NOTICE IS HEREBY GIVEN of the following matters to be considered by the Kaʻū Action
Committee in accordance with the provisions of Section 92-7, Hawaiʻi Revised Statutes (HRS).
This meeting will be held in-person at the location listed in this notice and by Interactive
Conference Technology (ICT) through Zoom.

NOTICE REGARDING PUBLIC TESTIMONY: The public may provide oral testimony at

NOTICE REGARDING INTERACTIVE CONFERENCE TECHNOLOGY (ICT):
A meeting held by ICT shall be automatically recessed for up to 30 minutes to restore
communication when audiovisual communication cannot be maintained with all members
participating in the meeting or with the in-person location identified in this notice. The meeting
may reconvene when either audiovisual communication is restored, or audio-only
communication is established after an unsuccessful attempt to restore audiovisual
communication. If it is not possible to reconvene the meeting as provided in this subsection
within 30 minutes after an interruption to communication, the meeting will be automatically
terminated.

minutes from October 16, 2024.
III. PUBLIC TESTIMONY ON AGENDA ITEMS: Pursuant to §92-3, HRS, interested

IV. BUSINESS:
1. Waiʻōhinu Transfer Station – Discussion and action on drafted letter to
Department of Environmental Management to open the transfer station to 7 days
a week.
2. Pāhala Water Bottling Facility Update – Discussion and potential action on
findings regarding the Pāhala Water Bottling Facility.
3. Egress and Ingress at Green Sands Subdivision Permitted Interaction Group
Report – The Permitted Interaction Group will present their report to the
committee. The committee may ask clarifying questions, but no discussion or
action may be made on the item at this meeting.
4. Proposed Transient Accommodations Rental Code Amendment (TAR Bill) –
Discussion and potential decision-making on providing testimony to County
Council’s TAR Bill package (Bill 121 and 122). Bill 123 was signed into law on

5. Nāʻālehu Hill Subdivision – Phase 1 (PL-SUB-2024-000279) – Discussion and
potential action on providing comment to relevant agencies regarding the pending
consolidation and re-subdivision application (TMK: (3) 9-5-008:001).
V. NEW BUSINESS: Action Committee members will discuss potential agenda items for
the next meeting, including revisiting topics from meetings that did not have a quorum.
VI. ANNOUNCEMENTS:
• Leinaʻala Enos will be resigning from the committee at the end of 2024. Mahalo to
her for all her time and dedication to the Kaʻū CDP Action Committee over the years.
• The Planning Department is currently seeking applicants for the Kaʻū CDP Action
Committee and is requesting assistance to get the word out to interested community

Committee member Morrow moved that the Action Committee (AC) send written testimony to 34 the Planning Commission (PC) regarding the Black Sands Beach Special Management Area 35
(SMA) application, based on findings from the Community Development Plan (CDP). The motion 36
was seconded by Chair Masters, who clarified that the testimony would highlight non-compliance 37 with the CDP. 38
Committee member Mokuhaliʻi noted that the AC operates under the rules of the Planning 39 Commission, referencing Rule 9, which defines the AC’s role in relation to the CDP. She added 40
that the SMA permit is overseen by the Planning Department. 41
Committee member Morrow emphasized this is the fourth memo written, focusing on the AC’s 42 interpretations of the application in relation to CDP policies and recommendations. 43
Committee member Enos supported the motion, emphasizing that the AC’s role is advisory and 44 that the letter should be sent after multiple community meetings. 45
Chair Masters read and elaborated on the key points in Committee member Morrow’s memo 46
(Communication No. 2024-26). 47
Vice Chair Hanoa expressed his manaʻo (thoughts) on the importance of honoring the kupuna 48 (elders). He raised concerns about land use by non-profits in Kaʻū, noting that it creates issues 49 with people from outside the community. He emphasized that the people of Kaʻū should be 50
provided with the resources necessary to remain in Kaʻū and raise their families. 51
Committee member Ke encouraged collaboration and compromise regarding resources in 52 Punaluʻu, urging others to share ideas and find common ground before fully opposing proposals. 53
Chair Masters noted that infrastructure issues such as water could be addressed by the landowner. 54
Vice Chair Hanoa raised a question about whether large-scale housing or smaller condo 55
developments would be more harmful to the community. 56
Chair Masters moved to finalize the memo, incorporating general changes, restating questions as 57 statements, and refining the language to align with CDP policies. Responses from Mr. Arai and 58 other applicable testimonies will be attached to the memo. The revised memo would then be sent 59 to the Planning Department and circulated to the AC. If there were no objections, the memo will 60
be sent to Chair Masters for signature and forwarded to PC. Seconded by committee member 61
Mokuhali’i. The roll call vote passed unanimously with 7 votes in favor. 62

