Please resolve confusion as to how many units and floors are planned. Note that the condo would drastically change the character of the area. The style is industrial, not in keeping with the Ali'i Drive Scenic Corridor. Several on-street parking spaces would be removed, increasing parking problems and making shoreline access more difficult. The driveway space from the gate to the main road is only nine feet, so cars will line up waiting to enter, blocking traffic. A lava dome would need to be removed for the swimming pool, but that would cause damage to the lot next door and require removing a power pole. When I was growing up, Kona was a quiet village without even one traffic light. But, in my lifetime, it's exploded into"Little L.A.". Please protect Kona from even more harm. There are numerous problems with the application, but just to name a few; 1.)Totally inadequate parking for residents and guests. No provision for ADA parking. 2.)Entry gate would be putting cars waiting across the bike/walking path as well as in the street blocking traffic. This would create a dangerous condition for drivers, bicyclists and pedestrians. 3.) A 5 story building is totally out of character for this section of Alii Drive. The proposed massive box like structure would block views and leave it looking like Urban Core type structure. This is wholly inappropriate for Alii Drive. Notably it is surrounded by single and two story modest structures. 4.) The plan proposes to convert 75%of the lot to imperious surfaces, this violates good building practices as it creates run off into storm drains and prevents natural pecolation of rainwater. 5.) The proposed improvement violates setback requirement of the zoning code. This appears to be one of many application filed in recent history for Alii Drive where the architect attempt to just through plans at the wall hoping they will stick. I am a residents and community members and I oppose the proposed six (8?)-unit condominium seeking SMA permit 21-000078. The application contains inaccuracies as well as a false description of the area giving the reader an impression the area is primarily condominiums and vacation rentals. While in fact, the area remains to be a "beach community", the proposed development will severely and negatively impact the charm of the community. While there may be additional concerns to the proposed development, the following descriptions should cause enough alarm to deny the application in its current form. The elevation (A012), and renderings (Figure 5a, 5b) depict a 5 STORY steel and glass industrial design style** that is inappropriate to the Alii Dr. Scenic Corridor. The values of the Scenic Corridor are based on a vision to preserve the historical and cultural design language of the village and 'The Kailua to Keauhou Beach Road". The proposed 5 STORY structure is jarring in relation to the neighborhood, and overwhelming in size and impact on the small lot (less that 10,000 sq ft. The proposed building will be very similar to the new Kona Brew brewery, in the old industrial area. The map, Figure 1 , as presented makes it appear that the property (TMK : (3) 7-5-020: 066) encompasses the entirety of lot 3, when in actuality it is less than 1/2 the area of the combined properties. This creates a false impression of buildable area in the presentation, and does not provide accurate information regarding the property scope. The driveway as shown will remove five currently available on-street (Alii Dr.) parking spaces. The adjacent Shoreline Access* is heavily used by families, surfers, divers, fisherpersons, and ocean access in general. Street parking is critical to the enjoyment of our shoreline by the public, and this neighborhood has very limited on-street parking. Shoreline Access, aka 'Old Canoe Road', Royal Patent by Kauikeaouli, and is now a private driveway. Although the shoreline access only requires a 5' wide pedestrian 141641 accessway, historically vehicles enter, unload/load while parking on the street, and adjacent properties support that limited community use. The subject property does not have legal access to the driveway. The access gate as presented in A001 Site Plan, is approximately 9' from the edge of Alii Dr. Vehicles attempting to enter the 5 STORY property would be forced to stop in the Alii Dr. traffic lanes and wait while the gate cycles, creating a traffic delay and public safety problem. Measurements to gated properties in both directions on Alii Dr. vary from 20' to 29', and clearly indicate past address to this potentially hazardous situation: Part of the property area consists of a large lava dome, that varies from 3'6" to 5'6" height above grade. The applicant proposes a swimming pool in this location. A HELCO inspector stated that it would not be possible to remove this natural feature without destroying the adjacent lot portion, and resulting in the loss of that property's power service pole. The plans submitted for permit are either fraudulent, or inaccurate. Initially, there is confusion related to number of floors, as the plans utilize the European floor numbering protocol, which makes it seem to be only four levels, when in actuality there are five. Ground level (A001 ) exhibits the site plan, including the before mentioned un-permittable entry from Alii Dr. and swimming pool proximity to a live high-voltage electric source (less than 5'). Level 2 (A003) shows two adjacent condo units. Level 3(A004) shows two adjacent condo units. Level 4 (a005) is stated as the lower level of two two-story units, however there are no internal stairs in either unit, nor open floor space in which to install same. Levels ground through four are serviced by an elevator. Level 5 (A006) is stated as the upper level of the two-floor units. These floor plans show internal stairs, but the floor below does not, and as drawn cannot support a stair landing from above. The only access to level five is via an outside stair from the fourth-floor lanai, there is no elevator or enclosed stair. Additionally, the fifth-floor units both contain a full kitchen. 