average daily usage of 400 gallons per day (gpd). DWS notes that average daily water usage through the 5/8 -inch meter serving Parcel 37 (existing school property), over the past 2 years, is approximately 1,267 gallons per day, which is equivalent to 4 units of water and exceeding the capacity of the 5/8 -inch meter. DWS further notes that due to roll previous land use actions of the original lot, additional water is not available from the existing DWS water system facilities unless significant water system improvements are constructed, which may include, but not be limited to, additional source, booster pump and transmission facilities. DWS states that current funding is not available, and no time schedule is set for such improvements by DWS. As further clarification, DWS provided a statement by email noting that the comments regarding the lack of additional water and the need to reduce water usage were in reference to Parcel 37. DWS further states that if the proposed new classrooms and bathroom facilities are served by the existing water service for Parcel 46, the estimated water usage should justify that it will be less than what is allocated. 33. Wastewater: According to the Department of Environmental Management (DEM), there is no County sewer system in the area, thus the applicant shall follow Department of Health (DOH) regulations for wastewater. The applicant states that a new septic system will be constructed on Parcel 46 to serve the two proposed classrooms. 34. Solid Waste: According to DOH, commercial operations, State and Federal agencies, religious entities and non-profit organizations may not use transfer stations for disposal. 35. Essential Utilities and Services: Electrical, telephone and internet services are available to the subject properties with medical services, fire and police stations located 3 miles away in Kailua-Kona. The school would like to add the adjacent property identified as TMK (3) 7-4-006:046-0000 to special permit 549 to be able to operate within the parameters of Special Permit 549. The school would also like to formally request an increase from the listed 180 students on permit 549 to be able to accommodate 210 students between the two parcels. The school has been recently gifted the TMK described above and would like to amend special permit 549 to be able to use it for educational purposes as well in conjunction with the existing school campus. Section 3 A. The proposed use of parcel of land is for educational purposes, classrooms. The land and modular building would be part of the adjacent school, Makua Lani Christian Academy. We are requesting to increase the amount of students due to an increase in demand and to also get our 5th graders back on the elementary school campus. Developmentally, 5th grade kids fit much better with grades K-4 vs 6-12. Over the last two years coming out of covid, we had to shift the 5th graders to the high school Makualani Campus to accommodate the amount of students we had a that time so we would not go over our current special permit 549. The parcel of land will be used to house new classrooms with bathrooms that will function for elementary school children. We are currently seeking to add 2 classrooms to the property that are 24x40 totaling 960 square feet, Both classrooms fit in the 960 square foot new modular building, making each classroom 12x24' that share a common wall. We would also add a separate set of bathrooms totaling a maximum of 225 square feet this would be Approx 15x15'. This would also include the addition of a new septic system. As for additional parking stalls that will be used, we would use a max of 4 for teacher parking. We do not need any additional parking unless the county requires us to. We do have two paved parking lots on the new parcel. There is an upper parking lot and a lower parking lot as shown on the TOPO map. The teachers would be on the property Monday through Friday from 7:00 a.m. to 4:00 p.m. The children would be on the property weekdays from 7:30-2:45 each, except on Wednesdays when the students leave at 12:30. Grace community church currently operates mainly on Sundays. B. The subject property is a 1.9 -acre parcel located adjacent to 74-4889 Palani Road (Grace Community Church) and 74-4907 Palani Road (Church of Christ/Makua Lani Christian Academy). See Exhibit "A" in attached deed. There is a single driveway access that provides for both this parcel of land and Grace Community Church. The parcel is split by the driveway, with the north side intended to accommodate the modular we currently do not have any plans to further develop the rest of the property. The topography is grass coverage with some rock underneath. C. The zoning for this property is RA.5a The current designation for the general plan is urban expansion. The state land use is residential. The property is not in an SMA. It sits in the Kona CDP planning area area for the community development plan. Special Permit is required to allow a school under RA zoning and Rural SLU designation. D. The surrounding properties are zoned agricultural, TMK: 740060370000 directly next to the subject property has a Special Permit No. 549 that Makualani elementary school is currently operating their elementary school campus on, this encompasses grades up to 5th grade. TMK 740060470000 directly to the east of the subject property is also zoned Ag and is operating under a special use permit to be able to operate Grace Community church. E. Flood Insurance Rate Map (FIRM) designation please see attached FIRM map. The property is located in Zone X F. There are no known archaeological resources that are on the property to the best of our knowledge. G. There are no known cultural resources or custom native Hawaiian rights practiced on the property to the best of our knowledge. H. The floral and fauna resources that are on the property consist of elephant grass, two ohia trees, 1 silver oak tree, 1 jacaranda, multiple areca palms, monstera, avocado trees, and multiple royal palm trees. We have also seen invasive wild pigs, chickens, and mongoose. I. No Public Access The road