The Ka'u CDP Action Committee designate two members to research and draft a letter
addressing recommendations and concerns regarding the Mahana Bay Coastline Access and
Resources. The members sought out to address the concerns of the Ka'u community about protecting cultural sites and natural resources in the greater Ka Lae area particularly regarding Mahana Bay. Increases in tourism and related activities have led to increased degradation of the area, resulting in significant damage to both the land and marine environment including sea life.
Additionally, important cultural sites, including sacred burial grounds and native Hawaiian trail
systems and other sites have been and are in further danger of being damaged or destroyed.
The Ka'u CDP addressed these issues in response to input from a large number of members of the community during the many information-gathering meetings during its formation. The final
CDP acknowledges the importance of preserving this area throughout the document as follows:
1.Section 4.6, Protect and Enhance Ecosystems, encourage the collaborative developmentand implementation of resource management plans and the enforcement necessary to protect
ecosystems.
Section 4.6.1, Community Objectives, lists the following objectives: •Protect, restore, and enhance ecosystems, including mauka forests and the shorelines,
while assuring responsible access for residents and for visitors.•Encourage community-based management plans to assure that human activity doesn'tdegrade the quality of Ka'u's unique natural and cultural lands.
Section 4.6.4, Advocacy: •

4.6.4.4, Department of Health. Require implementation of management measures to prevent nonpoint source pollution.
4.6.4.5, Department of Land and Natural Resources. Following the recommendation of the South Kona-Ka'u Coastal Conservation Task Force, dedicate at least one State DOCARE officer to the Ka'u District to aid in enforcement.
4.6.4.6, Department of Hawaiian Home Lands (DHHL). Maintain the Ka Lae (South Point) coastal areas and related infrastructure for recreational, cultural, education, and/or scientific uses in a manner that is protective of resources and is consistent with the Hawaiian Homes Commission Act and all applicable laws related to Native Hawaiian rights and public shoreline access. (GP 8.3(c) & 12.5.9.2(d)).
2.Section 4.2, Protect the Coast from Development. This section protects coastal areas
from development with the CDP Land Use Map, shoreline setbacks, the Special Management

Area, and encouragement to the State to strengthen protections and the community voice in land use decisions. •4.2.4.1 Advocacy: Following the recommendation of the South Kona-Ka'ii Task Force,
amend HAR 13-5-40(b) to require that public hearings before the Board of Land andNatural Resources be held in the judicial district in which the land is located.
The Ka'u Action Committee has found two recent studies regarding management of the Ka Lae
area, one in 2012 and one in 2016. The DHHL Ka'ii Regional Plan was adopted in 2012 by
Hawaiian Homes Commission. This plan prioritized two projects to be implemented by 2015: (1) develop vehicular roadway(s) and pedestrian pathways within the coastal area of Ka Lae (to manage access to Kaulana Bay, the fishing grounds at Ka Lae, and protect sensitive resources), & (2) protect and preserve sites in Kama'oa. Phases consisted of: updating the
Historic Landmark designation; developing a circulation plan; pursuing partnerships; developing
signage and educational programs; obtaining funding; and constructing roads, fencing, and educational signage. The South Point Resources Management Plan (RMP), prepared for the Hawaiian Home Lands Trust, was finalized in October 2016. This plan stated: This resources
management plan identifies specific near-and long-term management actions for lands held
under the Hawaiian Home Lands Trust located within the ahupua'a of Kama'oa-Pu'u'eo, Ka'ii District, Island of Hawaii. It is intended to guide future actions to steward the land and resources of this area." Of particular interest is the concluding paragraph on page vii of the 2016 document. "The main near-term priority for DHHL is to gain site control by managing vehicular
access."
The Ka'ii Action Committee has listened to the concerns of the community and have agreed that action needs to be taken. This issue is very important to the people of Ka'ii, as our
environment, our culture, and our history are being destroyed by lack of action by responsible
agencies. We are asking that the Planning Department forward our concerns to DHHL, DLNR, Hawaiian Homelands Trust, and any other agency that would have authority to act, and ask them to formulate a pla f action with a projected completion date.