2 AS SHOWN IN THE SUBMITED DOCUMENTS THIS IS AN EIGHT UNIT BUILDING. Whether this is an error, or a deliberate attempt to sneak in two additional units cannot be determined by the public. This permit must be rejected as presented, and an accurate plans set submitted so that the public is correctly informed, and can respond from a knowledgeable position. While recognizing that the proposed use may be qualified under the current zoning, the permit application must be amended for accuracy and, the design language and style of the building modified to fit into the surrounding environs. There has been no thought on the part of the applicant to create a project that fits the scale and sensibilities of a residential neighborhood. As of the morning of May 03, 2021 there is heavy equipment on the lot excavating within the Shoreline Management Area without permit! Please get clarification on the above issues and find out if they are still excavating without permit! I'm the longest serving member of the KCDP Action Committee and have been involved in it since its inception. I spent many hours collating our region's stakeholders' comments regarding their goals an visions for their communities and have listened for 15 years about how they want to see their visions implemented and those and their communities protected. One of the most agreed upon goalst is that our residents don't want to build their town and coastlines up like Oahu has, with only designated TODs and TNDs (so-called "village centers")having heights at the 4- or 5-story range. The location of this proposed project does not meet this requirement and, in fact, goes against the wishes and visions of a majority of Kona's takeholders. I will defer to others to speak to the environmental and cultural aspects of lining our coastline with higher and higher rising buildings. However, it's clear that blocking sea breezes means a hotter climate. View planes are gold. And this project sets a new precedent of blotting out view planes seaward and mauka —forever. Sea level rise, additional traffic, loss of sense of place, subsistence and cultural activities including surfing...There are so many reasons why you, in your capacity as a representative of We the People,must deny this applicant such a greedy, myopic plan that uses Kona as a commodity rather than a place where people live. Our healthy future upon grassroots generated growth—not top-down,developer-generated, destructive plans like this one. All I see is owners of the property tring to maximize their profit potential. My Uncle and Aunty had a home on Alii Dr just south of Kona Shores Apt building. They had to sell their home as the taxes (driven up by surrounding properties- IMO)were high for them to continue living there. Many other "local" families have been "pushed" out because of these developments. And it continues. So, to reiterate-NO 5 STORY CONDO. I am born and raised Hawaiian from Miloli'i,Hawai'i. I've lived here my whole 38 years of life. Being born and raised here, I've seen many developments over the years in our islands. Our island is NOT in need of more hotels, condos,rentals for tourism, vacation rental, etc. there are more than enough of these types of structures that already are available to the public and visitors and many are not rented simply because the demand is not there for more of them. I feel strongly the arch logical impact in this specific area especially is extra sensitive as there is a lot of Hawaiian and environmental significance in this particular Ahupua'a. I know this because I own the 5acre land parcel directly mauka of ofthis proposed development. On my land, I have designated over an acre to preservation,due to the kupuna I have resting on my land. The wall against alii drive I own and is my property as well and have surfers,beach goers, fisherman always parking alongside in front of my property to gain access to ala kala beach which is fine, however soon my access to my land will be open and that parking wil disappear as it's going to be the entrance to our property. with a structure as the one proposed to develop, the over flow ofparking and guest will be all over alii blocking access to both my land, neighbors, and making it very dangerous for kids and pedestrians in the area. If the owner wants to do anything, why not turn his land over to the state or county and provide parking for the community to frequent the family friendly beach area as there is no parking to begin with? There is absolutely no benefit for the kona community with these types of unnecessary developments. Please consider options for the future of kona which should consist of parks and places for our kids and families to enjoy. Overbuilding and proposing to satisfy parking requirements by using up street parking that is already designated to meet shoreline access needs is not meeting parking requirements. No No No No they are already illegally grubbing on the lot and that is definitely an indication that they will not be honest is what they are doing nor do they care about this community. The homeowner's at Ala Kala Condominium also don't need a vacation rental full of partiers next to them. This proposal is wrong in so many ways and the owner is definitely trying to take advantage of the idea that they can just get away with anything regardless of what the zoning, the rules, the permit will say. Additionally, Alii Drive in any disaster situation is already a disaster itself-trying to get to safety in a storm/ tsunami warning is out ofthe question-this building would only add to that burden and jeopardize peoples' life. Not to mention global warming and sea level change. No No No. Not only is this proposal excessive for the lot; it's excessive for the neighborhood and the attitude of this already deceptive developer is not needed on a small shoreline parcel. Should be noted the Objectives and Policies of the Coastal Zone Management Program and the Special management area guidelines of Chapter 205A, HRS. It should be noted that under the Planning Commission Rule 9-10 (H) (9), a proposed use,.this adds to the problem for the evacuation within a tsunami zone,this project on page 3, is approximately 200 feet from the shoreline. This indicates that the Kahalu' u ahupua ' a was one of major importance in Hawaiian culture and history during the times before European contact , for heiau are built only after careful consideration of all geographical , social , political and supernatural factors . Important historical events in ancient Hawaii are closely associated with the construction, dedication, or use of these heiau, for Kahalu' u appears to have been a major seat of political power; perhaps a place