PA IL w w . r r HISTORY: • SMA Permit No. 03-007 was approved by the Planning Commission to develop a 12- unit, 31/zstory condominium on June 17, zoos. • Pursuant to Condition No. z of the Special ManagementArea (SMA) Permit, the required completion of the project by June 17, z010, was not satisfied, thereby rendering the condition unfulfilled. • On March 16, 2017, the Planning Commission approved an amendment to Condition No. z of the Permit, thereby reviving the permit and granting a seven (7)-yeartime extension. HISTORY • On January A, 20a.8, The Planning Commission voted to amend Special ManagementArea (SMA) Permit No. 03-007 to modify Condition No. 3 of the permit. The original condition, pursuant to the requirements of the County Zoning Code, required the establishment of a twenty-foot (20') wide access easement on Tax Map Key (3) 7-5-021:038 to serve a proposed twelve (12)-unit structure. The applicant was unable to secure the necessary land for a 20-foot-wide easement and considered revising the scope of the proposal to a 4-unit structure in lieu of the 12-unit structure by amending the condition to allow for a 16-foot right of way for fewer than 4 units. • Pursuant to Condition No. z of the Special ManagementArea (SMA) Permit, the required completion of the project by January 18, 2025, was not satisfied, thereby rendering the condition unfulfilled. CURRENT PROPOSAL • • The applicant proposed to change the scope of the project from a 12-unit condominium to a single-family residence. As the scope of the project is considerably different from the original permit for a 12-unit condominium as well as the timing condition, the applicant is seeking a new SMA Use Permit and is seeking to revoke the original SMA Permit No. 03-007. PROPOSED PROJECT: • Construction of a two (2) story, 3,870 square foot single-family residence. • Consists of five (5) bedrooms, five (5) bathrooms, a three (3) car garage which includes a 936 square foot attached garage. • Related development includes a swimming pool, lanai and garage. • Building will be approximately 28.5 feet in height. • Existing utility infrastructure (water, sewage & electricity is available to the site. c� RM-4: MFR 24,000 sf,fi V-1.25: resort-hotel 1,250 sf. DIRECTORS RECOMMENDATION • Planning Director recommends revoking SMA No. 03-007 so that the applicant can pursue the project under PL-SMA-2025-000080.
