Time ext. Jan. 31, 2002, was granted by the Planning Director to Dec. 13, 2008, for SMA 388. June 6, 2007, Final plan approval for permit of the foundation slab. (Slap over a Lava Tube) This was where the HEWA set in. The public question is, with no archeological study in place, was there also a cave? AS ALWAYS, There is" Mana and Spiritual Factors", which of recent are too often overlooked, Perhaps the Cultural Resources Commission needs to review and physically walk this property. When you do not respect, there are consequences and sadly, there is no good for future generations to come back to, it will haunt you by the iwi kupuna.. . Time and time again the ones making the wrong decisions are not forgotten. Those of you with history here, know the facts about these ancient powers and need for respect. Lava Tubes and Caves are known habitats of the threatened Hawaiian Bat and often IWI KUPUNA artifacts and even waa(canoes)were stacked and secretly buried. Please correct the past wrong done now! Do not proceed! As of Jan. 21, 2021, time extension was granted. Since May 2017 plan approval was not completed within 2 years, and hence expired: without further action, the SMA Permit was automatically Voided! Now Sept 6, 2023, a NEW SMA Use permit application. The large concrete needs to be addressed as to what they covered? Per Archeological Historic Resources, this was fully disturbed. March 14, 2019, SHPD confirmed the Absence of Any Study of the subject parcel, they requested an opportunity for review& any permits involving ground disturbances. Although the applicant commissioned Archeological work the Assessment firm found "no historical sites or features within the project area". SHPD had no response received. HICRIS (NO. 2023 PRO 1257). It is important to know what is beneath the concrete Slab. SHPD letter dated March 14, 2019, to Director Michael Yee, Chapter 6E-42 Historic Review SHPD records indicates that numerous archaeological studies have been conducted along Ali'i Drive near the current project area. Those studies documented numerous traditional and historic properties including, habitation complexes,platforms, lava tubes (Probable sleeping area) discontinuous wall segments, burial platforms, agricultural remnants, and permanent habitation sites. Additionally, our records indicate NO archeological inventory survey has been conducted for the subject parcel. Thus with this stated,I oppose any further ground disturbances associated with development until a full investigation of the SLAB cover up. Throughout 2019 and into 2020, the prior owner cleared a lava tube, filled it with engineered fill and concrete, and redesigned the tube along with the building for potential differences in compaction. How was this allowed without lineal descendants being contacted? This area is of importance to the Hawaiian Royalty of Queen Emma and maps depicts her residence of this Ahupua'a. Kona regional history is associated with Umi a Liloa. Records of Pacific Monarch Resort Inc. noted records of the SLAB "BLD/foundation/Slab inspection" were conducted..since the inspection occurred after the building permit was issued, it is Not Clear whether those inspections were for that or the March 22, 2007 permit. Traffic: Where is the Traffic Impact Analysis? Given Ali'i Drive is within the High Hazard Evacuation Area. This site falls within the Civil Defense Tsunami Evacuation Zone. The shoreline is less than 300 feet from the lower portion of the subject site. We cannot handle any more development for one main reason are the Utility Poles with overload of the utility lines. We would not be able to evacuate, and we should definitely take seriously what occurred in Lahaina could happen here. I have heard many residents say this! Noted by Sid Fuke's letter of Nov. 10, 2023, to Zendo Kern In the event there is a need for evacuation, (wildfire, tsunami, or flood)there is sufficient evacuation warning. However, in the event of a locally generated tsunami... there would be little evacuation time, and regrettably, it would be. SOMETHING THAT CANNOT BE AVOIDED! We know the problem ahead, SO DO NOT ADD TO THIS! The comments from the State of Hawaii Ka Moku'aina O Hawaii Commission of Water Resources Management of Oct. 19, 2023 addressed concerns: Coordination with Water Use and development plan. (while we have water, what about the broken wells in North Kona) Concerns to Stormwater management(with Climate change and so much grading above more flooding to Makai, Kuakini Hwy to Alii Drive) Recommend Hawaii Green Business Program. (Concrete large structures are just the opposite) Recommend adopting landscape as best management. (this is the only solution to save our Ocean) There is potential for ground or surface water degradation/contamination and recommend approval be reviewed by the State Dept. of Health. And lastly while the SMA app reports indicates the water commitment fees and facility fee have been paid to DWS,the Commission has concerns on whether existing DWS capacity can meet the additional proposed demand of 22,000 pd for this proposed project. Should any New Water source (wells) develop be necessary to meet this demand,the Commission has concerns about new Source development impacts to Any Native Hawaiian Traditional and Customary rights in the area as well as impacts to Groundwater dependent ecosystems that may be affected. New water source development would require Commission permits and approvals. Oftentimes we are asked to ration our water usage and also,we have rolling black outs for electricity. Now added is the recent alert from Hawaiian Electric Public Safety Power Shut off or PSPS Watch. Due to weather conditions, including wind. Just say NO,we cannot add to the risk of this special and fragile SMA area. Public Safety should be of Priority. Please show respect to this Hawaii that we all love. Stop this development! DO NOT TURN YOUR HEADS AWAY FROM THE CORRECT DECISION NEEDED HERE! YOU HAVE THE LAST SAY, SO JUST SAY NO. NO!
