RESOLUTION NO. 12.1. 11
A RESOLUTION AUTHORIZING A ZONING PRE - EMPTION FOR A LOW -
INCOME HOUSING PROGRAM TO BE PROVIDED BY HOPE SERVICES
HAWAI'I, INC.
WHEREAS, the County of Hawai'i through its County Council passed Resolution
371 -10 authorizing the Office of Housing and Community Development to transfer 20
housing units located in Kawaihae to Council District 5 ; and
WHEREAS, Hawai'i Revised Statutes (HRS), Section 201H -38, in conjunction with
HRS 46 -15.1, allows the County, with approval of the County Council, to exempt low - income
housing projects from certain code and zoning requirements to facilitate the development of
the project; and
WHEREAS, HOPE Services Hawai'i, Inc. wishes to store and rehabilitate the
transitional units at that certain parcel of land located in and identified as Tax Map Key (3) 1-
5- 006:017; and
WHEREAS the rehabilitation of the units will be done in consultation with the County
to ensure that the minimum requirements of health and safety can be met; and
WHEREAS, HOPE Services Hawai'i, Inc. intends to subsequently make the units
available as housing for needy individuals and families; and
WHEREAS, HOPE Services Hawai'i, Inc. has requested that the County exempt the
subject property from the current Agriculture One -Acre (A -1 a) zoning to allow it to used as
permitted by Multi - Family Residential Two Thousand (RM -2) zoning.
NOW, THEREFORE, BE IT RESOVED BY THE COUNCIL OF THE COUNTY OF
HAWAI'I, that a zoning exemption from Agriculture One -Acre (A -la) to Multi - Family
Residential Two Thousand (RM -2) is hereby approved.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that a
copy of this resolution be transmitted to the Planning Director and Housing Administrator of
the County.
BE IT FURTHER RESOLVED, that this resolution shall take effect immediately.
