CALL TO ORDER: The meeting called to order at 3:12 pm by Eric Gee 2. CHAIRPERSON ERIC GEE WELCOME LETTER 3. STATEMENTS FROM THE PUBLIC - None. 4. NEW BUSINESS - 6a. Moani Yamanoha (Hawaiʻi Public Health Institute Youth Council) Presentation. o Kyla-Marie Turner asked: Do you guys work with for the coalition? Uh what groups are a part of the coalition? Moani Yamanoha said they are partnered with Pacific Health Institute & The Coalition for a Tobacco Free Hawaii. o Benjamin Rudo: asked “Is there like a specific amendment, like article that is already drafted up, related to this.” Scott responded “It to support bill 102.” Moani Yamanoha said to reach out to her or Scott. Eric suggested redirecting these questions when they are talking about the bill. o Cheydon Naleimaile-Evangelista: asked if someone wants to do work with them, how would that work? - Eric Gee asked someone to make motion to approve November meeting minutes. Benjamin Rudo motions & Cheydon Naleimaile-Evangelista seconds to approve. o VOTING: with 11 ayes meeting minutes were approved. - 5a. Old Business o Eric Gee: discussion on approval of draft mission bylaws. Chaden Evangelista read draft. ▪ Eric Gee: we need a motion made and seconded to approve the Commission bylaws as drafted before we can discuss. Benjamin Rudo motions & Perseas Vanebo seconds. • Benjamin Rudo: asked about adult advisors terms. “Can they do only one year term or many one year terms?” Eric Gee clarified it is up to commission to decide this. • Benjamin Rudo: moved commission for discussion on term limits for adult advisors. Article 6d Paragraph 1. Kyla-Marie Turner seconded. o Make 1 year terms with potential to renew for 1 year terms. • Keyra Wong: stated they will need to go back to council to determine the term dates of commissioners. o Pomaikaʻi Bartolome shared she spoke with Betsy to push term dates from February 2024 to October 2024. Betsy is researching to see how to work around that. o Jenn Kagiwada said “we landed on that She would see if we could start their terms based on the first meeting as opposed to that that ninety-day rule.” o Pomaikaʻi Bartolome: she didn’t make changes to fact sheet yet because she did not hear back yet. o Keyra Wong: said she will look into it further to determine when commissioners term dates end. County of Hawai`i is an Equal Opportunity Provider and Employer. Jenn Kagiwada: asked “about um Commissioners being approved by the Council, Article 4 -Organization and Meeting #2. We ended up just introducing people to the Council, but not actually needing approval. You are automatically appointed by your Council person or by the Mayor. She also asked to strike out the need for county council approvement. Made a motion and Damon Nagata seconded. Jenn Kagiwada: asked “We talked about, alternating the meetings between Kilo and Kona.” Going forward there will be only one physical location switching between Kona office and Hilo Office and a zoom link available for anyone unable to drive to either location. Cheydon Naleimaile-Evangelista motioned to move to approve the Commission bylaws as amended. Kyla-Marie Turner seconded. Eric Gee moved discussion to agenda item 6b, discussion on Bill 102 draft one and ordinance amending Chapter fourteen of the Hawaii County Code 1983 (2016 as amended) by adding a new article relating to the prohibition of flavor, Tobacco products. County of Hawai`i is an Equal Opportunity Provider and Employer. - Jenn Kagiwada shared that if the commissioners agree with this to help support the county council as they need as much support as possible. Honolulu has already passed a similar bill. If passed it wont come into effect until 2026 because state has to pass a bill and counties cant pass more stringent bills than the state. o Benjamin Rudo asked if they can get a copy and Eric Gee suggested to have a copy emailed to all commissioners. o Kyla-Marie Turner asked if the bill has anything to do with decriminalizing youth tobacco use. Jenn Kagiwada said there is no language doing that, it’s aimed more at the marketers and companies doing the selling. - Cheydon Naleimaile-Evangelis suggested that commissioners do attend for greater impact for county council hearing. Eric Gee asked for rules regarding clarification how many commissioners can go to the meetings at the same time