into the property is approximately 24' wide and in good condition. Please see attached deed for legal access information, a topo/plot plan has also been attached to show easements, and distance of proposed buildings off the paved road on the property. This entrance as shown in the scaled plot plan attach will be the main ingress and egress to the property. We will not need to enter the property under special permit 549 to access the new property. The access to enter the property under special permit number 549 is 175' heading west on Palani road. K. There is a separate access to enter the TMK with the current special use permit no 549. L. There will be no impact on traffic. There is a turn lane that has been installed years ago for the other parcels that surround this property. Vehicles entering the property can do so currently from both lanes of traffic and there is also another entrance to the main Makualani campus approximately 60 yards south west of the turn lane that accommodates most of the ingress into the current Makualani school campus. M. Water meter has been installed on the property and electric and telephone run on the Palani road side of the property and are available to be connected to. We plan on adding a septic system to take care of the solid waste and sewage disposal H Al. The use of the land for classrooms will not affect the surrounding properties. The property is bordered by two churches (being used primarily on Sundays) whereas the classrooms will be used primarily Monday through Friday. There won't be any overlap of usage of the shared driveway. One of the bordering churches also contains the earlier grades for the school, so traffic patterns are already established and not interfering with the flow of Palani Road. A2. There will be no unreasonable burden to public agencies. The land will not require any public road services, changes to public school improvements, police or fire departments. A3. None to discuss A4. The land is zoned agricultural but the likelihood of productive horticulture is minimal as the location is bordered by churches, parking lots, and a main road. A5. The proposed land usage will not alter the character of the land and present use. The classrooms will serve a similar purpose as the surrounding buildings and facilities (churches). A6. The proposed use will not be contrary to the goals, policies, and standards of the General Plan and other applicable documents such as community development plans and design plans. 5. The amendment is to allow an increase in the maximum enrollment from 120 to 180 students. The property is located on the southeast side of Palani Road approximately 2,100 feet makai of the Palani Road -Hawaii Belt Road intersection, Honokohau 2nd, North Kona, Hawaii. Approval of this request is based on the following: The applicant originally proposed to increase the enrollment of the school from 120 children to a maximum enrollment of 150 children. By letter dated July 30, 1998, the applicant amended their•request to allow a maximum enrollment of 180 children. The hours of operation would remain the same from Monday through Friday, 7:30 to 5:00 p.m. The expansion is based on the present demands of the community as more and more parents seek Christian Education for their children. Approval of this request would not be contrary to the General Plan or the Zoning Code. The amendment to Condition No. 8 would not be contrary to the original reasons for granting the Special Permit. The request is consistent with the Land Use Element of the General Plan which states to "Designate and allocate lands in appropriate proportions and mix and in keeping with the social, cultural, and physical 00398 FtCT 2 6 1998 Mr. Ray Stimac Page 2 environments of the County" and to "...encourage the development and maintenance of communities meeting the needs of its residents in balance with the physical and social environment. " Traffic on Palani Road has been a concern. The applicant prepared a Traffic Impact Analysis Report (TIAR) for 180 students. It was concluded that the expansion would not have an adverse impact on Palani Road and that new improvements would not be required. The report was reviewed by the Department of Public Works and it was recommended that a consolidated driveway be established with a left turn storage area. A subsequent TIAR provided by Malia Ohana Partnership, addressed the impact of development from both Malia Ohana and the Kona Christian Academy. This joint report recommended that a two -driveway system serving both developments would improve traffic operations and safety slightly over two separate driveways. It was also recommended that a flashing signal facing south bound would help mitigate the traffic safety problem. Comments from the Department of Public Works recommended that a left-hand turn storage lane/pocket be provided. Along with the installation of the storage lane, a flashing signal and that only one access point be allowed, traffic concerns can be mitigated. Based on the above findings, the request to increase the maximum enrollment to 180 students is hereby approved. Condition No. 5 is deleted and replaced by a condition limiting the driveway to one access point. In addition, a new condition is included to require the construction of a left-hand turn storage lane/pocket meeting with Department of Public Works approval. Condition No. 7 already addresses the installation of flashing lights and Condition No. 8 regarding maximum enrollment is revised respectively. Special Permit No. 549 is amended as follows: (Material to be deleted is bracketed and material to be added is underscored): 1. The petitioner, its successor or assigns, shall be responsible for complying with all conditions of approval. 2. The applicant shall indemnify and hold the County of Hawaii harmless from and against any loss, liability, claim or demand for the property damage, personal injury or death arising out of any act or omission of the applicant, its successors or assigns, officers, employees, contractors and agents under this permit or relating to or connected with the approval of this permit. 