Alcohol will cross the unlicensed areas solely for the purpose of transporting alcohol to the storage areas located on the first floor. KIND OF BUSINESS: Applicant will operate as a family friendly golf simulator and retail business, open seven (7) days a week from 11:00 a.m. — 10:00 p.m. Applicant has installed two (2) advanced golf simulators which will be rented out hourly, allowing customers to practice or play simulated rounds of golf indoors. In addition to simulator rentals, the space will offer a curated selection of golf -related retail products, including accessories, apparel, and lifestyle items tailored to the golfing community. Applicant would also like to offer alcohol and prepackaged snacks, bentos, etc., for retail. Employment will consist of approximately four (4) employees, all of which will be certified by the Department of Liquor Control to supervise the sale of liquor. LEASE: Forthcoming. UNLICENSED PREMISES: The lease will reflect that the Applicant has control and use of its premises located at 26 Hoku Street, Hilo, therefore, customers will be allowed to consume food and drinks purchased from Applicant within its premises. Session 1 discussed Navigating Tariffs: Adapting to Rising Costs in the Alcohol Industry. The panel consisted of Sarah Bradley, General Counsel, North America, Campari America, LLC, Darshak S. Dholakia, Partner at McDermott Will & Emery, Rob Maron, Senior VP, International Trade Policy and Market Access, DISCUS, William Tomaszeewski, Senior Regulatory Advisor, Wine.com and Julie Cook, Senior Counsel, Compliance, Wegmans Food Market, Inc. Key discussions included: 1) the purpose of tariffs i.e. protect domestic industry from foreign competition, generate government revenue and retaliate against unfair trade practices. 2) how tariffs affect the liquor industry i.e. aluminum cans are subject to Section 232 tariffs as an "aluminum derivative" product, which leads to higher production costs for beverages packaged in aluminum cans, which are then passed to consumer. 3) recognizing and supporting the Administration's goal for jobs and manufacturing in the United States, however, the United States hospitality industry and farmers are struggling (the agriculture section is so important to the liquor industry i.e. grapes, corn, wheat, barley, hops, rye, etc.) Tariffs on imports risk more retaliation on U.S. exports. The dilemma faced by industry leaders is whether tariffs are a temporary disruption or a structural change that will have long-term impacts on the industry. Hawai'i County is an Equal Opportunity Provider and Employer Page 2 Session 2 discussed New York and Its Neighbors: A Historical Perspective on Alcohol Trafficking from Prohibition to Today. The panel consisted of Martin Mehler, Senior Partner, Mehler & Buscemi, Kirstin L. Krueger, Interim Director, New Jersey Division of Alcoholic Beverage Control, Marc Sorini, General Counsel, Brewers Association, Jeremy Locke, Deputy Chief Operating Officer, The Alcohol & Gaming Commission of Ontario. Key discussions included: 1) National Prohibition came in with the ratification of the 18th Amendment to the Constitution in 1919. Starting in 1917, wartime rationing severely curtailed alcohol availability. Many states became "dry" prior to 1919. Congress passed the infamous Volstead Act to codify and enforce Prohibition. 2) Prohibition bred disrespect for the law i.e., respectable citizen's flouted the ban on alcohol, fueled massive and violent organized crime underworld and moved consumption towards dangerous products. 3) By the early 1930's the secondary effects of Prohibition and the need for excise tax revenue in the Great Depression caused public sentiment to turn towards repeal. 4) In 1933, the 21 St Amendment repealed Prohibition and its second clause authorized states to control the traffic in alcohol within their borders. 