The Leeward Planning Commission met in regular session on Thursday, June 20, 2024, at 9:31
a.m. in the West Hawai‘i Civic Center, Council Chambers, Building A, 74-5044 Ane
Keohokālole Highway, Kailua-Kona, Hawai‘i, with Chairperson Barbara DeFranco presiding.
This meeting was streamed live on YouTube.
COMMISSIONERS PRESENT: Mahina Paishon Duarte (Vice Chair), Dean Au, Clement “CJ”
Kanuha, Donna “Kinuko” Noborikawa, Armando Rodriguez, and Barbara DeFranco
(Chairperson).
ABSENT AND EXCUSED: Michael Dela Cruz.
ALSO PRESENT: Suzanna Tiapula, Esq. (Deputy Corp Counsel to the Commission), Jean
Campbell, Esq. (Deputy Corp Counsel to the Planning Department), and Zendo Kern (Planning
Director) and Planning Department staff.
Approximately 11 public members were in the audience.

Staff introductions were made. She asked each Commissioner to confirm they have had the
opportunity to review all materials, including written public testimony, related to the applications
being reviewed today. It was noted that each Commissioner verbally confirmed the review of

APPROVAL OF MINUTES
At 9:37 a.m. the Commission took up the minutes of the April 18, 2024, and May 22, 2024,
Leeward Planning Commission meeting. No corrections were offered. It was moved by
Commissioner Kanuha and Seconded by Commissioner Au that the minutes be approved as
submitted. A voice vote was taken, and the motion was carried with all in favor. [SEE

STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS
At 9:39 a.m. the Commission took up this item with approximately 11 public members in the
audience in the Council Chambers. Chairperson DeFranco stated she will be limiting testimony
to 3 minutes per testifier for each agenda item. Chairperson DeFranco explained the procedure

UNFINISHED BUSINESS
1. APPLICANT: KAUPULEHU LAND LLC (PL-SLU-2022-000008)
Application for a State Land Use Boundary Amendment from Agricultural to Rural for
2.653 acres of land. The subject property is located at 64-983 Māmalahoa Highway,
approximately one mile east of its intersection with Kawaihae Road, Puʻukapu
Homesteads, South Kohala, Hawai‘i, TMK: (3) 6-4-024:027.
2. APPLICANT: KAUPULEHU LAND LLC (PL-REZ-2022-000039)
Application for a Change of Zone from an Agricultural-5 acre (A-5a) zoning district to a
Neighborhood Commercial-10,000 square feet (CN-10) zoning district for 2.325 acres of
land and from an Agricultural-5 acre (A-5a) zoning district to a Residential
Agricultural-0.5 acre (RA-0.5a) zoning district for 3.024 acres of land. The subject
property is located at 64-983 Māmalahoa Highway, approximately one mile east of its
intersection with Kawaihae Road, Puʻukapu Homesteads, South Kohala, Hawai‘i,
TMK: (3) 6-4-024:027.
The Commission took up both items at 9:40 a.m. for the purpose of the presentation and fact

Commissioner Rodriguez asked about the flood zone status of the property. Ms. Jackson

Vice Chair Paishon-Duarte expressed concerns about traffic flow and congestion. Ms. Jackson
explained that the applicant conducted a traffic study. The Department of Transportation's main
concern was the two access points from the highway. They agreed to approve only one access
point, prompting the applicant to revise their site plan accordingly. The applicant will propose a

Commissioner Noborikawa inquired about written confirmation from the State Department of
Transportation. Ms. Jackson mentioned an email from the district engineer, adding that the
applicants need DOT permits to develop access points onto their roads. DOT has the authority to
restrict or allow such access, issuing permits after commission approval. [SEE YOUTUBE

Commissioner Rodriguez raised concerns about the building's height and the existence of
CC&Rs. Katherine Garson confirmed CC&Rs will be in place. Planning Director Kern
referenced visual renderings on page 72 of the background report. Commissioner Kanuha
expressed traffic and community engagement concerns. Katherine Garson assured the
commission that Mr. Metzler had engaged with community members regarding traffic and access

Vice Chair Paishon-Duarte followed up on community engagement diversity. Commissioner Au
asked about outreach to the Waimea Community Association and neighboring landowners. Mr.
Metzler confirmed the outreach to nearby property owners but not the association. [SEE

Commissioner Noborikawa asked about contacting lineal descendants regarding possible burials,
noting historical farming use since the 1920s. Chair DeFranco recalled the property's history as

Vice Chair Paishon-Duarte thanked Mr. Metzler for his stewardship and inquired about steps

Chair DeFranco asked for a motion for action. Commissioner Au moved that a favorable
recommendation be forwarded to the County Council on PL-SLU-2022-000008 based on the
Planning Director’s recommendation which shall be adopted. Seconded by Commissioner

Chair DeFranco initiated the discussion. Commissioner Au emphasized property owners' rights
to develop within state and county regulations, noting the applicant's compliance through
multiple hearings and processes. Commissioner Noborikawa clarified the property's dual urban-
agricultural designation and supported the project for creating a boundary between these zones,
consistent with the General Plan’s Land Use Pattern Allocation Guide Map. Chair DeFranco also
supports the project, highlighting its design in harmony with Waimea's aesthetic and compliance

