HomeMy WebLinkAboutPD Background Report Kermit Johnson (PL-SMA-2024-065) -1- RKJ_SMA_NOV_2024 COUNTY OF HAWAIʻI PLANNING DEPARTMENT BACKGROUND REPORT KERMIT JOHNSON SPECIAL MANAGEMENT AREA USE PERMIT APPLICATION (PL-SMA-2024-000065) KERMIT JOHNSON has submitted an Application for a Special Management Area Use Permit to construct a two (2) story, 6,402 square foot single family residence, with four (4) bedrooms and three (3) bathrooms and related improvements on a 27,878 square foot shoreline parcel within the Special Management Area. The subject property is located on the makai side of Ala Heiau Road, approximately 100-feet south of its intersection with Makuʻu Drive, Hawaiian Paradise Park, Block 11 Keaau, Puna District, Hawai‘i, TMK: (3) 1-5-031:067. PROPOSED DEVELOPMENT 1. Request: The applicants proposed development consists of a 30-foot high, 2-story single- family dwelling with four (4) bedrooms, kitchen, wet-bar/kitchenette, living room, three (3) bathrooms, a three (3) car garage, and related development. Additional development includes the construction of an individual wastewater system (IWS), a private drill well for potable water use, and a paved driveway for access. The plan also accounts for stormwater management with appropriate grading and drainage systems, and landscaping areas have been strategically positioned to enhance visual appeal while maintaining the natural environment's integrity. The shoreline was certified for this parcel on July 12, 2022. (Planning Department Exhibit 1 – SMA Use Permit Application dated August 26, 2024) 2. Project Objectives: The purpose of the project is to construct a single-family residence on the subject parcel for personal use. 3. Cost/Time of Project: The current estimated cost of the improvements is $900,000. The project would be initiated after the granting of all necessary permits. 4. Landowner: Kermit and Doris K. Johnson, Hilo, HI -2- BACKGROUND INFORMATION 5. Special Management Area (SMA): No previous SMA permits have been issued for the subject parcel. 6. Chapter 343, HRS: The proposed improvements are not subject to the requirements of Chapter 343, Hawaiʻi Revised Statutes, regarding Environmental Impact Statements and as such the project is exempt from the filing of an Environmental Assessment (EA). STATE AND COUNTY PLANS 7. State Land Use Designation: Agriculture 8. General Plan LUPAG MAP: Rural and Open 9. County Zoning: Agricultural 1-acre (A-1a) 10. Puna Community Development Plan (PCDP): The Puna Community Development Plan (PCDP) was adopted by the Hawaiʻi County Council by Ordinance No. 08-166 in 2008 and amended by Ordinances Nos. 10-104, 11-51, 11-52, 11-53, 11-117 and 11-118 in 2010 and 2011). 11. Special Management Area (SMA): The project is located within the Special Management Area and therefore, the proposed development is subject to the SMA review. No work will occur within the shoreline setback area. DESCRIPTION OF PROJECT AREAS AND SURROUNDING AREA 12. Subject Project Area: The 27,878 square foot subject property is relatively flat, with minimal vegetation and no previous development. The property is located on the makai (ocean side) side of Ala Heiau Road, close to its intersection with Makuʻu Drive in Hawaiian Paradise Park. Vegetation of the property includes non-native ironwoods, albizia, and other typical coastal vegetation; some native naupaka, also common in this area, is present. The property is between 20 and feet above sea level with the makai property boundary being a rocky cliff that borders the ocean. Two (2) separate rock wall segments are located along the north and south property boundaries; however, they are not located on the subject parcel. 13. Surrounding Zoning/Uses: The surrounding area is developed with single-family residences or undeveloped residential parcels, with all surrounding parcels also within the -3- County’s A-1a zoning designation. Immediately makai of the subject parcel is the ocean, and Ala Heiau Road demarcates the mauka property boundary. 14. Flood Insurance Rate Map (FIRM): The property is predominately within Flood Zone X, or outside of the 500-year flood plan. A small portion of the shoreline is located within Flood Zone VE (areas subject to a 1% annual chance of inundation by a 100-year flood event with additional hazards associated with storm induced wave action). The proposed development will be within Flood Zone X. 15. Sea Level Rise: According to the State of Hawaiʻi Sea Level Rise Viewer (SLR-Xa), the coastal portion of the subject parcel is within the 3.2 ft. Sea Level Rise Exposure Area, the 3.2 ft. Passive Flooding area, and the Coastal Flood Hazard Zone. 16. Flora/Fauna Resources: The applicant did not complete a “biotic” survey of the subject parcel; however, they do not believe that any rare, threatened, or endangered floral or faunal resources are likely to be found within the project parcel. Several non-native trees such as ironwood and coconut palm are located on the property, none of which require protection or preservation. Species of shorebirds may be found along the shoreline, however that is outside the project area. 17. Archaeological Resources: Although no archaeological survey of the site was conducted for this application, it is highly unlikely that any historic sites would be found as the property has been located within the well-developed residential subdivision. 