RESOLUTION No. ~6 69
RESOLUTION OF THE COUNTY COUNCIL OF THE COUNTY OF HAWAII AUTHORIZING THE
EXEMPTION OF CERTAIN ZONING, SUBDIVISION AND ROADWAY CODES AND
REQUIREMENTS, PURSUANT TO HRS SECTION 201E-201 AND 201E-210, FOR THE
PROPOSED KALALOA SUBDIVISION PROJECT.
WHEREAS, the Housing Finance and Development Corporation (HFDC) and
the Hawaii County Housing Agency (HCHA) are empowered to develop and sell
dwelling units to persons of low and moderate income; and
WHEREAS, the HFDC and the HCHA have proposed a residential housing
project for moderate income families to be constructed in Lalamilo, South
Kohala, Hawaii to be known as the Kalaloa Subdivision; and
WHEREAS, the preliminary plans and specifications submitted for said
Kalaloa Subdivision are attached hereto as "Exhibit A"; and
WHEREAS, HRS §201E-210 allow certain residential housing projects to
be exempt from certain laws and rules, provided that the County Council
approve the project; and
WHEREAS, §23-83, of the Hawaii County Code, provides that the County,
in lieu of its granting final approval to a subdivision prior to the
completion of improvements thereupon, may accept an agreement to complete
said improvements, such agreement to be secured by a good and sufficient
surety bond, certified check or other security acceptable to the planning
director; and
WHEREAS, the Kalaloa Subdivision project will promote the goals
contained in HRS §201E, HRS §46-15.1, and in Chapter 2, Article 13, of
the Hawaii County Code.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII
that the Kalaloa Subdivision project is hereby approved according to the
preliminary plans and specifications attached hereto as "Exhibit A".
BE IT FURTHER RESOLVED that pursuant to the exemption provisions of
201E-210, Hawaii Revised Statutes, the Kalaloa Subdivision project will
be permitted to start construction of the homes prior to compliance with
25-39 of the Subdivision code.
BE IT FURTHER RESOLVED that the planning director may accept a letter
from the HFDC guaranteeing completion of the necessary improvements as
security sufficient to satisfactorily fulfill the bond requirements of
23-83, of the Hawaii County Code.
BE IT FURTHER RESOLVED that copies of this resolution be sent to the
Executive Director of the Housing Finance and Development Corporation,
the Administrator of the Office of Housing and Community Development and
the Planning Director for the County of Hawaii.

The Office of Housing and Community Development has submitted to the
Hawaii County Housing Agency (HCHA) a resolution of the County Council of
the County of Hawaii authorizing the exemption of certain zoning,
subdivision and roadway codes and requirements, pursuant to HRS Section
201E-201 and 201E-210, for the proposed Kalaloa Subdivision project.
The HCHA has reviewed and approved the resolution at its meeting of
July 19, 1989. Accordingly, I am requesting that the resolution be
included on the Council agenda for action at its August 2, 1989, meeting.