where ruling chiefs held their courts . Many of the heiau are hundreds of years old, to judge from traditional history and legends , yet stand grandly above the now desolate terrain in fine condition. The mere fact that so many heiau exist in this district shows the com- plexity of Hawaiian society, for it must have taken literallythousandsandthousandsofmandaystobuildthem, since all are massive engineering feats of mortarless stonework. Along Royal Poinciana, residents could not exit their driveway. Note that Kahakai Elementary School is at the bottom of this road. What type of future financial responsibility might the county incur for knowingly approving a building that may end up under water? The application contains inaccuracies as well as a false description of the area giving the reader an impression the area is primarily condominiums and vacation rentals. While in fact, the area remains to be a "beach community", the proposed development will severely and negatively impact the charm of the community. In a West Hawaii Today (WHT) 5/13/21 article there is presently a request for standing in a contested hearing. This needs to be cleared before any decision is made. While there may be additional concerns to the proposed development, the following descriptions should cause enough alarm to deny the application in its current form. The elevation .(A012), and renderings (Figure 5a, 5b) depict a 5 STORY steel and glass industrial design style** that is inappropriate to the Alii Dr. Scenic Corridor. The values of the Scenic Corridor are based on a vision to preserve the historical and cultural design language of the village and The Kailua to Keauhou Beach Road". The proposed 5 STORY structure is jarring in relation to the neighborhood, and overwhelming in size and impact on the small lot (less that 10,000 sq ft. The proposed building will be very similar to the new Kona Brew brewery, in the old industrial area. The map, Figure 1 , as presented makes it appear that the property (TMK : (3) 7-5-020: 066) encompasses the entirety of lot 3, when in actuality it is less than 1/2 the area of the combined properties. This creates a false impression of buildable area in the presentation, and does not provide accurate information regarding the property scope. The driveway as shown will remove five currently available on-street (Alii Dr.) parking spaces. The adjacent Shoreline Access* is heavily used by families, surfers, divers, fisherpersons, and ocean access in general. Street parking is critical to the enjoyment of our shoreline by the public, and this neighborhood has very limited on-street parking. Shoreline Access, aka 'Old Canoe Road', Royal Patent by Kauikeaouli, and is now a private driveway. Although the shoreline access only requires a 5' wide pedestrian accessway, historically vehicles enter, unload/load while parking on the street, and 1 141767 adjacent properties support that limited community use. The subject property does not have legal access to the driveway. The access gate as presented in A001 Site Plan, is approximately 9' from the edge of Alii Dr. Vehicles attempting to enter the 5 STORY property would be forced to stop in the Alii Dr. traffic lanes and wait while the gate cycles, creating a traffic delay and public safety problem. Measurements to gated properties in both directions on Alii Dr. vary from 20' to 29', and clearly indicate past address to this potentially hazardous situation: Part of the property area consists of a large lava dome, that varies from 3'6" to 5'6" height above grade. The applicant proposes a swimming pool in this location. A HELCO inspector stated that it would not be possible to remove this natural feature without destroying the adjacent lot portion, and resulting in the loss of that property's power service pole. The plans submitted for permit are either fraudulent, or inaccurate. Initially, there is confusion related to number of floors, as the plans utilize the European floor numbering protocol, which makes it seem to be only four levels, when in actuality there are five. Ground level (A001) exhibits the site plan, including the before mentioned un-permittable entry from Alii Dr. and swimming pool proximity to a live high-voltage electric source (less than 5'). Level 2 (A003) shows two adjacent condo units. Level 3(A004) shows two adjacent condo units. Level 4 (a005) is stated as the lower level of two two-story units, however there are no internal stairs in either unit, nor open floor space in which to install same. Levels ground through four are serviced by an elevator. Level 5 (A006) is stated as the upper level of the two-floor units. These floor plans show internal stairs, but the floor below does not, and as drawn cannot support a stair landing from above. The only access to level five is via an outside stair from the fourth-floor lanai, there is no elevator or enclosed stair. Additionally, the fifth-floor units both contain a full kitchen. AS SHOWN IN THE SUBMITED DOCUMENTS THIS IS AN EIGHT UNIT BUILDING. Whether this is an error, or a deliberate attempt to sneak in two additional units cannot be determined by the public. This permit must be rejected as presented, and an accurate plans set submitted so that the public is correctly informed, and can respond from a knowledgeable position. 2 While recognizing that the proposed use may be qualified under the current zoning, the permit application must be amended for accuracy and, the design language and style of the building modified to fit into the surrounding environs. There has been no thought on the part of the applicant to create a project that fits the scale and sensibilities of a residential neighborhood. As of the morning of May 03, 2021 there is heavy equipment on the lot excavating within the Shoreline Management Area without permit! Please get clarification on the above issues and find out if they are still excavating without permit! We have lived almost directly across from this lot for over 30 years. We have seen many accidents, including fatalities along this stretch over the years. One was a male who was hit as a pedestrian and this stretch of Alii Drive is designated as a passing zone with no lighting. Furthermore, access to the property is limited and posses a serious danger to those attempting to walk to the beach or access AlaKala Condominiums, which is very low profile/2 stories. The narrow