AN ACT
Defining Hiohways,and Defining and Establishing ceutain
Rights and Duties in connection tiieuewith.
Be it Enacted by the Queen and the Letialatitrc nf the Hawaiian
Kingdom :
THE HIGHWAYS ACT,1892.
Section 1.This Act may bo cited iii nil public proceed-
ings as "Tho Highways Act,1892."
DEFINITION OF PUBLIC HIGHWAY.
Section 2.All roads,alleys,streots,ways,lanes,courts,
places,trails and bridges iu tho Hawaiian Islands,whether
now or hereafter opened,laid out or built by tho Govern
ment,or by private parties,and dedicated or abandoned to
tho public as a highway,are hereby declared to be public
highways.
All public highways once established shall continue until
abandoned by due process of law.
DEDICATION OF HIGHWAYS BY PRIVATE PERSONS.
Section 3.Any road,alley,street,way,lane,court,place,
trail or bridge laid out,constructed,opened or maintained by
individuals or corporations as a highway,may become a pub-
lic highway by dedication or abandonment,or surrender
thereof to general use by such individual or corporation;
provided that the samo shall be accepted or adopted by tho
Minister of Interior.
DEDICATION OR ABANDONMENT.
Section 4.Dedication or abandonment of airy highway,
mentioned in Section 2 of this Act,may bo by deed or by a
surrender or abandonment ;such surrender or abandonment
shall be taken to be when no act of ownership by tho ownor
thereof has been exorcised within fivo years.
OWNERSHIP OF PUBLIC HIGHWAYS IN THE GOVERNMENT.
Section 5.Tho ownership of all public highways and tho
land,real estate and property-o-f tho same shall bo in tho
Hawaiian Government in fee simple.
SUPERVISION 'OF HIGHWAY'S IN MINISTER OF INTERIOR.
Section G.All public highways are under tho general su-
pervision,charge 'and control of tho Minister of Interior,aud,
except as otherwise provided by law,he is charged with tho
execution of all duties'relative thereto,whether prescribed by
this Aot or otherwise.
IRRIGATION AND DRAINAGE DITCHES CROSSING HIGH-
WAYS TO BE BRIDGED BY OWNER.
Section 7.AH persons or corporations excavating or mak-
ing or maintaining irrigation or drainage ditches,or ways
across publio highways,"are required to bridge such ditches
at such orossing,i and maintain the same in good repair ;and
iu case of neglect,after notice so to do,the road authorities
may coiiBtruct'the same,or repair tho same,and recover the
whole costs and expense of tho same,of such person or cor-
poration,in an action at law.Such action may bo brought
in the name of the Minister of Interior,on behalf of tho Ha-
waiian Government,and tho respective road authorities,ns
the case may bo,are authorized to institute such action.

