Dear Members of the Windward Planning Commission,
I am writing to bring your attention to two critical pieces of legislation that have significant
implications for property owners and housing accommodations in our county. Bill 121 and
Bill 122, recently passed by the Hawaii County Council, warrant thorough examination and
thoughtful consideration.
1. Bill 121: Relating to Transient Accommodation Rentals and Hosting Platforms
• Bill 121 introduces new regulations governing transient accommodation rentals and
hosting platforms. While the intent is to enhance safety and standardization, it also
encroaches upon private property rights. Property owners now face a complex web of
definitions, rules, and administrative processes.
• The erosion of private property rights is a concern, and we must strike a balance
between regulation and individual autonomy. As we review this bill, we should consider
its impact on property owners' rights and the delicate balance between local needs and
constitutional protections.
2. Bill 122: Elimination of Bed & Breakfast Permits
• Bill 122 seeks to eliminate Bed &Breakfast permits, a long-standing and visitor-desired
vacation housing accommodation. By doing so, we risk reducing available lodging
options for tourists and impacting local economies.
• Property owners who previously operated Bed& Breakfasts now face uncertainty and
potential financial strain. Their livelihoods are at stake, and we must weigh the benefits
of regulation against the stability of their income.
• Additionally, we should explore alternatives to outright elimination, such as revising
existing permits to align with safety standards.
As members of the Windward Planning Commission, your expertise and insights are
invaluable in evaluating these bills. Let us engage in robust discussions, consider the impact
on property owners, and ensure that our decisions uphold both the spirit of the law and
citizens' rights.
