HomeMy WebLinkAbout2024-07-30 Diane Ware Testimony From: Diane Ware To: WPCtestimonv Subject: Agenda item 1,08/01/24 Date: Tuesday,July 30,2024 3:55:36 PM Dear Chair Lin and Commissioners, The Colony 1 HOA has updated the filing for a contested case in the matter of the SMAA application for Black Sands Beach development at Punalu'u.Mr.Silva has qualifications with water and sanitation systems and was appointed by the board to represent the owners in this matter.The board has provided numerous documents to not only clear up questions the committee had regarding their standing including the board's February 2024 meeting minutes but also documents that back up their claims regarding health and safety issues not as yet corrected by the owner,Ms.Liu,of Punalu'u Water and Sanitation LLC after 4 years of ownership.The engineering report also states that the current system capacity was downgraded by the HDOH in 2017 to 20,000 g/d from 100,000 g/d.The downgrade was never reported in the SMAA,only the original capacity. PWS is a privately owned public utility regulated by the PUC under docket 2018-0408. In it is included the Aqua Engineering report regarding the condition and lifespan of PWS.In the case of the wastewater treatment system Aqua Engineers recommends replacing the wastewater facility and upgrading it to R-1 with a more"eco friendly"system.This recommendation aligns with the proposed system upgrade outlined in the 2006 DEIS. I recently spent a week at Colony 1 and witnessed the deficiencies and can say I would also live in fear of fire and failures in the water and sanitation system.I saw the broken fire hydrants and the pump station just below the condominiums.The building looks dilapidated with a hole punched in one wall to divert smelly,flowing sewage into a manhole.It was frightening.Below is my photo taken mid May very similar to the one provided by the HOA. The hose is a soft material easily perforated and would leak into environment 36'above sea level and close to ponds.What is going on here?This needs to be corrected and brought up to current standards before any new development is approved. ❑— ❑® I wholeheartedly encourage you to reconsider the HOA contested case and take steps to protect residents and the health of nearshore waters and wildlife like honu.