RAILROADS,CANALS AND DITCHES CROSSING HIGHWAYS'
TO BE KEPT IN ORDER BY THE GOVERNMENT.
Section 8."Whenever highways uio laid out to cross rail-
roads,cauals or ditches tho road authorities must,at public
expense and without delay,so pieparo and guard such road,
canal or ditch that tho public may cross tho samo without
danger.
GATES IN PUBLIC HIGHWAYS.
Section 9.The Minister of Interior,in his discretion,
may permit tho establishment of gates on tho public high-
ways iu cortain cases to avoid tho necessity of building road
fences and prescribe rules and regulations for closing tho
same,provided that tho exponso for tho erection and main-
tenance of such gates shall,in all cases,bo borne by tho
party or parties for whoso immediate benefit tho samo shall
bo ordered.
SIDEWALKS.
Section 10.Upon highways of twonty-fiv-o foot in width
or over,adjoining owners may construct a sidewalk;such
sidewalk "shall not exceed si foot in width on highways Iobs
than forty feet wide.Thoy must not exceed ton foot in
width on all other highways,in all cases tho construction
and maiutonauco of sidewalks shall bo subject to such regu-
lations regarding grades,width,height,material and method
of construction,as may bo from timo to time promulgated
by tho Minister of Interior,and tho Minister of Interior may
permit,iu his discretion,tho construction of a sidewalk on
highways of twenty-fiv-e foot or less in width.
OWNER OR ABUTTOR TO CONSTRUCT AT HIS EXPENSE.
Section 11.All sidewalks shall bo constructed aud main-
tained at tho oxponso of tho adjoining ownor or abuttor sub-
ject to tho provisions of Section 12 of this Act.
SIDEWALK CONSTRUCTION.
Section 12.After tho establishment of tho grades of
streots in Honolulu,as by law prescribed,tho said Minister
may require tho owners of tho land adjoining any street,tho
grade of which has boon established,to construct sidewalks
in accordance with tho grado of tho street and to comply
with tho regulations regarding tho material aud construction
of such sidewalks.
CONSTRUCTION BY OWNER.
Section 18.If any such owner,after receiviug notice to
construct a sidewalk,as provided in Section 12 hereof,shall
neglect or refuso to comply with such direction for sixty days
after notice,tho Minister may proceed to construct such side-
walk at tho expense of such owner,such expense shall bo a
lien"on tho property in front of which such sidewalk is con-
structed,and tho Minister may rocoerhOi amount of such
lien,and the expense and costs of the same,by action at law
in assumpsit,or by any action allowed by law and equity,or
that may bo prescribed by statute.
TRESPASS OF SIKLWALKS.
Section 14.Any persons using a sidewalk constructed ac-
cording to tho provisions of this Act with mule,horse or
team,or who shall drive a wagon,bicycle or other wheeled
vehicle on such sidewalk without permission of tho ownor,
shall be liable to the owner or occupant in tho sum of fivo
dollars for each trespass,and for all damages sulVoied there-
by,to bo recovered by such owner or occupant in an action
of trespass.
TREE PLANTING.
Section 15.Any ownor or occupant of land adjoining a
public highway may plant trees in and along the said high-
way on the sido contiguous to his land ;they shall be set in
regular rows,at a distance of at least twenty feet from each
other,and so that thoy shall not interfere with the free pas-
sage of water in tho gutters,and shall be subject to such reg-
ulations as may bo,from time to time,made by tho Minister
of Interior.
TRESPASS TO TREES.
Section 10.Any person injuring the trees in front of tho
premises of any ownor or occupant without permission of the
owner or occupant shall be liable to the owner or occupant
in tho sum of fivo dollars for each tree so injured,to bo
recovered in an action of trespass ;provided,that this shall
not apply to the trimming and removal of trees by authority
of proper officers of tho Government for public purposes and
uses.
MALICIOUS INJURY TO TREKS A MISDEMEANOR.
Section 17.Whoever digs up,cuts down,or otherwise
maliciously injures or destroys any shade or ornamental trees
on any public highway,unless tho samo is doomed an ob-
struction by the Minister of Intoiior,or thoso acting under
his"authority,or by other persons by law duly authorized,
shall bo deoinod guilty of a misdemeanor.
MAPS AND RECORDS OF HIGHWAYS.
Section 18.Tho Minister of Interior is authorized and
directed to prepare maps and diagrams of all publio highways
of tho Kingdom,and ceitify to them,and copios of thorn,and
to furnish to tho rospoctivo road authorities certified copios
of tho samo relating to thoso portions of tho country con-
trolled by tho respective road authorities of tho Kingdom ;
and all such maps and cortified copios,and all locords of tho
road authorities shall constitute and bo tho publio records of
public highways.
Tho Chief Clerk of tho Department of Interior is author-
ized to sign such certificates.
MEASURING DISTANCES-MI-LE STOKES.
Section 19.Tho Minister of Interior is horoby directed to
ascertain and define mileage distances upon tho main Govern-
ment roads.A suitable mark shall be placed at each mile
indicating clearly tho distance from tlip point of doparture.
If auy of tho road authorities doom it necessary or useful,
thoy may also ascertain and maintain local mile marks ;but
in such cases tho mark shall definitely nanio tho local point
of departure.
POINT OF DEPARTURK FOR MILEAGE.
Suction 20.On the Island of Hawaii,tho general point of
departure for mileage shall bo tho Post Offico in Hilo,and
tho Court House at Waimea.On Maui it shall bo tho Court
House in Wailuku.On Molokai it shall bo tho Court Houso
at Pnkoo.On Oahu it shall bo Aliiolaui Halo.On Kauai it
shall bo tho Couit Houso at Nawiliwili.
Section 21.In addition to the distance measurements,to
bo ascertained and maintained ns by this Act provided,tho
Minister of Interior,or respective road authorities,under
direction of Baid Minister,are likewise charged with the duty
of erecting and maintaining,at all impoitant cross or branch
roads on public highways,guide posts,direction boards,or
signs with suitable inscriptions indicating tho direction of
tho nearest important points or places to which said cross or
branch roads or public highways respectively lead.
STREET NAMES.
Section 22.Upon tho corners of all streets in Honolulu,
Hilo,Wailuku and Lahaina,the street names shall bo placed
in conspicuous positions,at least 3A foot above tho street
grade.
Section 23.Whoever maliciously removes or injures any
mile board or milo stone,or guide board or guido posts,or
any inscription on such,orocted on any public highway,shall
bo deemed guilty of a misdemeanor.-.
EXPENSES.
Section 2--All expenses incurred under or in conse-
quence of the provisions of this Act,not otherwise heroin
provided for,shall be paid out of the road moneys of the re-
spective districts.
VIOLATION OF REGULATIONS A MISDEMEANOR.
Section 25.Any person who shall violate any of tho reg-ilatio-ns
or rules that may be promulgated by tho Minister of
Interior,under tho provisions of this Act,shall be deemed
guilty of a misdemeanor.
PENALTY FOR MISDEMEANOR.
Section 20.Any person convicted of a misdemeanor under
tho provisions of this Act shall bo punished by a fine not ex-
ceeding one hundred dollars.
DISTRICT COURT JURISDICTION.
Section 27.The several District Justices of the Kingdom
shall have jurisdiction to try and detormine all misdemeanors
arising under this Act,and all complaints for violation of any
of the provisions of this Act,aud to impose any of tho penal-
ties heroin proscribed.
Section 28.This Act shall take ett'eet from and after tho
date of its approval.