3. Final Plan Approval shall be secured from the Planning Department within one year from the effective date of this amendment. To assure adequate time for plan approval review and in accordance with Ordinance 96-160, Article 2, Division 7, Section 25-2-71, plans shall be submitted a minimum of forty-five days prior to the date by which plan approval must be secured. Plans shall identify all structures, fire protection measures, landscaping, and paved parking stalls associated with the church and primary school use. As required by the Fire Department, classrooms shall maintain a minimum distance of 50 feet from the existing church facility. Parking shall comply with the requirements of Plan Approval and a building permit to allow the establishment of the primary school within the existing church facility, prior to the submittal of plans for the remainder of the proposed development. The amendment is to allow an increase in the maximum enrollment from 60 to 120 students at the primary school. The property is located along the southeast side of Palani Road approximately 2,100 feet makai of the Palani Road -Hawaii Belt Road intersection, Honokohau 2nd, North Kona, Hawaii. Approval of this request is based on the following: The granting of this request would promote the effectiveness and objectives of Chapter 205, Hawaii Revised Statutes, as amended. The State Land Use Law and Regulations are intended to preserve, protect and encourage the development of lands for those uses to which they are best suited in the interest of the public welfare of the people of the State of Hawaii. - In the case of the Agricultural District, the intent is to preserve or keep lands of high agricultural potential in agricultural use. The subject property, although classified as Agricultural by the State Land Use Commission, has Kaimu extremely stony peat soils, which are rated low for agricultural activities. It was determined under the original permit that the subject development would not be contrary to the State Land Use Laws and Regulations given the low agricultural potential for the subject area. As such, any expansion of existing facilities to accommodate an increase in student enrollment will be located on the existing 5 -acre Kona Church of Christ site. Therefore, the proposed expansion will not displace a significant amount of land from agricultural use and would not be contrary to the objectives of the State Land Use Law for the Agricultural District. The applicants have already constructed an approximately 3,600 square foot church and two 1,265 square foot classroom buildings on the property. Additional construction of classrooms and related improvements is anticipated to be made in increments, based on need c 77 Mr. Dennis Westcott Page 2 and the ability to finance infrastructural improvements to support the increased levels of enrollment. Although, the applicant originally requested an increase in enrollment to 200 students, a revised request was received to lower the maximum enrollment to 120 students. The applicant proposes to accommodate approximately 20 additional students per year. The desired use will not adversely affect the surrounding properties. The subject property is five acres and sufficient in size to accommodate additional classrooms. According to the site plan, the playground area is buffered by the church and school buildings. In addition, the Department has not received any complaints regarding the church and school facilities. Unusual conditions, trends and needs have arisen since the district boundaries and regulations were established. The North Kona District has been one of the largest growth areas on the island. The County of Hawaii Data Book 1994, shows a population of 13,748 in 1980 and a population of 22,284 in 1990. This is a 62 percent increase in ten years. Allowing for the expansion of the primary school will help to meet the educational needs of the expanding population in this area. The use will not substantial alter or change the essential character of the land and the present use. As previously discussed, the subject property is the present site of the Kona Church of Christ and an existing primary school. The subject property has been developed; any expansion on the site would supplement existing uses. The request is consistent with the following goals, policies and standards of the General Plan and the Kona Regional Plan. The proposed request would still complement the overall Land Use Goal of the General Plan to: * Designate and allocate land uses in appropriate proportions and in keeping with the social, cultural and physical environments of the County. * The county shall encourage the development and maintenance of communities meeting the needs of its residents in balance with the physical and social environment. Electricity, water, wastewater disposal facilities and other essential services are or will be made available for the school expansion. The applicant shall also comply with all requirements of applicable agencies, including the Department of Health, Fire Department and Department of Water Supply, prior to the issuance of a certificate of occupancy for new school facilities. The desired use will not unreasonably burden public agencies to provide roads and streets, sewers, water, drainage, school improvements, police and fire protection. The applicant anticipates that enrollment will increase by approximately 20 students per year. Palani Road, which fronts the subject property, is a two-lane County roadway, which has a pavement width of 20 feet within a 40 -foot right-of-way. It serves as a main corridor for traffic entering Kailua-Kona from subdivisions north of the subject property and as an access for existing driveway for residential and other approved uses. There have been concerns in the past in regards to traffic congestion and safety on Palani Road. The Department of Public Works recommended that a Traffic Impact Analysis Report (TIAR) be conducted to determine traffic impacts and mitigation measures to ensure safe entry and exit at the school site. According to the