My testimony focuses on three main areas: enforceability, inequity, and the lack of data supporting the bill's provisions. Firstly,the enforceability of Bill 121 raises significant concerns.The bill's requirements, such as the affidavit requirement, place a heavy burden on homeowners and the Planning Department, potentially diverting resources from more critical issues. I urge the commission to recommend removing the affidavit requirement to alleviate this burden. Secondly, Bill 121 introduces inequity bytreating property owners and operators differently based on their living arrangements.This distinction could unfairly penalize those who contribute positively to our community and economy.Therefore, I request the commission to recommend equal treatment for all property owners and operators, regardless of their living situation. Lastly,the lack of comprehensive data on the impact of short-term rentals on affordable housing and the local economy is concerning.Without this data, it is challenging to assess the bill's potential effects accurately. I recommend that the commission advocate for an economic impact study and an affordable housing study to inform future decisions. Our community deserves regulations that are fair, enforceable, and based on solid data. I believe that by addressing these concerns,we can find a balanced approach that respects private property rights, supports our economy, and maintains the character of our neighborhoods.
