• HECO inspector stated that if the lava dome is bisected along property line, the power pole
will fall.

Encroaches into Property by up to 1'8".The driveway has been in place prior to 1970 with no
action to dispute use by any of a series of owners of the Mysin property. The driveway shall
remain in place by adverse possession.

NOTES:
• Pool and spa depths below grade (22'6") are not delineated.
• Spa position is immediately at property line on the south side and west corner. If the spa is
above grade there must be a setback.
• Additionally, the Ala Ka La power pole is directly across the west corner of the spa, therefore a
5'separation from an electrical source is required.
• The dumpster station is depicted as accessed from the paved Ala Ka La driveway/Public
Pedestrian Beach Access right-of-way. It is not certain that the Mysin property has direct
access rights to the property owned by Alii Point, and encumbered by deeded access by Ala
Ka La.
• Site plan does not include the required 20% of lot area as landscaping. With a lot size of 9,934
sq ft a minimum 1,987 sq ft of natural landscaping is required. The drop-off are has been
connected to the driveway, which eliminates approx 120 sq ft from existing plan.
Calculations from transmitted site plan show only 1,167 sq ft of planned landscaping.
Calculations are admittedly rough, scaled from small drawing, but no way are they off by 41%
(820 sq ft).

NOTES:
• There is no elevator or landing purposed for the installation of an elevator.
• Neither ground unit is ADAAG compliant. A six-unit residential property is required by Federal
Law to include at least one Handicap Accessible unit, whether a person with a disability is in
residence or not.
• If this is a residential condominium as is declared by the application, why is a 90 sq ft
`Reception Office' designated at the entrance to the building?This comports to the stated use
by Mysin that the property will be operated as a MINI HOTEL and EVENT CENTER.
