Aloha Chairperson Lin & Commission Members,
As a lifelong resident of Hawaii and a homeowner who has been
responsibly hosting short-term rentals for the past seven years, I am
compelled to express my comprehensive concerns regarding Bill 121. My
experience has allowed me to contribute positively to our local economy
while being considerate of my neighbors, many of whom were unaware of
my hosting activities due to their minimal impact. This letter consolidates my
previous communications to ensure that all my points are considered in your
deliberations on Bill 121.
Excessive Government Control and Financial Burdens: Bill 121 introduces
excessive government control over homeowners, imposing financial burdens
through annual registration fees and infringing on our privacy with invasive
signage and neighbor notification requirements. These measures not only
threaten our livelihoods but also disrupt the harmony within our
communities.
Affidavit Requirement and Restrictions on Host-Guest Proximity: The
affidavit requirement complicates the registration process unnecessarily,
placing an undue burden on homeowners. Additionally, the restrictions on
where hosts live relative to their guests are overly restrictive, infringing on
private property rights and limiting our ability to utilize our properties
effectively.
Need for Targeted Regulations and Comprehensive Review: While
acknowledge the need for some regulation to address concerns such as
parking, noise, and tax compliance, much of Bill 121 constitutes
overregulation. I advocate for targeted regulations that directly address
these issues without imposing broad requirements on all homeowners. A
comprehensive review of the bill is necessary to identify areas where
regulation can be simplified or adjusted to avoid excessive government
intervention.
Recommendations for Amendments: In light of these concerns,
respectfully request the following amendments to Bill 121:
Remove the annual registration fee requirement and invasive neighborhood
notification and signage requirements to alleviate financial and privacy
burdens on homeowners.
Eliminate the affidavit requirement and restrictions on host-guest proximity
to respect homeowners' rights and support flexible accommodation
solutions.
Conduct a thorough review of the bill to ensure it balances the legitimate
concerns of the community with the rights and contributions of
homeowners, without resorting to overregulation.
believe that with thoughtful revisions, Bill 121 can provide a framework that
ensures respectful and fair use of property in our communities while
preserving the autonomy and economic contributions of homeowners. It is
crucial that we find a balanced approach that supports both responsible
short-term rentals and the long-term health of our neighborhoods.
am against this bill as presented, I am one of many older respectful, tax
paying, hard working local residents that would likely be forced out of my
homeownership because of this regulation.