roadway is a designated public access and is used heavily by pedestrians who have to park on Alii Drive and walk in. Furthermore, a 5 story building is not the type of development or land use consistent with the homes in the area. As part of the public volunteer group who participated in the Zoning plans currently in effect, the overwhelming opinion is that such developments of this height need to be restricted to resort zoning and kept in "pods" rather than allowing them to infiltrate residential properties, who have low profile appearance and use. There are NO buildings higher than 3 stories anywhere near this proposed eyesore! We DO NOT want to have Kailua Kona appear like Kihei Maui has allowed or see small scale home development replaced with high rise buildings and crowded conditions. The owners of this property own at least 27 properties and we do not feel that these owners are committed to keeping Kona country or low scale use. In addition, because we have seen Alii Drive so backed up when trying to access Kuakini or other mauka roads, we feel further concentration of residences only poses hindrance to tsunami or hurricane evacuations. Alii Dr needs open spaces saved for public use, view planes, and limit concentrations of people who cannot evacuate timely or safely. This is NOT the type of development we need or want now or in the future! The commission is required by Section 25-2-65 (2)of the zoning ordinance to consider the following: "(2)The granting of the proposed use shall not be materially detrimental to the public welfare nor cause substantial,adverse impact to the community's character,to surrounding properties." Clearly, a 5 story box-like structure negatively impacts the"community's character" in particular impacting the surrounding properties which are modest one and two story properties in the same zone. Special attention should be paid to design which puts windows in the new structure looking down into neighboring properties,thus interfering with privacy and creating glare off windows and unwanted light during nighttime hours which would impact negatively the present dark sky conditions in and around this area of Alii Drive. Given that Alakala is a public beach,we are not aware of any public beach on the Kona coast that would have such an imposing 5 story structure looking down at the public. The commission also needs to consider the daylight plane impact of a 5 story structure on neighboring properties. The "minimum" setback might be appropriate in some RM 1.5 zones, however, where it is close to a public beach and neighboring modest 1 and 2 story structures the commission must require greater setbacks and orientation of windows away from neighboring properties. 4.) Section 25-5-37 requires the applicant to dedicate a minimum of 20%of the lot surface area to landscaping. The present plan does not have sufficient detail to show that it meets this requirement and therefore should be rejected. The plan proposes to convert over 80%of the lot to impervious surfaces, this violates good building and land use practices as it creates run off into storm drains or the ocean of contaminants and prevents natural percolation of rainwater. This is especially harmful in the coastal zone where it would be prudent to require more than the minimum lot area to be landscaped for ecological reasons. The swimming pool at the rear and surrounding paved areas not shown on the plan)are not"landscaping" within the letter or spirit of the zoning code. 5.)The proposed improvement fails to provide parking for persons with disabilities and therefore fails to meet the requirements of Section 25-4-55 of the zoning ordinance. I have been a full-time resident of Kona for over twenty years and had the honor of serving on the Kona Community Development Plan (KCDP) Steering Committee from 2005 to 2008. Through KCDP, we attempted to balance smart growth ideas such as neighborhood infill near publicly financed infrastructure with common sense protection of essential natural resources. I would like to bring to your attention this section of the KCDP which I believe is relevant to this proposed project: Policy LU-1.5: Enhanced Shoreline Setback. Beyond the 40 foot shoreline setback regulated by Hawaii Revised Statutes (HRS) Sections 205A Part Ill, the County shall explore alternatives (e.g., density transfer based on gross density) for the applicant of a Special Management Area (SMA) Major Permit to dedicate to the government or land trust or encumber as open space for the purpose of realizing a shoreline linear park along as much of Kona's coastline as possible. Consistent with the Federal Coastal Zone Management Act CZMA) and County of Hawaii General Plan policy to retain open space and protect natural resources along with public access to and along the shoreline, it shall be a priority of the County to maintain a minimum of 1,000-foot open space no-build setback for undeveloped lands adjacent to the shoreline, on parcels which currently exceed 1,000 feet in depth, in discretionary land use approvals such as SMA major permits, rezonings, and state land use boundary amendments. Structures makai of this setback should be for public recreation and ocean-dependent facilities such as harbor improvements. Another item of interest from the KCDP is from the Village Design Guidelines. My experience from public Planning Charettes in 2008 was that people insisted we respect and maintain the "feel" of Kona Village as it 141840 relates to building heights and aesthetics. While these expectations may vary among individuals, the following guidelines should be considered: Attachment B—Village Design Guidelines 1.3.3. THE BLOCK AND THE BUILDING 1. That buildings and landscaping contribute to the physical definition of transportation corridors as CIVIC places. 2. That development adequately accommodate automobiles while respecting the pedestrian and the spatial form of public areas. 3. That the design of streets and buildings reinforce safe environments, but not at the expense of accessibility. 4. That architecture and landscape design grow from local climate, topography, building practice and fit with Kona's history and lifestyle. 5. That buildings provide their inhabitants with a clear sense of geography and climate through energy efficient methods. 6. That CIVIC BUILDINGS and public gathering places be provided as locations that reinforce community identity and support self-government. 