As the Ka'u CDP Action Committee, our responsibility to hear and evaluate the concerns from members
of our community within our boundaries of the CDP goals and policies is critical to a comprehensive
advisory to the Department of Environmental Management.
There has been testimony from the public (with petition) at two consecutive meetings regarding the
newly renovated Waiohinu Transfer Station.
Items of discussion were pertaining to:
A)Revert back to opening 7 days a week. To accommodate new population growth within the entire
Ka'ū wahi pana, and alleviate dumping on our side roads and in the gulches up mauka which create
issues for the continuous flowing of water ways set up to prevent flooding, also potential health
hazards.
B)Address large puddling happening right in front of new rubbish chute, as this draws concern for
injury by slipping and or falling, also unsanitary stagnant water.
With these concerns falling into;
Section 3: Advance Preferred Conservation and Settlement Patterns
3.4 Land Use Policy
Policy 3. Commercial facilities shall be developed in areas adequately served by necessary services, such
as water, utilities, sewers, and transportation systems. Should such services not be available, the
development of more intensive uses should be in concert with a localized program of public and private
capital improvements to meet the expected increased needs.
Section 5: Strengthen Infrastructure, Facilities, and Services.
5.8 Environmental Management Facilities.
This section of the CDP prioritizes expanded wastewater systems, the new transfer station in Ocean
View, improvements to the recycling area in Pahala, and green waste drop-off and mulch pick-up sites.
Policy 121 Build the solid waste transfer station in Ocean View.
Policy 122 Implement plans to improve the recycling area at the Pahala Transfer Station.
Although the Waiohinu Transfer station is not stated in a specific Policy, it surely falls under the
Department of Environmental Management.
To Address the concerns from the community, and the Ka'u CDP Action Committee, regarding the
Waiohinu Transfer Station, we urge the Department of Environmental Management to open
communications for discussions and solutions.

the listed officers for their review and comments. Please be advised that we are
deferring action on the referenced application until all listed officers’ comments are

Please note that although we are accepting this application, we are requesting minor
corrections to the preliminary plat map in compliance with Hawai‘i County Code
requirements. Please see the following:
1. Please label any exclusions (other parcels) to the proposed subdivision.
2. Provide information on the remainder size calculations.
3. Please label the owner’s name on the Preliminary Plat Map.
4. Please provide a consistent date for any future map submittals.
5. There are thirty-nine (39) proposed lots and a remainder. Only thirty-seven (37)
Grants/Land Commission Awards were listed as being used for the proposed
consolidation/resubdivision action. Please include two (2) more Grants/Land
Commission Awards that you will be using from the remaining pre-existing lots
listed on the Revised Pre-Existing Lot of Record Determination letter dated October
8, 2014, and additional Information letter dated September 15, 2015. We assume
that Grant 5917 will be one of those land titles being used to account for a portion of
land located within proposed Lot Z2-28.
6. Please provide discussion as to the layout of Lots Z1-2 & Z1-3 with respect to the
government right-of-way that was used to determine pre-existing lots.
7. Clearly define existing government rights-of-way and new road lots created to
account for meandering of the physical roadways.
8. Please correct typographical errors in your supplemental list of Grants and Land
Commission Awards.
9. There is a remaining processing fee of $25 required for the remainder that was not
included with the application. Please submit the remaining balance of $25 at your
earliest convenience.
10. Please note that there may be additional clarification questions and modifications
requested as necessary.
