MEMORANDUM No. 2024-10 November 18, 2024 TO: Staff Zekik ker4 FROM: ZENDO KERN Zendo Kern(Nov 19,2024 05:52 HST) Planning Director SUBJECT: BUILDING PERMIT REJECTION PROCESS The purpose of this memo is to provide direction to staff when a building permit is being considered for rejection and resubmittal during Planning's Land Use Review of the permit. Typically, a building permit is assigned to Planning for the Land Use Review. This is reviewed for street address verification and for land use review. If one or both reviews is rejected, it is returned and requires resubmittal by the applicant. This will cause a delay to the building permit approval process. To help ensure that any rejection is needed, the staff member reviewing the building permit will be required to receive approval from either an immediate Supervisor, a SMA Planner(if SMA related), a Planner(if Plan Approval related), a Manager,the Deputy Director or the Director. Upon receiving approval from either one of the above,the assigned staff member shall make a notation in the building permit note area of the approving Supervisor, Planner, Manager, Deputy Director or Director by noting"Approved by [name of approving authority]. This process is being implemented based on several previous rejections of land use reviews for building permits that could have been avoided if reviewed by an approving authority. Examples include, rejecting a permit for SMA review and requiring a SMA Assessment before resubmittal when a SMA Assessment is not required or rejecting for Plan Approval when Plan Approval is not required. The applicant shall secure all necessary approvals and permits from other affected federal, state, and county agencies as necessary to comply with all applicable laws and regulations. 2. This exemption only applies to the proposed uses activities and operations as presented on Page 1. No additional development shall be allowed within the SMA without obtaining a permit. 3. Artificial light from exterior lighting fixtures, including, but not limited to floodlights, uplights, or spotlights used for decorative or aesthetic purposes is prohibited if the light directly illuminates, or is directed to project across property boundaries toward the shoreline and ocean waters, except as may otherwise be permitted pursuant to HRS§205A-7I(b). 4. In the unlikely event that surface or subsurface historic resources, including human skeletal remains, structural remains (e.g. rock walls, terraces, platforms, etc.), cultural deposits, marine shell concentrations,sand deposits,or sink holes are identified during the demolition and/or construction work, cease work in the immediate vicinity of the find, protect the find from additional disturbance and contact the State Historic Preservation Division at(808)933-7651. 5. Best Management Practices regarding water quality and equipment maintenance must be strictly adhered to during all phases of construction to ensure that no construction or equipment runoff enters a coastal or riparian area. 6.
