This meeting will be held in-person at the location listed in this notice and by Interactive Conference Technology (ICT) through Zoom. DATE: Wednesday, May 22, 2024 TIME: 5:00 P.M IN PERSON LOCATION: Ka'ū District Gym Multi-Purpose Room 96-1219 Kamani St Pāhala, Hawaii 96777 ONLINE/ZOOM: https://www.zoomgov.com/meeting/register/vJItduyrqTkrGO44A3aYuVBT9E2HYssnqRA NOTICE REGARDING PUBLIC TESTIMONY: The public may provide oral testimony at the meeting by joining Zoom or attending in-person at the physical location listed above. Although not required, to register in advance for oral testimony please contact staff at cdp@hawaiicounty.gov or (808) 961-8288. Pursuant to § 92-3, HRS, interested persons who want to provide oral testimony may do so either at the time the committee takes public statements on the agenda, or at the time the specific agenda item is called. Please note that public testimony may be limited to three (3) minutes in length per agenda item. In addition, although not required, to ensure timely delivery of written testimony to committee members, it is requested that written testimony be submitted by 4:30 p.m. at least two business days prior to the meeting via email to cdp@hawaiicounty.gov or in person at the Hilo or Kona Planning Department. When submitting written testimony, please specify for which agenda item written testimony is being submitted. All written testimony will be a part of the public record. NOTICE REGARDING INTERACTIVE CONFERENCE TECHNOLOGY (ICT): A meeting held by ICT shall be automatically recessed for up to 30 minutes to restore communication when audiovisual communication cannot be maintained with all members participating in the meeting or with the in-person location identified in this notice. The meeting may reconvene when either audiovisual communication is restored, or audio-only communication is established after an unsuccessful attempt to restore audiovisual communication. If it is not possible to reconvene the meeting as provided in this subsection within 30 minutes after an interruption to communication, the meeting will be automatically terminated. AGENDA I. CALL TO ORDER & ROLL CALL II. APPROVAL OF THE MINUTES: The Committee will consider approving the draft minutes from April 24, 2024. III. PUBLIC TESTIMONY ON AGENDA ITEMS: Pursuant to § 92-3, HRS, interested persons who want to provide oral testimony may do so now, or at the time the specific agenda item is called. Public testimony may be limited to three (3) minutes in length per agenda item. IV. BUSINESS: 1. Testimony to the Windward Planning Commission regarding the Black Sands Beach, LLC SMA application (PL-SMA-2023-000046) – Discussion and decision making on submitting testimony to the Windward Planning Commission. 2. Discussion of Implementation Priorities for 2024 – Presentation by Planning Staff to review the “Kaʻū CDP AC Action Plan for 2024” Google Form responses. Discussion and decision making on Kaʻū CDP Community Development Plan Appendix 8A: Community-Based, Collaborative Action Guide priorities and strategies for 2024. 3. Discussion of Action Committee Meeting Cadence – Discussion and decision-making regarding the scheduling, logistics, and format of future meetings. 4. Egress and Ingress at Green Sands Subdivision Regarding Kaʻū CDP Policy 118, Section 5.7.2. – Discussion and decision-making on prioritizing Policy 118 regarding hazard mitigation and evacuation routes. 5. Pāhala Water Bottling Facility – Discussion and potential decision making on findings regarding the Pāhala Water Bottling Facility. V. AGENDA FOR NEXT MEETING: Action Committee members will discuss potential agenda items for the next meeting including revisiting topics from meetings that did not have a quorum. VI. NOTICE: The purpose of the public hearings is to afford all interested persons a reasonable opportunity to be heard on the above items. A person desiring to submit oral or written testimony shall indicate their name and whether the testimony is on their behalf or as a representative of an organization or individual. Written testimony can be submitted via email or hard copy. Hard copies should include an original and nine copies and be submitted no later than 4:30pm two business days prior to the meeting. Anyone who requires an auxiliary aid or service, other reasonable modification, or language interpretation to access this meeting please contact the Planning Department at (808) 961-8288 or cdp@hawaiicounty.gov as soon as possible, but no later than five business days prior to the meeting date, to arrange for accommodations. If a response is received after the five-business days deadline, we will try to obtain the auxiliary aid/service or accommodation, but we cannot guarantee that the request will be fulfilled. “Other reasonable modification” refers to communication methods or devices for people with disabilities who are mentally and/or physically challenged. Upon request, this notice is available in alternate formats such as large print, Braille, or electronic copy. If you are a lobbyist, you must register with the Hawai‘i County Clerk within five days of becoming a lobbyist. (Article 15, Section 2-91.3(b), Hawai‘i County Code). A lobbyist means, “any individual engaged