18. Cultural/Historic Resources: The shoreline area located adjacent to the subject parcel is currently used for coastal gathering and fishing by native Hawaiians, however, use of the project site itself for traditional and customary rights is unknown. The parcel has never been cleared, graded, or developed; however, it would be unlikely that the site would serve any traditional purpose or use. There is an existing 5-foot-wide shoreline access easement located on Parcel 70, which is 3 parcels north of the project site. The access easement provides public shoreline access from Ala Heiau Road to the shoreline. Additionally, lateral shoreline access is heavily utilized for fishing and other gathering purposes. The proposed project will not interfere with, alter, or block lateral shoreline access in this area. 19. Scenic and Open Space Resources: The construction of a new single-family dwelling is -4- anticipated to have minimal impacts on scenic views, especially since the area along the shoreline has been previously developed with similar single-family residences for some time. The proposed development is consistent with the surrounding developed parcels which include numerous 2-story dwelling structures built along the shoreline. Open space resources are primarily the shoreline area makai of the project site, which is comprised of a basalt bench and rocky coastline, and the ocean which is utilized by both native Hawaiians and the public. 20. Recreation/Public Access: A 5-foot-wide pedestrian shoreline access pathway is located on Parcel 70, which is three (3) parcels north of the project parcel that permits access to the shoreline from Ala Heiau Road along the property boundary to the shoreline area. The coastline in this area is utilized for fishing and other gathering practices, with lateral shoreline access available in this area. The existing shoreline public access located on the project site and the lateral shoreline access located makai of the project site will not be impacted by the proposed activities. PUBLIC UTILITIES AND SERVICES 21. Access: A driveway will be constructed to allow access to the site from Ala Heiau Road. 22. Water: Water is not available on site per the Dept. of Water Supply (DWS). The applicant will be applying for and installing a private drill well for potable water use on the subject parcel. 23. Wastewater: Wastewater will be handled by a new Individual Wastewater System (IWS) approved by the State Department of Health. 24. Other Essential Utilities and Services: All other utilities including electrical, telephone and cable services are available to the site. AGENCIES' COMMENTS 25. The Department has not received any comments or objections from the general public or adjacent landowners on the subject application. J.No valued Cultural resources or Hawaiian rights are known to owner on this site. There is noshoreline access on this property. There is no sandy beach at the ocean side of the property and is all rockand boulders. There is ocean access at the nearby end of the road at Maku'u Point Park. L.There are no plants of significance (weeds, grass and a few palm trees. M.Access to the property will be provided by a private driveway to the existing public road. N.Traffic impact is minimal since this project is one single family home. 0.Existing electrical and water lines are in the road right of way. Solid waste collection is availableby private companies. Sewage disposal will be provided by a new septic system. This property isa legal lot within a legal subdivision. P.None have been identified except to apply for an SMA. 4.A. The environmental setting of this property is it is an ocean front lot with the surrounding propertiesthat are of the same use as proposed witch are single family homes. B.The proposed project is a single family home and is constant with the policies, zoning and landuse of the area and is a legal lot within a legal subdivision. C.The impact of this project is the addition of a single family home and is constant with the area.This project is setback an additional fifteen feet from the shoreline set back, and the shoreline isnot a sandy beach but is a cliff and all rock and boulders. D.The adverse environmental effect that can not be avoided is the construction of a single familyhome with utilities and septic system.E.Alternative to building a new single family home is not to build one on a legal single family homelot.F.Mitigating measures proposed to minimize impact are we setback an additional fifteen ( 15) feetfrom the shoreline setback, additional side and front yard setbacks, the house is less than themaximum height limit, and we have not maximized the full coverage of the site.