TUESDAY,OCT.25,1892.
Mr.Thurston assumed in the
Legislature to-da-y that the paying
of Government employees at the
end of the month depended on the
appointmout of a now Cabinet.The
fact is the enabling Act for the pa'-me-ut
of salaries did not run past
September 30,and thoro is no autho-
rity to pay them until the Appro-
priation Bill is passed.This cannot
possibly be done beforo the end of
this month anyway.Those respon-
sible for the delay are tho politicians
who sprung tho vote of want of con-
fidence on tho Legislature,largely,
if not chiefly,so that tho Ministry
should not have credit for tho policy
of retrenchment they wore ready to
submit.
A CONSTITUTIONAL BRIEF.
"Tho Constitution"is tho title of
a lawyer's brief in this morning's;
Advertiser.'It opens with tho broad
statement that "tho Hawaiian Con-
stitution of 1887 introduced in its
entirety tho systom of ministerial
responsibility which has grown up
in England by tho slow process of
centuries,and which has served as
tho typo of constitutional liberty for
almost all tho nations of Europe."
The articlo goos on to maintain,in
effect,that tho precedents of Eng-
land's unwritten Constitution aro
authoritative in construing Hawaii's
written Constitution.This conten-
tion goos too far altogether.Ample
proof can be furnished in our Su-
premo Court Reports that our writ-to-n
law does not run beyond either
its obvious or construed intent.Tho
limited scope of tlio common law in
this kingdom is evidence against tho
contention in question,at least in its
full significance.Some States of the
American Union adopted tho Eng-
lish common law at tho outset,as it
ran in tho Colonial days,but these
States in voluminous instancos havo
enacted laws to supersede the com-
mon law.The common law of one
day is likewise superseded by the
legislation of tho next day in Eng-
land itself.Even tho unwritten Con-
stitution of England is subject to
sudden changes.Tho conditions lead-
ing up to such changes aro usually of
slow,almost imperceptible growth,
but tho precedent that frequently
remains binding for an indoiinito
time is made in a moment.Leaving
aside such precedents as aro made
by the Executive and which become
binding if followed by a succeeding
Executive,it is enough to say that
thoro is no constitutional limit to
tho power of tho Euglish Parlia-
ment.Parliament can wipo out tho
monarchy and establish
a republic,and tho act will bo con-
stitutional so far as that goes.If
England should adopt a written
Constitution to-da-it would prob-
ably contain soino limitations on
this supreme power of Parliament.
Tho Hawaiian Constitution liko the
Constitution of the United States is
,a writton one.And liko that of tho
Unitod States it strictly limits tho
powers of tho Executive,tho Legis-
lative,tho Judiciary.'When thoro is
any question raised as to the true in-
tent of tho instrument,it is decided
by tho Supreme Court by the same
principles of construct ion as would bo
omployed in tho case of statute law.
English procodontis only cited when
thoro appears to bo nothing in tho
contoxt or circutnstaucos which is
adoquato to solvo tho original iutont
of tho instrument.But American
precedent has boon cited as authori-
tatively when it has fitted an omorg-ouo-y,