pertaining Sunshine Law. Keyra Wong responded that less than quorum, so only 6 commissioners can attend. And the commission does have to determine their stance during the meeting. o Shannon Matson clarified if they are testifying on behalf of the commission, they need to vote on the thing they are testifying on. o Keyra Wong clarified commissioners can not testify on their own behalf, when in front of ‘bodies’ then they are considered a commissioner. o Benjamin Rudo asked the main point of the bill. Jenn Kagiwada responded saying it is to stop having flavored tobacco in our county available at all. Benjamin Rudo share his worry about banning things in general and that they can lead to unintended consequences. ▪ Eric Gee clarified about the bill: “it's not necessarily specifically about the flavoring it's the fact that it's the flavoring is used to manipulate youth into vaping and purchasing these products. So that's kind of, I think, more of where the bill is.” o Eric Gee requested for commission to take a stance on the matter. ▪ Cheydon Naleimaile-Evangelis made motion to support bill 102. Eric Gee seconded. • Kyla-Marie Turner requested that an addition be made to create educational materials for people to understand why the bill is being made. She shared how she really wants a sense of transparency and education so everyone understands why the law is being passed. • Cheydon Naleimaile-Evangelis withdrew his motion to support bill 102. • Kyla-Marie Turner made a motion to support bill 102 with the caveat to create educational materials for the public as to the reason for the bill. Eric Gee asked which commissioners would like to attend the county council meeting the following week on December 20th starting at 9am. - Kyla-Marie Turner volunteered to attend in Hilo. - Jenn Kagiwada clarified that commissioners can testify on a matter at the very start for a latter topic so that they won’t have to sit through the whole day for their turn. Eric Gee motioned to move agenda item 6c, 6d, to the next meetings agenda. Benjamin Rudo seconded. Everyone voted Aye. Eric Gee moved discussion to 6e for any topics or speakers for next meeting. - Kyla-Marie Turner brought up the war between Palestine and Israel. She would like for the youth to become educated on the current conflict. Suggested she would like to arrange to have a presentations about the conflict and to share pro-Palestinian stories with us. o Kyla-Marie Turner made motion to “add to agenda for some time allotted maybe a ten minute presentation um m where Palestinians and the outstanding support for the same time and talk to us online. Um, probably through. Zoom about what's going on.” ▪ Goretti Allen seconded motion. ▪ All commissioners said Aye. • With 9 Ayes, the suggestion will be added to next agenda. Eric Gee moved to item 7 on agenda. - Next Youth Commission meeting is Wednesday January 10th, 2024 in Kona and on Zoom. Eric Gee requested a motion for adjournment. o Cheydon Naleimaile-Evangelista motions to adjourn. Kyla-Marie Turner seconds. ▪ All commissioners said Aye. • With 9 Ayes, the meeting was adjourned at 4:34pm. Submitting Testimony: Those wishing to testify in person must register with the Commission Secretary at the meeting. Those submitting written testimony at the meeting should bring 10 copies for distribution. Testimony may be submitted by (1) mail to Youth Commission c/o Office of the Mayor, 25 Aupuni St., Suite 2603, Hilo, HI 96720; or (2) by email to. Please submit separate testimony for each item. Copies will be distributed by the commission secretary at the meeting. All oral and written testimony will be public record. Notice to Lobbyists: If you are a lobbyist, you must register with the Hawai‘i County Clerk within five days of becoming a lobbyist [Article 15, Section 2-91.3(b), Hawai‘i County Code]. A lobbyist means “any individual engaged for pay or other consideration who spends more than five hours in any month or $275 in any six-month period for the purpose of attempting to influence legislative or administrative action by communicating or urging others to communicate with public officials.” [Article 15, Section 2-91.3(a) (6), Hawai‘i County Code] Registration forms and expenditure report documents are available at the Office of the County Clerk, 25 Aupuni St., Room 1402, Hilo.
