Subject: Urgent Concerns Regarding Bill 121 and Its Impacts

Aloha Chairman Lin,
I am writing to express my deep concerns regarding Bill 121 and its potential impacts on
our community. As a resident and property owner in Hawaii, I believe it is crucial to
address several issues that could arise from the implementation of this bill.
Firstly, the bill's approach to regulating short-term rentals could significantly transform our
neighborhoods, moving away from the sense of community and aloha that defines our
island. The restrictions on where hosts live and where guests stay could lead to a decrease
in the availability of affordable accommodations for visitors, which in turn could affect our
local tourism economy.
Moreover, the bill's requirements, such as the affidavit requirement and invasive
registration processes, pose a threat to private property rights and impose undue burdens
on property owners. These requirements could deter homeowners from offering short-
term rentals, further reducing the availability of accommodations and impacting the
livelihoods of those who depend on this income.
In light of these concerns, I respectfully request the Planning Commission to consider the
following recommendations:
Remove the affidavit requirement to alleviate the burden on property owners.
Continue to define short-term rentals as under 30 days to maintain clarity and consistency.
Recommend the removal of restrictions about where hosts live and where guests stay, as
long as the owner is in the same building, on the same parcel, or on an adjacent parcel.
Several bills have already been passed regarding transient accommodations it seems the
hotel industry is not satisfied and keeps coming back to tweak these hopeful laws . As they
are designed to outlaw a Hawaiian Cottage industry .
These recommendations aim to address the enforceability, inequity, and human resource
allocation concerns previously expressed by the Planning Commission. By considering
these changes, we can work towards a more balanced and fair approach to regulating
short-term rentals in Hawaii County.
