Kekai Deputy Director MEMORANDUM No. BLD-24-003R Effective immediately, the Building Division will accept the following three additional document types as proof of ownership when the Owner is not the party listed on the Real Property Tax website. 1.Filed conveyance deed that indicates the property passed to the permit applicant; the copy of the acceptable deed shall be a filed copy, i.e., the deed must be filed with the Bureau of Conveyances; a filed deed will have a file stamp from the Bureau, a HawaiiState seal, and a document number; 2.Final settlement statement from an escrow company that indicates the property was purchased; or, 3.Notarized letter of sale that states the property is in escrow and ownership will be transferred upon issuance of the Building Permit. Purchase agreements, and other documents showing an upcoming sale shall not be accepted. The notarized letter of sale must be signed by seller, buyer, and lender. If permit applicants are unable to provide any of these documents, the original Owner (i.e., the party listed on the Real Property Tax website) may apply for and receive the building permit. Once ownership is documented, the new Owner may submit a Transfer of Ownership form. Permit applications that are submitted prior to September 1, 2024, with the prospective (new) Owner on the Declaration of Ownership and plan sheet title block will be accepted. However, if plans require re-submittal, then the resubmitted plans shall bear the name of the original owner and a revised Declaration of Ownership for the original owner shall be submitted.