7. That CIVIC BUILDINGS be distinctive and appropriate to a role more important than the other buildings that constitute the fabric of the village. 8. That the preservation and renewal of historic buildings be facilitated, to affirm the continuity and evolution of society. 9. That the harmonious and orderly evolution of urban areas should be secured through form-based guidelines or codes. While this proposed project is within the urban growth area and serviced by publicly paid for amenities (road, water, sewer, schools, etc...), it is also one of the last undeveloped lots makai of Alii Drive. I have been a full-time resident of Kona for over twenty years and had the honor of serving on the Kona Community Development Plan (KCDP) Steering Committee from 2005 to 2008. Through KCDP, we attempted to balance smart growth ideas such as neighborhood infill near publicly financed infrastructure with common sense protection of essential natural resources. I would like to bring to your attention this section of the KCDP which I believe is relevant to this proposed project: Policy LU-1.5: Enhanced Shoreline Setback. Beyond the 40 foot shoreline setback regulated by Hawaii Revised Statutes (HRS) Sections 205A Part III, the County shall explore alternatives (e.g., density transfer based on gross density)for the applicant of a Special Management Area (SMA) Major Permit to dedicate to the government or land trust or encumber as open space for the purpose of realizing a shoreline linear park along as much of Kona's coastline as possible. Consistent with the Federal Coastal Zone Management Act(CZMA) and County of Hawaii General Plan policy to retain open space and protect natural resources along with public access to and along the shoreline, it shall be a priority of the County to maintain a minimum of 1,000-foot open space no-build setback for undeveloped lands adjacent to the shoreline, on parcels which currently exceed 1,000 feet in depth, in discretionary land use approvals such as SMA major permits, rezonings, and state land use boundary amendments. Structures makai of this setback should be for public recreation and ocean-dependent facilities such as harbor improvements. Another item of interest from the KCDP is from the Village Design Guidelines. My experience from public Planning Charettes in 2008 was that people insisted we respect and maintain the feel" of Kona Village as it relates to building heights and aesthetics. While these expectations may vary among individuals, the following guidelines should be considered: Attachment B—Village Design Guidelines 1.3.3. THE BLOCK AND THE BUILDING 1. That buildings and landscaping contribute to the physical definition of transportation corridors as CIVIC places. 2. That development adequately accommodate automobiles while respecting the pedestrian and the spatial form of public areas. 3. That the design of streets and buildings reinforce safe environments, but not at the expense of accessibility. 4. That architecture and landscape design grow from local climate,topography, building practice and fit with Kona's history and lifestyle. 5. That buildings provide their inhabitants with a clear sense of geography and climate through energy efficient methods. 6. That CIVIC BUILDINGS and public gathering places be provided as locations that reinforce community identity and support self-government. 7. That CIVIC BUILDINGS be distinctive and appropriate to a role more important than the other buildings that constitute the fabric of the village. 8. That the preservation and renewal of historic buildings be facilitated, to affirm the continuity and evolution of society. 9. That the harmonious and orderly evolution of urban areas should be secured through form- based guidelines or codes. While this proposed project is within the urban growth area and serviced by publicly paid for amenities (road, water, sewer, schools, etc...), it is also one of the last undeveloped lots makai of Alii Drive. The elevation (A012), and renderings (Figure 5a. 5b) depict a 5 STORY steel and glass industrial design style** that is inappropriate to the Alii Dr. Scenic Corridor. The values of the Scenic Corridor are based on a vision to preserve the historical and cultural design language of the village and 'The Kailua to Keauhou Beach Road". The proposed 5 STORY structure is jarring in relation to the neighborhood, and overwhelming in size and impact on the small lot (less that 10,000 sq ft. The proposed building will be very similar to the new Kona Brew brewery, in the old industrial area. The map, Figure 1, as presented makes it appear that the property (TMK : (3) 7-5-020: 066) encompasses the entirety of lot 3, when in actuality it is less than 1/2 the area of the combined properties. This creates a false impression of buildable area in the presentation, and does not provide accurate information regarding the property scope. Page 2 of 30 Shoreline Access, aka 'Old Canoe Road', Royal Patent by Kauikeaouli, and is now a private driveway. Although the shoreline access only requires a 5' wide pedestrian accessway, historically vehicles enter, unload/load while parking on the street, and adjacent properties support that limited community use. The subject property does not have legal access to the driveway. The access gate as presented in A001 Site Plan, is approximately 9' from the edge of Alii Dr. Vehicles attempting to enter the 5 STORY property would be forced to stop in the Alii Dr. traffic lanes and wait while the gate cycles, creating a traffic delay and public safety problem. Measurements to gated properties in both directions on Alii Dr. vary from 20' to 29', and clearly indicate past address to this potentially hazardous situation: Part of the property area consists of a large lava dome, that varies from 3'6" to 5'6" height above grade. The applicant proposes a swimming pool in this location. A HELCO inspector stated that it would not be possible to remove this natural feature without destroying the adjacent lot portion, and resulting in the loss of that property's power service pole. The plans submitted for permit are either fraudulent, or inaccurate. Initially, there is confusion related to number of floors, as the plans utilize the European floor numbering protocol, which makes it seem to be only four levels, when in actuality there are five. Ground