This meeting will be held in-person at the location listed in this notice and by Interactive Conference Technology (ICT) through Zoom. DATE: Thursday, May 15, 2025 TIME: 5:00 PM – 7:00 PM LOCATION: Waikōloa Village Association Community Room 68-1792 Melia Street Waikōloa Village, HI 96738 ZOOM: https://www.zoomgov.com/meeting/register/RevCbk1RRP2OC8kXwARqLw INTERACTIVE CONFERENCE TECHNOLOGY (ICT): A meeting held by ICT shall be automatically recessed for up to 30 minutes to restore communication when audiovisual communication cannot be maintained with all members participating in the meeting or with the in-person location identified in this notice. The meeting may reconvene when either audiovisual communication is restored, or audio-only communication is established after an unsuccessful attempt to restore audiovisual communication. If it is not possible to reconvene the meeting as provided in this subsection within 30 minutes after an interruption to communication, the meeting will be automatically terminated. PUBLIC TESTIMONY: The public may provide oral testimony at the meeting by joining Zoom or attending in-person at the physical location listed above. Although not required, to register in advance for oral testimony please contact staff at cdp@hawaiicounty.gov or (808) 961-8288. Pursuant to Section 92-3, HRS, interested persons who want to provide oral testimony may do so either at the time the committee takes public statements on the agenda, or at the time the specific agenda item is called. Please note that public testimony may be limited to three (3) minutes in length per agenda item. In addition, although not required, to ensure timely delivery of written testimony to committee members, it is requested that written testimony be submitted by 4:30 p.m. at least two business days prior to the meeting via email to cdp@hawaiicounty.gov. When submitting written testimony, please specify for which agenda item written testimony is being submitted. All written testimony will be a part of the public record. AGENDA I. Puakō Sewer Project Update – Committee member Karen Anderson will provide an update on the Puakō Sewer Project, with potential committee decision-making. 2. Waimea Water Resources Community Meeting Update – Vice-Chair Scott Nagata will report on the Waimea Water Resources Community Meetings held on January 22, 2025 and April 30, 2025 with potential committee decision-making. 3. Kailapa Firewise Evacuation Plan Update – Committee member Jojo Tanimoto will provide an update on the Kailapa Community Meeting held on December 27, 2024, with potential committee decision-making. V. PROPOSED NEW BUSINESS – Committee members will discuss potential agenda items for the next meeting. VI. ANNOUNCEMENTS • Mahalo to Pete Hendricks for his time, dedication, and service to the community and the South Kohala CDP Action Committee. • Council Member James Hustace will provide updates related to the South Kohala Community Development Plan. • Jeff Darrow has been confirmed as the new Director of the Planning Department as of January 22, 2025. • A Joint Action Committee Chairs and Vice-Chairs meeting was held on February 13, 2025. • SB869, relating to Community Outreach Boards, has been passed by the full Senate and is awaiting signature by the Governor. • Environmental Notice Regarding Pololū Trailhead Management Plan: https://files.hawaii.gov/dbedt/erp/The_Environmental_Notice/2025-03-23-TEN.pdf • The Planning Department is seeking applicants for the South Kohala Action Committee and requests assistance in spreading the word to interested community members. Election of Chair and Vice-Chair – Discussion and potential action to elect a Chair and Vice-26 Chair for the South Kohala CDP Action Committee for 2025. 27 This item was called to order 5:21 p.m. [SEE YOUTUBE TIMESTAMP 11:49 & 1:34:45] 28 Committee member Sanborn made a motion to nominate Chair Licoan for Chairperson 2025. The 29 motion was seconded by committee member Alos. The motion passed unanimously. Chair Licoan 30 accepted the role of Chair for 2025. 31 Chair Licoan made a motion to nominate Vice-Chair Nagata for Vice-Chairperson 2025. The 32 motion was seconded by committee member Anderson. The motion passed unanimously. Vice-33 Chair Nagata accepted the position of Vice-Chair for 2025. 34 This item closed at 5:25 p.m. 35 SOUTH KOHALA CDP ACTION COMMITTEE Minutes of January 16, 2025 2 2. Testimony at State Legislature Regarding HRS 92 (Sunshine Law) – Presentation by 36 Nancy Pisicchio regarding a drafted bill being introduce to the Legislative Session that could 37 provide Sunshine Law flexibility for CDP Action Committees. Followed by discussion and 38 decision-making to provide testimony to the Legislature. 39 This item was called to order at 5:25 p.m. [SEE YOUTUBE TIMESTAMP 16:00 & 1:08:05] 40 Nancy Pisicchio from the Kona CDP Action Committee discussed challenges posed by Chapter 41 92 ("Sunshine Law") on the action committees, which need more flexibility for community 42 interaction. She highlighted past legislative amendments (Chapter 92.81-92.83) and ongoing 43 efforts, led by Senator Dru Kanuha, to further amend the law to improve flexibility and 44 engagement for neighborhood boards and other counties. 45 John Pelletier from the Kona CDP Action Committee emphasized the proposed benefits, including 46 allowing public input on non-agenda items, holding meetings without a quorum (no decisions 47 made), and enhancing community outreach. 48 Committee member Anderson inquired about opposition to the bill, to which Nancy responded 49 that she knows of no opposition but noted some defensiveness about the Sunshine Law’s quorum 50 rules. She offered to provide updates on the bill’s posting. 51 Committee member Sandborn moved to submit written testimony in support of replicating what 52 the Kona CDP Action Committee already voted to submit and that the South Kohala CDP Action 53 Committee will be updated with the bill numbers once it is released. The County 65 Department of Water Supply (DWS) will host an informational presentation with a Q&A session 66 on January 22nd, from 5 to 7 p.m., aiming to address community needs. The meeting washosted by 75 Senator Tim Richards and Civil Defense Administrator Talmadge Magno at the Kailapa 76 Community Center to discuss critical topics such as water resources for Kawaihae and the 77 development of an emergency road. 78 • The Planning Department is currently seeking applicants for the South Kohala Action 79 Committee and is requesting assistance to get the word out to interested community 80 members. The application can be found on the Mayor’s office website at: 81 https://www.hawaiicounty.gov/our-county/boards-commissions-application 82 • The Environmental Notice Waikoloa Drive/Paniolo Avenue Roundabout – Final EA 83 (FONSI): 84 • Vice-Chair Nagata shared that he attended the South Kohala Traffic Committee meeting, 85 where the State Transportation Department announced that the Waiaka roundabout project 86 is in its final stages. They plan to begin construction in the next couple of months, so 87 preparations for traffic disruptions in the area are expected soon.
