After our review of the above referenced Use Permit Application, we are returning the
application and are requesting the following information to be provided before acceptance:
1. Please provide one of the following regarding Archaeological Resources:
a. An archaeological inventory report containing significance assessments,effect
determinations, and proposed mitigation commitments. The report should be
completed pursuant to State Department of Land and Natural Resources
Historic Preservation Division(DLNR-SHPD)rules.
b. A "no effect"letter from the State DLNR Historic Preservation Division.
c. A copy of a letter written by the applicant to the State DLNR Historic
Preservation Division requesting a"no effect" letter, including supporting
documentation,to which SHPD has not responded after 30 days(SHPD's time
limit under their rules).
2. The landowner, Waikoloa Baptist Church, originally received approval via Use
Permit No. 99 to construct a church and related improvements. Conditions of the
permit have lapsed and the Church has not submitted an amendment request for
the lapsed conditions. Please provide information regarding the owner's proposed
actions to bring their permit into compliance. We are attaching the last letter to
the landowner for your information.

In the future, we do not need 21 set of full drawings for the submittal. One full set along with
8 1/2 by 11 inch copies of the drawings submitted with the applications would be sufficient for
acceptance.
We are enclosing a receipt for the filing fee and will hold the applications and filing fee for the

On July 21, 2006 the PlanningeComMission approved a 2-year time extension to comPly with
Condition Nos. 4 and 5, and.revised these coriditions to eliminate phasing of the development.
At that time a new site plan was submitted showing the existing day Care centertworship.center,
proposed multipurpose recreation building,proposed worship center building, proposed
education center, and two proposed pastor's residences. Condition No:4 required that Final Plan
Approval for the remainder of the development be secured by July 21;2008, but we have not yet
received an application for plan approval from you. Therefore, a request for an extension of time
to complete Condition No. 4 must be submitted with the application fee'of$250. The original
and 20 copies of this request should state the specific reasons:for requirifig the time extension.