for pay or other consideration who spends more than five hours in any month or $275 in any six-month period for the purpose of attempting to influence legislative or administrative action by communicating or urging others to communicate with public officials.” (Article 15, Section 2-91.3(a)(6), Hawai‘i County Code). KAʻŪ CDP ACTION COMMITTEE KAʻŪ COMMUNITY DEVELOPMENT PLAN ACTION COMMITTEE COUNTY OF HAWAIʻI DRAFT MINUTES April 24, 2024 CALL TO ORDER Chair Pernell Hanoa called the Kaʻū Community Development Plan (CDP) Action Committee (AC) meeting to order at 5:32 p.m. A quorum was established with seven members in attendance. This meeting was held in person at the Pāhala Community Center and online via the Zoom platform. Members Absent: Catherine Williams From the County (in person): Maryam Palma, Jessica Lahip, and Tiara Cobile (Planning Department Staff); Jean Campbell (Deputy Corporation Counsel for the Committee) There were approximately 15 members of the public in attendance (12 in person and 3 via Zoom). APPROVAL OF MINUTES Committee Member Babette Morrow made a motion to approve the February 28, 2024 meeting minutes. Committee Member Jesse Ke seconded the motion. The motion passed unanimously. This item was called to order at 5:36 p.m. [SEE YOUTUBE TIMESTAMP 5:42] Committee Member Leinaʻala Enos made a motion to nominate Committee Member Jason Masters for Chairperson. Committee Member Kaweni Ibarra seconded the motion. The motion passed with 7 votes aye, and 0 votes nay. KAʻŪ CDP ACTION COMMITTEE Minutes of April 24, 2024 2 Committee Member Kaʻohinani Mokuhaliʻi made a motion to nominate Committee Member Pernell Hanoa for Vice-Chairperson. Committee Member Leinaʻala Enos seconded the motion. The motion passed with 7 votes aye, and 0 votes nay. This item concluded at 5:40 p.m. 2. Testimony to the Windward Planning Commission – Discussion and decision-making if and how the Committee will provide testimony to the Windward Planning Commission regarding the pending SMA application by Black Sands Beach, LLC (PL-SMA-2023-000046). This item was called to order at 5:41 p.m. [SEE YOUTUBE TIMESTAMP 10:10] Committee Member Babette Morrow made a motion to open discussion. Committee Member Leinaʻala Enos seconded the motion. Vice-Chair Pernell Hanoa stated that he would be submitting personal testimony, representing himself and not the Action Committee. Committee Member Leinaʻala Enos stated her concerns regarding having enough adequate time to hear the requests from the community. Chair Jason Masters asked the Committee whether they would be interested in having him and Committee Member Babette Morrow review the Kaʻū CDP for inconsistencies with the SMA application, Black Sands Beach, LLC (PL-SMA-2023-000046). Committee Member Kaʻohinani Mokuhaliʻi seconded the motion. An all-in-favor voice vote carried the motion unanimously. This item concluded at 6:44 p.m. 3. Overview of CDP Action Committee Purpose and Kaʻū CDP Implementation Priorities for 2024 – Brief presentation by Planning Department Staff on the background and purpose of the CDP Action Committee. Discussion to establish implementation projects the Committee will pursue in 2024, based on findings from the Kaʻū CDP. This item was called to order at 6:44 p.m. [SEE YOUTUBE TIMESTAMP 1:13:31]Maryam Palma (from the Planning Department) presented on the Action Committee’s role, Sunshine Law, and examples of possible CDP priorities for 2024. KAʻŪ CDP ACTION COMMITTEE Minutes of April 24, 2024 3 Ms. Palma also demonstrated how to find public notice information on the Planning Department’s website. Public notices are updated regularly by the Department. Ms. Palma provided guidance on subscribing to County Boards and Commissions email notifications. Members may then discuss ideas on actions they want to prioritize. [SEE YOUTUBE TIMESTAMP 1:54:45] Committee Member Babette Morrow raised a question regarding the Planning Department’s process for drafting the meeting agenda. Committee Member Leinaʻala Enos further suggested the Committee discuss future meetings during this time. Ms. Palma went on to discuss the process for setting the agenda, which includes Chair and Vice-Chair meetings. While the meeting of April 24 was a special meeting, requested by the Committee, the Kaʻū CDP Action Committee meets on a quarterly basis. An all-in-favor voice vote carried the motion unanimously. [SEE YOUTUBE TIMESTAMP 2:03:44] Committee Member Kaʻohinani Mokuhaliʻi raised a question for Deputy Corporation Counsel, Jean Campbell regarding motions and voting. Ms. Campbell explained that roll call votes are led by County staff calling on each member to vote separately. Under Sunshine Law, unanimous votes do not require a roll call vote. Egress/ingress at Green Sands regarding Policy 1.18, Section 5.7.2 KAʻŪ CDP ACTION COMMITTEE Minutes of April 24, 2024 4 Ms. Palma provided an update on the next steps in the Draft General Plan timeline. The public comment period closed on April 1, 2024. Currently, the Planning Department is in the process of reviewing and incorporating public feedback to revise the draft. The Department will release a Final Recommended Draft General Plan by the end of July and the public comment period will reopen.
