Your "Petition for Standing in a Contested Case Hearing" ("Petition") filed in relation to Kona
Three, LLC's application to amend a zoning ordinance ("PL-REZ-2022-000033") was received
on December 8, 2022.
The Petition will not be heard by the Leeward Planning Commission at its meeting on
December 15, 2022 because hearings on requests to intervene are only allowed for contested
cases. See County of Hawaii Planning Commission, Rules of Practice and Procedure ("RPP"),
Rule 4. Contested Case Procedure and Rule 10. Zoning Amendments. PL-REZ-2022-000033 is
not a contested case subject to the contested case procedures detailed in RPP, Rule 4.
PL-REZ-2022-000033 is subject to the procedures detailed in RPP, Rule 10, which require the
Leeward Planning Commission to provide recommendations to the Hawaii County Council
regarding zoning amendments. When the Leeward Planning Commission is acting in a purely
advisory capacity to Hawaii County Council, as it is for PL-REZ-2022-00033, the Hawaii
Administrative Procedure Act, HRS, Chapter 91's ("HAPA") contested case requirements do not
apply. See Kailua Cnty. Council v. City & Cnty. of Honolulu, 60 Haw. 428, 433-34, 591 P.2d
602, 605-06 (1979) (planning commission is not subject to HAPA when performing a purely
advisory function to the city council).