Chair DeFranco clarified that the Leeward Planning Commission's decision wasn't final and that
it still needed approval from the County Council. She highlighted concerns about the flood zone
status. Katherine Garson confirmed the area was still in a flood zone and offered to bring in their
engineer if the commission needed further information on flooding concerns. [SEE YOUTUBE

regarding flood mitigation. He explained that their approach to flood mitigation adheres to
drainage standards required for projects in the AE flood zone. They follow both FEMA and
County guidelines to ensure construction within these zones does not exacerbate flooding,
aiming to protect both neighbors and applicants from flood damage rather than eliminating the

Commissioner Au made a point of order that the motion on the floor is for the State Use Land

At the June 20, 2024, meeting, a roll call vote was taken, and the motion failed with 3 ayes (Au,
Noborikawa, and DeFranco) and 3 nays (Kanuha, Paishon-Duarte, and Rodriguez) [SEE

Commissioner Au proposed a motion for an unfavorable recommendation on application PL-
SLU-2022-000008 to the County Council, pending discussion on specific reasons. Commissioner

Kanuha seconded the motion. Chair DeFranco clarified the motion was for discussion purposes

Action: At the June 20, 2024, meeting, it was moved by Commissioner Kanuha and seconded
by Vice Chair Paishon-Duarte to forward an unfavorable recommendation to the County Council
on PL-REZ-2022-000039 for the following reasons: concerns over lack of community

vote was taken, and the motion carried with five ayes (Kanuha, Paishon-Duarte, Au,

Ms. Jackson sought clarification from Deputy Corp Counsel regarding the State Land Use
Boundary Amendment. In the absence of a valid motion, she presumed the application would be
forwarded to the County Council with an unfavorable recommendation. Deputy Corp Counsel
Tiapula clarified that since no motion had succeeded, technically no action had been taken. The
commission could continue discussing, make a new motion, or leave it to proceed without action,
resulting in an unfavorable recommendation by default under the 90-day rule. She distinguished
between two scenarios: Item #1, where no action was taken, resulting in an unfavorable
recommendation without stated reasons; and Item #2, where a motion was successful, reasons
were given, and the recommendation would proceed with those reasons to the council. [SEE

Hwy, approximately 580 feet south of its intersection with Kalelei Street, Keauhou 2nd

Commissioner Noborikawa discussed the proposal for an additional farm dwelling, emphasizing
that farm dwellings are meant for housing agricultural workers or those benefiting directly from
agricultural activities. She expressed concerns that a bed and breakfast (B&B) might not align
with this purpose. Ms. Jackson clarified that the B&B would be considered the primary farm
dwelling, while the larger house where the operator lives would become the additional farm
dwelling, as the operator is actively farming avocados on the property to comply with state law.

Commissioner Noborikawa questioned the perpetual nature of agreements for additional farm
dwellings, referring to Planning Department Rule 13 and a notarized statement regarding future

Commissioner Rodriguez inquired about the requirements for special use permits, specifically
regarding signage and notification to neighbors. Ms. Jackson confirmed that applicants must post

6. INITIATOR: COUNTY COUNCIL (PL-CCI-2024-000007)
Bill 134, Draft 2, an ordinance amending Chapter 25 (Zoning), Article 2, Section 25-2-
42, of the Hawaiʻi County Code 1983 (2016 Edition, as amended), relating to
amendments initiated by property owners and other persons. Establishes the requirement
for the Planning Director to prepare a report identifying all buildings, excluding existing
buildings, that are legally permitted to be constructed on surrounding properties within a
one-quarter mile radius of a subject property that is seeking a change of zoning district.

Planning Director Kern elaborated on the importance of accurate information from various
departments when evaluating development potential. He emphasized that zoning alone isn't
sufficient; factors like water and sewer availability are crucial for determining actual
development feasibility. He expressed concern about distinguishing between theoretical density

Councilmembers Holeka Inaba and Cindy Evans stated they introduced this bill to enhance the
information available to the Planning Commissions and County Council for zoning change
applications. They emphasized the need for comprehensive data to support informed decision-

Noborikawa sought clarification on the proposed radius size from Councilmember Evans and
discussed potential strain on planning department staff with Planning Director Kern, who

Councilmembers and the Planning Department. Councilmember Inaba acknowledged the
importance of collaboration and committed to working closely with the Planning Department to

Bill 144, an ordinance amending Chapter 4 (Animals) and Chapter 25 (Zoning) of the
Hawaiʻi County Code 1983 (2016 Edition, as amended), relating to apiaries and
beekeeping. Establishes accepted apiary management practices for sound and sustainable
beekeeping practice, and adding apiaries to the list of allowable uses in various zoning
districts.

The Commissioners had no input regarding agenda items for the next Commission

ANNOUNCEMENTS
The Leeward Planning Commission’s next regular meeting is scheduled for Thursday,
July 18, 2024, at the County Council Chambers in Kona and the public can also testify
via Zoom. The date and venue of the meeting are subject to change. [SEE YOUTUBE

Ms. Jackson made an announcement that there will be four items on the next agenda, including
two items that were deferred today and then there will be a training provided by Deputy
Corporation Counsel Tiapula on parliamentary procedure in closed session which will occur at

There being no further business, it was moved by Vice Chair Paishon-Duarte and seconded by
Commissioner Kanuha that the meeting be adjourned. A voice vote was taken, and the motion
was carried with all in favor.
