1 KHD_SMA_Addendum_2024 COUNTY OF HAWAI‘I PLANNING DEPARTMENT ADDENDUM KONA HAWAII DEVELOPMENT, LLC SPECIAL MANAGEMENT AREA USE PERMIT APPLICATION (PL-SMA-2023-000038) _____________________________________________________ The Applicant has submitted updated site plans as part of the mediation process which was concluded on November 15, 2024. The updated site plans outline new agreed upon design changes for the proposed Special Management Area Use Permit Application No. PL-SMA-2023- 000038 (Planning Department Exhibit 20 – Updated Site Plans dated December 4, 2024). Since the updated site plans were submitted after the Background and Recommendation Reports were completed, the Planning Department is submitting the following addendum to the Directors Recommendation report. Additionally, based on the terms and conditions agreed upon during the mediation process by the parties involved, the Planning Department will be inserting two (2) additional conditions (No. 11 and 12) and amending two (2) existing conditions (No. 2 and 3) of the recommendation report for the subject SMA Use Permit Application: 2. The Applicant will comply with all applicable laws, rules, and ordinances from other affected Federal, State, and County agencies as necessary to comply with all applicable regulations, including, but not limited to, Hawaii Administrative Rules (HAR) Chapter 46, relative to Community Noise Control. 3. Construction and operation of the proposed 100-room hotel shall be conducted in a manner that is substantially representative of plans and details as contained within the Special Management Area Use Permit application dated September 6, 2023, the Memorandum of Agreement dated November 15, 2024, and representations made to the Leeward Planning Commission. 2 11. The Applicant will establish three (3) free public parking sparces designated for beach access in the area adjacent to Kahakai Road and south of the CJ Kimberly property. These parking spaces will be labeled “Public Coastal Access Only”. 12. The Applicant will develop an Emergency Response Plan (Plan) for the proposed hotel in conjunction with Hawaii County Civil Defense Agency and the Hawaii County Fire Department. The Plan shall cover shelter in place and/or evacuation procedures and routes in the event of hurricane, flood, fire, tsunami, earthquake, lava flow or other emergency requiring an emergency response. The Applicant will publish, post, and provide guests and employees with evacuation plans consistent with the recommendations made by Civil Defense and the Fire Department, and shall post signs at reasonably visible locations throughout the hotel. Staff notes that all conditions included in the recommendation report, and the addendum, will be re-numbered accordingly to include the two (2) additional conditions.