level (A001) exhibits the site plan, including the before mentioned un-permittable entry from Alii Dr. and swimming pool proximity to a live high-voltage electric source (less than 5'). Level 2 (A003) shows two adjacent condo units. Level 3(A004) shows two adjacent condo units. Level 4 (a005is stated as the lower level of two two-story units, however there are no internal stairs in either unit, nor open floor space in which to install same. Levels ground through four are serviced by an elevator. Level 5 (A006) is stated as the upper level of the two-floor units. These floor plans show internal stairs, but the floor below does not, and as drawn cannot support a stair landing from above. The only access to level five is via an outside stair from the fourth-floor lanai, there is no elevator or enclosed stair. Additionally, the fifth-floor units both contain a full kitchen. AS SHOWN IN THE SUBMITED DOCUMENTS THIS IS AN EIGHT UNIT BUILDING. Whether this is an error, or a deliberate attempt to sneak in two additional units cannot be determined by the public. This permit must be rejected as presented, and an accurate plans set submitted so that the public is correctly informed, and can respond from a knowledgeable position. While recognizing that the proposed use may be qualified under the current zoning, the permit application must be amended for accuracy and, the design language and style of the building modified to fit into the surrounding environs. There has been no thought on the part of the applicant to create a project that fits the scale and sensibilities of a residential neighborhood. I feel strongly the arch logical impact in this specific area especially is extra sensitive as there is a lot of Hawaiian and environmental significance in this particular Ahupua'a. I know this because I own the 5acre land parcel directly mauka of of this proposed development. On my land, I have designated over an acre to preservation,due to the kupuna I have resting on my land. The wall against alii drive I own and is my property as well and have surfers, beach goers, fisherman always parking alongside in front of my property to gain access to ala kala beach which is fine, however soon my access to my land will be open and that parking wil disappear as it's going to be the entrance to our property. with a structure as the one proposed to develop,the over flow of parking and guest will be all over alii blocking access to both my land,neighbors, and making it very dangerous for kids and pedestrians in the area. If the owner wants to do anything,why not turn his land over to the state or county and provide parking for the community to frequent the family friendly beach area as there is no parking to begin with?There is absolutely no benefit for the kona community with these types of unnecessary developments. Please consider options for the future of kona which should consist of parks and places for our kids and families to enjoy. I represent the owner's of 75-6138 Alii Drive, Kailua-Kona, Hi. Their property is within 300 feet of the proposed development and is comprise of a single story residence. In the original notice sent in May the application provided building plans, in the latest mailing the applicant failed to provide plans other than the site plan. We are not able to comment on an incomplete disclosure of information with regards to the building,therefore the application should be rejected as having not met the requirements for informing the neighboring properties. The site plan fails to show an exterior details, mass,overhangs,lanais or othcr features that are critical to this application. Nevertheless,we make the following additional objections to the application: I.) The proposed entry gate would be putting can waiting at the entry to the subject property across the bike/walking path as well as in the street blocking traffic. This would create a dangerous condition for drivers,bicyclists and pedestrians. The setback from Alii Drive needs to be increased by at least 15' from what is presently shown on the plan so that it meets basic safety requirements. 2.) The plans submitted violate Section 25-S-36 of the zoning ordinance in that it fails to provide of the required 18' minimum side yard setback for a 5 story building. It also violates the minimum rear yard setback of 20'. It should be noted that the site plan as submitted appears to show a hashed line on the set back but the dimension is either not shown or misrepresented. Scaled drawing is obviously incorrect in showing setbacks required by the code. 3.) A S story building is totally out of character for this section of Alii Drive. The proposed massive box-like structure would block views and leave it looking like Urban Core type structure. This is wholly inappropriate for Alii Drive. Notably, it is surrounded by single story and two-story modest structures. The commission is required by Section 25-2-65 (2)of the zoning ordinance to consider the following: 650) 322-3344 153 SECOND ST., #101, LOS ALTOS, CA 94022 2)The granting of the proposed use shall not be materially detrimental to the public welfare nor cause substantial,advent impact to the community's character,to surrounding properties." Clearly,a five-story box-like structure negatively impacts the"community's character" in particular impacting the surrounding properties which are modest one and two-story properties in the same zone. Special attention should be paid to design which puts windows in the new structure looking down into neighboring properties, thus interfering with privacy and creating glare off windows and unwanted light during nighttime hours which would impact negatively the present dark sky conditions in and around this area of Alii Drive. Given that Alakala is a public beach,we are not aware of any public beach on the Kona coast that would have such an imposing 5 story structure looking down at the public. The commission also needs to consider the daylight plane impact of a 5 story structure on neighboring properties. The"minimum"setback might be appropriate in some RM 1.5 zones, however,where it is close to a public beach and neighboring modest 1 and 2 story structures the commission must require greater setbacks and orientation of windows away from neighboring properties. 