Department of Public Works, a TIAR should be conducted when a Mr. Dennis Westcott Page 3 student enrollment reaches 150 students. A Summarized Traffic Study based on an increase in enrollment from 60 to 120 students was submitted by the applicants. The report indicates the posted speed limit as 25 mph when school is in session with an increase to 35 mph when school is not in session. With the anticipated increase in school traffic, the right turns into the church/school are unimpeded, and the left turns into the site operate at Level of Service "E", under both existing and proposed conditions. Sight distance from the north is impeded by a horizontal curve and brush vegetation. When approaching the entrance of the church, travelling south towards Kailua, sight distance is significant. Cars entering the church (left turn) will stack traffic. According to the study, calculations for determining whether a channelized intersection is warranted are inconclusive. As a result of this study, the Planning Director recommends that conditions be included to require the applicant to 1) maintain the vegetation in the right-of-way along Palani Road to assure adequate sight distance and 2) install flashing lights as determined by and meeting with the requirements of the Department of Public Works. In addition, recognizing that the calculation of traffic estimates reflected only an increase in school traffic and did not include future projections of increase in traffic along Palani Road, future expansion beyond the 120 students must be carefully reviewed. Unless an alternate route is created to deter traffic from the existing Palani Road, traffic congestion will continue to grow, and equally, the safety and health hazards for the church/school and the general public will increase. The applicant should be aware that unless traffic conditions improve, any future request to increase student enrollment may require the installation of a channelized intersection or may call for a recommendation of denial by the Planning Director. Based on the above considerations, the request to amend Special Permit No. 549 to allow an increase student enrollment from 60 to a maximum of 120 students would be an unusual and reasonable use of land within the State Land Use District, which would not be contrary to the objectives sought to be accomplished by the State Land Use Law Rules and Regulations. In summary, it is recommended that an indemnification clause be included as a new Condition No. 2, with subsequent conditions to be renumbered. Minor changes are included for the renumbered Conditions Nos. 3 and 4. In addition, Condition No. 4 is deleted as new fire requirements apply and can be addressed by renumbered Condition No. 9. Condition No. 8 allows for the increase to 120 students and new Conditions Nos. 6 and 7 address traffic concerns. The amendment request would allow the establishment of a primary school within the existing church facilities and two new classrooms. The property is the site of the Kona Church of Christ located along the southeast side (mauka) of Palani Road, immediately opposite the Paniolo Country Subdivision, Honokohau 2nd, North Kona, Hawaii. Approval of this amendment is based on the following: The request to allow the establishment of a primary school within the existing Kona Church of Christ facilities and two new classrooms will not be contrary to the original reasons for granting the permit. The proposed use will require the construction of two classrooms adjacent to an area already improved to accommodate the existing church facilities on lands determined as not suitable for cultivation by the Soil Conservation Service and having a very poor potential for agricultural use by the Land Study Bureau's Overall Master Productivity Rating system. Therefore, the proposed use will not have a significant adverse impact on the County's agricultural land inventory. According to the Department of Public Works, "It is anticipated that, with the proposed hours of operation, the P.M. peak traffic hour (along Palani•Road) will be avoided. Given the location of the school at the top of Palani Road, it is not anticipated that the traffic during the A.M. peak hour will be significantly impacted." To ensure that enrollment at the school does not increase to a level which adversely impacts traffic along Palani Road, it is recommended that the school enrollment be limited to no more than 60 students as represented by the applicant. According to water usage calculations submitted by the applicant, the Department of Water Supply has indicated that water systems in the area are able to support the proposed primary school use. According to the calculations, the proposed use will consume approximately 600 gallons of water per day. According to the fire Department, the proposed use will be permitted within the existing church facility with no additional fire requirements. Fire protection for the church facility is provided by an existing fire hydrant located along Palani Road. However, the Fire Department is recommending that a 12,000 gallon water tank for fire fighting purposes be provided on site upon the construction of the proposed two -classroom facility. These requirements are being recommended as conditions of this permit, should it be approved. The desired use will not adversely affect surrounding properties. The proposed use will be located within existing church facilities and two new classrooms which will maintain a minimum setback of 100 feet from its property boundaries. Operation of the primary school will be limited to the hours of 8:00 a.m. to 2:30 p.m. during the weekdays. The hours and days of operation of the proposed school use would reduce any potential conflict with surrounding residential uses. The request is not contrary to the goals, standards and policies of the General Plan and to the Kona Regional Plan. The proposed request would still complement the overall Land Use goal of the General Plan to "Designate and allocate land uses in appropriate proportions and in keeping with the social, cultural and physical environments of the County."
