Based on the Hawaii County Planning Commission Rule 9-11,(f), (4) PL-SAA-2024-000249 SHOULD NOT BE APPROVED NOR ACCEPTED for 2 years from September 24, 2024 the DENIAL date of PL-SMA-2024- 000058. POINT#1 Windward Planning Commission Actions on September 24,2024-DENIED-PL-SMA-2024-000058 "APPLICANT:TIELI WANG (PL-SMA-2024-000058) (PLEASE SEE THE ATTACHED) Application for a Special Management Area Use Permit to construct three (3), three-story, single-family dwellings and related improvements; one single-family dwelling will be constructed on each parcel.The three (3) parcels total 24,250 square feet and are located within the Special Management Area.The subject properties are located at the end of Machida Lane, approximately 300 feet east of Onekahakaha Road, Keaukaha, South Hilo, Hawai'i,TMKs: (3) 2-1-014:044,045 and 046. DENIED". POINT#2 According to the Hawaii County Planning Commission Rule 9-11,(f), (4), pg 9-19 REFILING: Whenever an application for a Special Management Area Use Permit has been denied, no new application for the same or similar development, covering all or any portion of the property involved in the application, shall be accepted by the Commission through the Director for a period of two years from the effective date of the denial of the application; provided, however,that upon showing of a substantial change of circumstances the Commission may permit the filing of anew application prior to the expiration of such a two-year period. As"no new application for the same or similar development, covering all or any portion of the property involved in the application,shall be accepted by the Commission through the Director for a period of two years from the effective date of the denial of the application", which was on September 24, 2024 'Red at8 by Ccif_y - 'd---AL— ,� » p • POINT#4 As defined for 3 reasons for DENIAL of SMA PL-SMA-2024-000058 at the Windward Planning Commission hearing on September 24, 2024: 1).Septic System Impact(recommended hooking up to sewer system) 2) Road Access Issues(the bad condition of the private road with no maintenance agreements leads to problems and concerns with tsunami evacuation and fire truck access) 3) Other Environmental Concerns None of these issues have been mitigated in the application of PL-SAA-2024-000249 and therefore should be DENIED and written into the amendments of any future development of TMKs: (3) 2-1- 014:044,045 and 046 The Hawaii County Planning Department advised Ms.Colter to submit the application for all 3 lots together as a larger development and therefore the SMA permit application should not be permitted to be submitted individually after the initial SMA permit application was denied. Ms Colter admits to this fact that she was advised by the Planning Department to submit all 3 properties together as the owners intention is to develop all 3 properties.