4.) Section 25-5-37 requires the applicant to dedicate a minimum of 20%ofthe lot surface area to landscaping. The present plan does not have sufficient detail to show that it meets this requirement and therefore should be rejected. The plan proposes to convert over 80%of the lot to impervious surfaces,this violates good building and land use practices as it creates run off into storm drains or the ocean of contaminants and prevents natural percolation of rainwater. This is especially harmful in the coastal zone where it would be prudent to require more than the minimum lot area to be landscaped for ecological reasons. The swimming pool at the rear and surrounding paved areas(not shown on the plan)are not"landscaping" within the letter or spirit of the zoning code. 5.) The proposed improvement fails to provide parking for persons with disabilities and therefore fails to meet the requirements of Section 25-4-55 of the zoning ordinance. As shown the van accessible space does not meet the standard. It is not permitted to have car/van doors open into a wall. The space fails to provide for the minimum width required by the code. 6.) Enclosed parking spaces such as the ones shown surrounded by three walls underneath the building require a minimum width of 10 feet. The space at the rear would require the driver to back over 25 feet in a straight line in order to begin a three point turn to exit. This makes the parking spaces functionally unusable. Parking as shown by the front wall is way to crowded making use of these spaces functionally impossible as occupant would not be able to exit their cars after parking. The standard space is against a wall,and then is adjacent to small compact spaces. One compact space passenger would have to exit into a planter. The rationale that further development is warranted in order to finance additional egress in the event of a tsunami is akin to saying lets pave paradise to put up a parking lot. Why was tsunami planning in terms of building set-backs and egress routes not considered years ago? The 10,000 square foot lot, (approximate), would be more consciously dedicated to a park or 4 unit multi-family building constructed in the character of those already along Alii drive; wooden materials, gingerbread trim. The construction demands of a five story vacation rental with underground parking, a pool and limited parking will put at risk the porosity of the rock adjacent to the shoreline. Drilling down through the lava to install structural steel vertical supports,the weight of the glass exterior, swimming pool and additional paving requires the assessment of a structural engineer. As to the archaeological statements made to date, it is my understanding an archaeology report has not been done. In light of property taxes outstanding, grubbing begun without a grubbing permit, and architectural plans to date not meeting building specification indicates a lack of responsibility and consideration for both the county regulations and neighborhood. Who is to say what other egressions will occur at each level of development going forward. It is time the county building administration adopt a consciousness of protection for the cultural ambience of Kona and mitigation of risk rather than be driven by the revenue generated by increasing densities which strain sewage, water and visual aesthetic resources at the expense Kailua Kona residents. I visited the County of Hawai'i property tax record website on June 14, 2021, and observed that Jekaterina Mysin has 27 parcels listed under her name. Most of the parcels listed have delinquent property taxes since the year of acquisition in 2018. c, As a matter of public policy, I do not support the issuance of a building permit before the delinquent property taxes are paid in full. 4. Quiet Enjoyment of Property: As a owner for 19 years, I have enjoyed the quiet community at Ala Ka La. I recognize that development occurs in the normal course of growth in a community. Here is the reality that the Ala Ka La ohana will face during the construction phase. Let's not equivocate, site preparation noise and pounding (in particular, lava excavation) will be extremely loud (you can't even have a phone conversation or watch TV when the gardener's leaf blower is outside.) This noise will not be limited to a "few days". I doubt that I will be able to talk on the phone, watch TV, read a book, take a nap, be on a 1 1 4 2 3 2 8 Zoom call, or have family or friends visit while excavation is going on. It begs the question of whether we can stay in our units. c During the construction phase, there will be dust and dirt continually landing on: our cars (3 spaces directly next to the rear property line of the proposed development); lanais and the furniture and rugs we have thereon; and rooftops. There could potentially be damage to our private driveway as a result of the lava excavation. I believe the developer has a responsibility to remediate these issues for the Ala Ka La owners and I would like to see a formal requirement by the County that the developer has a responsibility to remediate these items. Absent, any formal requirement, the Ala Ka La AOAO would have to incur otherwise unnecessary costs to seek remediation. 0 For units that are permitted long-term vacation rentals, there will most likely be a loss of revenue as it will be difficult to rent a unit during the noisiest construction phase. I no longer reside on the Big Island- however, I grew up there and visit regularly. I have watched the island change in a way that accommodates tourism but not really working to address the quality of the environment- beaches, green spaces, culture. Preserving what makes the island beautiful. The discussion of this 5 story condo concerns me as this takes away from the landscape and adds to pollution. As I have seen in the information provided- this building will not blend in, but stick out like a sore thumb- taller than any other building surrounding. Similar types of buildings have become vacation rentals which does not help the current housing market. We do not need to continue to build near the ocean. Sea levels rise, issues with storms- tsunamis, hurricanes etc- over crowing near the ocean makes it difficult during times of evacuation. This is not smart emergency planning. When planning for the development of the island- resources and the overall impact on the island need to be considered. People travel to Hawaii because it is a beautiful treasure. The people who make decisions