5) Congress enacted the Federal Alcohol Administration Act ("FAA Act") in 1935 to establish federal oversight of the newly legalized alcoholic beverage industry. Session 3 discussed Pouring with a Purpose: Compliance in Alcohol -Focused Donations and Scholarships. The panel consisted of Rob Pinson, Partner & Alcohol & Trade Hospitality Team Leader, Adams & Reece, Ryan Malkin, Principal Attorney, Malkin Law P.A., Missy P. Welch, Esq., Director of Programming, North Carolina Alcoholic Beverage Control Commission, Randy Barnhart, VP Governmental Relations Eastern Region & Canada, Southern Glazer's Wine and Spirits. Key discussions were 1) Sponsorships i.e. NFL, college football, NASCAR, and how it can benefit the alcohol companies such as brand awareness, targeted marketing, emotional connection with fans and access to large audiences. For example, Whiteout Tequila was co-founded by former Penn State football players and was inspired by the culture and atmosphere of Penn State's White Out games. Bottle signing, where fans can get bottles of Whiteout Tequila signed by former Penn State players, connect the tequila brand with the strong community and traditions of Penn State football. 2) Burden of alcohol sponsorship falls to the regulator where they have to be mindful of what they say they want to do vs what they are really doing. Regulatory concern is the normalization of alcohol consumption among young people who are heavily exposed to alcohol branding during sports events. Few ways to reduce burden is encouraging responsible consumption, limiting industry exposure, inventory product before and after event when there is sampling involved at event, require server training before events and always keeping public safety at forefront. Session 4 discussed Beyond the Bottle Bill — Assessing Public Policy Options to Reduce Environmental Impact of the Alcoholic Beverage Industry. The panel consisted of Steve Gross, VP, State Relations, Wine Institute, Paul Gagliardi, Owner of Flair Beverages Corp., Paul Pisano, Senior VP, Industry Affairs and General Counsel, National Beer Wholesalers Association, Scott Wexler, Managing Director, Catalyst Government Relations. There are 10 bottle bill states throughout the US, one being Hawaii. Each state has their own version of a bottle bill. Bottle bills, also known as container deposit return laws, are the practice of adding a small deposit on top of the price of a beverage, which is repaid to the consumer when an empty can or bottle is returned to a redemption center for recycling. There are ongoing efforts to expand existing laws or create new laws regarding cash redemption value programs. Discussions consisted about sustainability and what can be confusing for the consumers on what can and cannot be redeemed. Page 3 Session 5 discussed Keeping it Local: Small Businesses Work to Remain Compliant and Thriving. The panel consisted of Jamie Gallagher, Deputy Counsel, New York State Liquor Authority, Michael Correra, Executive Director, Metropolitan Package Store Association, Inc., Brian Facquet, Chairman, New York State Distillers Guild, Sandra Jacquez, President, New York State Latino Restaurant, Bar and Lounge Association, Tim Pezzolesi, Director of Agriculture Development, NYS Dept of Agriculture and Markets, Dave Simoni, General Counsel, Corporate Affairs, FIFCO USA. Key discussions involved the different viewpoints from the speakers. While a distiller in New York creates jobs and supports the agriculture by working with farmers, their biggest challenge is access to distribution (cannot be picked up by a wholesaler) so they need to self -distribute which creates a financial disadvantage. Majority of their monies are made in tasting rooms and farmer markets. For a small retail operation, they value the three-tier system and how it ensures safe, orderly and accountable marketplace and how it creates fairness by preventing monopolies and giving family operated small stores a chance to thrive. Locally owned and independent operators are part of the neighborhood fabric i.e. know the customers personally and supports local causes. Session 6 discussed Custom Crush vs. Alternating Proprietorship: Who's in Charge Here? The panel consisted of Curtis R. Harrington II, Founding Partner, Belcher Sykes Harrington, PLLC, Chris Messina, Senior Partner, Barnes Beverage Group, Maggie Woods, Distilled Spirits Administrator, Kentucky Department of Alcoholic Beverage Control, Jennifer Hill, Outreach Program Manager, Alcohol and Tobacco Tax and Trade Bureau. Custom Crush is a contract under which an established licensed producer makes wine/beer/spirits on behalf of a third -party brand owner whereas an Alternating Proprietorship is an arrangement where two or more separately licensed producers, i.e. wineries, breweries or distillers, share the