BR-CCInitiated-TAR.doc 12/1/2023 <br />COUNTY OF HAWAII PLANNING DEPARTMENT <br />BACKGROUND AND RECOMMENDATION <br />COUNTY COUNCIL INITIATED BILL NO. 121 (PL -CCI -2024-000003) <br />AMENDMENT TO CHAPTER 25, ARTICLE 1, ARTICLE 4, ARTICLE 5, AND <br />ARTICLE 6, OF THE HAWAII COUNTY CODE 1983 (2016 EDITION, AS <br />AMENDED), RELATING TO TRANSIENT ACCOMODATION RENTALS AND <br />HOSTING PLATFORMS <br />The County Council has referred Bill No. 121 to the Planning Director and the <br />Windward and Leeward Planning Commissions for comments and recommendations. <br />PURPOSE OF BILL NO. 121 <br />1. The Hawai`i County Council has introduced Bill No. 121 (Planning Department <br />Exhibit 1), which seeks to amend Chapter 25 (Zoning Code), Article 1, Article 4, <br />and Article 5 of the Hawai`i County Code 1983 (2016 edition, as amended), <br />relating to transient accommodation rentals (TARs) and hosting platforms for <br />TARs. <br />2. The purpose of this bill is to manage the impacts of TARs by: 1) repealing the <br />definition of "short term vacation rentals"; 2) establishing new definitions for <br />transient accommodations; 3) amending the rental period from thirty consecutive <br />days or less to 180 consecutive days or less; 4) clearly identifying three types of <br />TARs; 5) defining where these uses will be allowed; 6) providing an avenue for <br />existing TARs to apply for a nonconforming use certificate that would allow them <br />to continue to operate in a non -permitted district; 7) changing parking <br />requirements to a schedule set by the planning department rather than a formula; <br />8) clarifying applicable dates for the tax amnesty; 9) creating standards to regulate <br />hosting platforms; and 10) providing new enforcement regulations for TARs. <br />CHRONOLOGICAL BACKGROUND OF SHORT-TERM VACATION <br />RENTALS <br />3. In 2018, the Hawai`i County Council adopted Ordinance 18 114 (Planning <br />Department Exhibit 2), also known as Bill 108, relating to short-term vacation <br />rentals (STVR's). With the adoption of Ordinance 18 114, the Zoning Code <br />(Chapter 25 of the Hawai`i County Code) was updated to include a definition of <br />-1- <br />