about the island need to consider this. If the shores are overdeveloped, sea life is gone, and plant life is paved over- what brings people to Hawaii? The program includes key elements: Protecting natural resources, Managing development in high hazard areas, Giving development priority to coastal-dependent uses, Providing public access for recreation, Prioritizing water-dependent uses, and Coordinating state and federal actions. I advise that the Leeward Planning Committee be very mindful of the phrase 'housing crisis' as the Palisade rezoning on May 20th, 2021 and this 5 Story Condo clearly will not serve our local community and will in fact perpetuate off island, multi home ownership for the wealthy. It increases local land taxes and continues to displace families who are renting, with an actual housing crisis. It would be highly recommended and beneficial that the Leeward Planning Committee recognises and reflects continuity in line with DLNR, NRC, CMZ and Culture through Plants, Soil and Water Conservation knowledge and efforts. What we do on the mountain here impacts our ocean life and drinking water because our island is so young and porous. My reasons for this opposition; This monstrosity will block our ocean views being on the makai side of Ali'i Drive. Making Kona less appealing and less Hawai'i nei. It will be the tallest condo structure protruding above all buildings in the surrounding area. Sticks out and visible from Kuakini Hwy. 1 i42263 Kills our cultural landscape and adds insult by gentrified representation of Hawai'i through a large scale dolphin mural on the revised condo designs This increases density near a major intersection at Royal Poinciana near Kahakai Elementary School. Making it less evacuation friendly. Should not exceed 1 story, nor should we continue to develop so close to the water as sea levels have already risen by 80 feet more or less. View Kahalu'u cesspool image that is now in the shoreline. This will impact our ocean quality, fishing and surf spot with 27 bathrooms connecting into our leaking sewage system as we face an increased 'High Bacteria Alert' warning along the Kona coast. If this design and large mass of a building passes, more like this will pass. Tsunami evacuations in the past failed tremendously to get people up the mountain at all. In fact traffic comes to a dead stop due to overpopulation and lack of connecting roadways. In 2020 we had 2 Tsunami warnings that were cancelled. It is a matter of WHEN. This is not in the direction of becoming catastrophically prepared nor dealing with rising sea levels. We need green open space and public parks all along Ali'i Drive's oceanfront just like Hilo. No more buildings! If this passes there will be great disharmony in our community towards this negative direction in our overall planning of Kona coastal lots. Our coral reef system is a collaborative participant that impacts global ocean habitat behavior. I don't find that this structure leaves our Natural Resources protected for generations to come. We really need to think and plan accordly to our reality for 50 plus years down the line and be of the mindset of mitigating and supporting nature and not taking from it and developing the waterfront for quick profit for a few people. While in fact, the area remains to be a "beach community", residential and 15 acres agricultural directly across the street. The proposed development will severely, negatively and irreversibly impact the charm of the community and RESTRICT SHORELINE ACCESS! This project is not in alignment with the Scenic and Historic Alii Drive. (description of the designation follows below) When shoreline access is affected in a negative way - it should be forefront in decision making. This is a future generation argument---what is our legacy as we are leaving and Kona becomes fully developed? Natural resources must be preserved and protected for the people! Zoning does not mean you "get what you want"--you're only at the first base. If the infrastructure isn't available water. parking. adequate streets. adequate emergency evacuation routes- development CANNOT happen. Developers must be required to provide adequate parking, including guest parking ON SITE. and must not be able to utilize public property/streets to accommodate the developments needs. Pre-Covid and pre bridge construction- it's normal during busy hours for traffic to back up from Lunapule Street to Alii Gardens Market Place- 300 feet away from proposed development! Access to Kuakini Highway from Royal Poinciana Street backs up during busy hours and is_compounded by the Kahakai Elementary School traffic (one way in and out of school) from Alii Drive up to Kuakini Highway. During the last tsunami warning- traffic was backed up- to a standstill- including emergency vehicles --- people were told to get out of their cars and run! Shoreline access is NOT just a designated pathway- safe parking is necessary. Shoreline access is already restricted by lack of safe parking along Alii drive. This area "Ala Kala" is a popular, Page 2 of 6 multigenerational user shoreline for fishing, surfing, diving and family beachgoers. A driveway will take several parking areas away from the shoreline access use. There is a fire hydrant at the subject driveway, so most likely there will be no parking to the north of the shoreline access path once the driveway is installed. Alii Drive cannot support any more development. The best solution is for the County to purchase this property to preserve & protect Shoreline Access. Please review the attached rendering of a new aesthetic that we feel conforms more to the existing development in the area. You also expressed some concerns with regard to archeological sites. An Archaeological Field Inspection was conducted on the subject property and was submitted to the State Historic Preservation Division. The survey found no evidence of historic or cultural resources requiring preservation. This finding was confirmed by SHPD by letter, stating "no historic properties will be affected" by the proposed project. Further, if any archaeological finds are made during construction, work will cease and only proceed after clearance from SHPD and the County. Should the proposed project be given County approval to move forward, we hope that this additional information and the proposed mitigation strategies alleviate some of your concerns.