those facts,what nonsense is it to
ay that tho written Constitution of
Hawaii must bo construed by tho
unwritten Constitution of England!
Tlio Advertiser's attorney is un-
fortunate,however,in his applica-
tion of English precedent to our
present situation.His sweeping
jlaim that this kingdom is under
English law in respect to ministerial
responsibility carries him much
further than ho would probably be
willing to go.Without splitting
hairs as to details of procedure,it is
admitted that our written Constitu-
tion requires the retirement of a
Ministry upon a vote of want of
confidence passed by a majority of
the elective members of tho Legisla-
ture.Although tho provision is
only a negative olio,forbidding the
Sovereign to rotnovo a Ministry ex
cepting upon such a vote,still in
tho nature of things no Ministry
would delay resigning thoir commis-
sions after tho Legislature had voted
want of confidonco in thein.A voto
of want of confidence is tho only
reason why Ministors should retire
or bo removed in Hawaii oxcopt
voluntarily,or in case of impoach-nio-nt
or conviction of felony.In
England a Ministry is oxpocted to
resign or olso appeal to tho country
under other circumstances.Tho
defeat of an important ministerial
measure has tho same effect as a
direct voto of want of confidence.
When thoro is irroconcilablo dis-
sension in tho Cabinet which
becomes public is another recog-
nized cause for tlio rotiromout

states,"does not protend to recito
everything which is necessary to give
effect to its provisions,"and "the
methods of administering this S3'S-te-
in European countries and
"above all"in "England must bo
authoritative for Hawaii,"then
there will probably novor bo a case
more peculiarly calling lor tho
English appeal to the people than
the present deadlock in Hawaii.Wo
aro not advocating such an appeal,
remember,as wo boliovo it is hotter
to keep within tho terms of our
written Constitution.Tho espouse
of a general election is too groat,and
its disturbance of business too
serious,to make us readily advocate
oven tho insortion of such a pro-
vision in tho Constitution as would
givo a Ministry tho power of dis-
solving tho Legislature,especially
when our Legislature's term is only
two years against tho English Par-
liament's seven.
Tho key to Ministerial responsi-
bility in England is that tho Ministry
is responsible to Parliament and
Parliament again directly to tho
people by tho practice of having a
dissolution of Parliament when Min-
istors think that tho majority in
Parliament does not represent tho
majority of tho people.Again,this
test of tho confidonco of tho people
and Parliament in tho Ministry as a
wholo is supplemented by tho fact
that Ministers,while holding office,
must bo members of Parliament of
either HousOj and if of tho elective
branch must submit to an individual
tost of tho reliance of tho people in
thorn by resigning and being re-
elected by thoir constituents as
members of tho Ministry.Neither
of these foundation stones of tho
"system of Ministerial responsibility
which has grown up in England"

Sho Lost Her Fortune in Throo Bays
at Monto Carlo.

cide of Miss .lane Armstrong of Now
York after sho had lost a fortune at
Monto Carlo.
Miss Armstrong was an orphan,20
years old.Sho sailed from Now
York early in August,nnd,after
having visited friends in Triosto,
wont to Vontimiglia,about twenty
miles from Nice.Sho first wont to
tho Casino at Monto Carlo on Sopt.
8.Sho played insanely tho first day,
and won l(H),(XK)francs on tho
"twenty-four.-"Sho was so possessed
of tho desire to try hor luck again
that sho stopped wi 'acquaintan-
ces over night at a hotel near by,
that sho might begin playing as soon
as possible on tlio following day.
As on the first day tho "twenty-four-"

Miss Armstrong continued to piny
it.and lost heavily,bho omnmed
at tho table from midday to mid-
night,and quit it $200,000.losor.
On tho third day sho recovered
what sho had lost and left the Ca-
sino,saying that sho was ill and
would novor play tho game again.
Sho returned,however,and began
bottintr on the "twenty-four.-"She
lost steadily until hor wholo fortune
of 5250,000 was gone.As tho crou-
pier took in hor last gold coin sho
roso and loft tho Casino.To an ac-
quaintance,who mot hor at tho door
and remarked on her paleness,sho
said that sho had lost all,and was
going to friends in Trieste,who
would see that sho got back to tho
United States.Sho did not no to
Triesto,however,but shot herself in
a room in a villa at Vontimiglia.
Tho usual effort was mado at
Monto Carlo to suppress tho news,
and tho report was sent out that tho
Miss Armstrong who had killed her-
self was an elderly lady who had
left Monto Carlo for Triesto soino
days boforo,and had committed sui-
cide there.Two men,said to bo
Englishmen,who had lost all their
money at tho Casino,sprang into
tho sea on tho night of Miss Arm-
strong's suicide.Those suicides also
aro denied by tlio Monto Carlo peo-
ple.
