My name is Sebastian Lancelotti, and I am writing to express my concerns about the
effectiveness of the provisions within Bill 121 in achieving the Planning Department's goals.
While the intention behind the bill may be to address issues related to short-term rentals, I
believe that the current approach may not effectively meet the objectives laid out by the
Planning Department,particularly in areas such as enforceability, equity, and the protection of
private property rights. Firstly, the bill's requirements could place an undue burden on
homeowners and operators, potentially leading to inequities in how the regulations are applied.
For example, the affidavit requirement could be seen as an invasive measure that does not
necessarily contribute to the bill's goals. Therefore, I request the Planning Commission to
recommend the removal of the affidavit requirement. Secondly, the bill's approach to defining
short-term rentals under 30 days seems to overlook the diversity of accommodations that
contribute to HawaiTs tourism and local economy. I urge the Planning Commission to
recommend we continue to define short-term as under 30 days to maintain flexibility and
fairness in the market. Lastly,the bill's restrictions on where hosts live and where guests stay
could transform neighborhoods in ways that do not align with the community's values or the
Planning Department's objectives. It is crucial to allow property owners the freedom to
manage their properties as long as they are responsible and compliant with broader
regulations. Therefore, I recommend the Planning Commission to advocate for the removal of
restrictions about where hosts live and where guests stay. In conclusion, while I understand the
need to regulate short-term rentals, I believe that a more balanced and thoughtful approach is
necessary. I kindly ask the Planning Commission to consider these recommendations to ensure
that the regulations serve the best interests of all stakeholders involved. Mahalo for your