exclusive use of a bonded facility. Custom crush are attractive for new entrants who want to build a brand without the cost or regulatory burden of becoming a bonded producer. Very common in wine industry. Primary licensed holder/producer remits all taxes, operation costs, formula submissions, COLA applications, etc. Brand owner can be involved in decision making of the products and the labeling of the brand owner can include who the manufacture is; this will include the Producer registering the dba of the Brand Owner under their permit. Alternating Proprietorship are often used by startups who want to operate under their own permits but cannot afford a full build -out of the premises. Although it requires more regulatory overhead then Custom Crush, it does provide more independence and control. The licensed producers alternate use of the bonded space and equipment for their own production during times of its exclusive use (no commingling of the revenue). Each proprietor must have its own independent licensing and registrations i.e. TTB permits and each must maintain its own records, labels, inventory and tax responsibility. The TTB will need to approve the Alternating Proprietorship before it can begin. Session 7 Alcohol Jeopardy. Fun interactive trivia game with attendees involving alcohol. Page 4 Session 8 Bridging Policy and Practice: Educating vs Lobbying vs Lawyering. The panel consisted of Travis Hill, Counsel, Hunton Andrews Kurth, VA, Wendy Knight, Commissioner, Vermont Department of Liquor and Lottery, Thomas Akras, Director Legal and Legislative Division, Maryland Alcohol, Tobacco and Cannabis Commission and Rodrigo Diaz, Executive Director, Pennsylvania Liquor Control Board. Where one is positioned within the government shapes the regulatory and decision -making approach that is taken. As an educator, the approach will be informing and guiding stakeholders on compliance and best practices, as a lobbyist, the approach will be advocating for policies and interests within the legislative and executive environment and as a lawyer/technical expert, their responsibility of maintaining legal compliance through interpreting regulations and hearing decisions is key. Four qualities of good regulator are clarity, consistency, accessibility, and confidentiality. A clear understanding of roles, strategic engagement, continuous learning and maintaining integrity are effective in bridging policy and practice. Session 9 discussed the Logistics of DTC: Fulfillment Houses & Shipping Legally. The panel consisted of Russell F. Thomas, Executive Director, Tennessee Alcoholic Beverage Commission, Dustin Pickens, Lead Counsel, Regulatory Affairs, FedEx Ground, Federal Express Corporation, Alex Koral, Regulatory General Counsel, ShipComplaint by Sovos, Elaina Parina, VP, Regulatory Affairs, Constellations, Alyssa Wickstrom, Chief Legal Officers, Wineshipping.com. A fulfillment house is any location that ships wine directly to consumers with an address other than the address listed on the Direct -to -Consumer license, regardless of ownership. Fulfillment houses offer a variety of services including inventory control and technology (weather holds and live feeds), access to carriers, additional compliance checks, etc. Fulfillment houses are bonded warehouses used to store wine prior to sale; it is licensed by the TTB as a Bonded Wine Celler which permits all activities of a bonded winery except production. Fulfillment houses are agents of the wineries they support and everything is done at the direction/control of the licensed winery. Fulfillment houses do not sell alcohol. Takase Director Pursuant to Section 2-100 (b) of the Hawaii County Code 1983 (as amended), the following report is submitted for the National Conference of State Liquor Administrators (NCSLA) hosted by the South Dakota State Liquor Authority held at the DoubleTree by Hilton Rapid City Downtown Convention Center, in Rapid City, South Dakota. Session 1 was "Boomer vs. Zoomer: Bridging Generational Gaps in the Alcohol Industry." The panel was moderated by Kristen Techel, Drink law, and panelists included Bridget Halbur, Beatbox Beverages; Lester Jones, National Beer Wholesalers Association; Casey Scamporino, DISCUS; and Lynn Walding, Diageo North America. The panel discussed how "Alcohol is more than a product- it reflects culture, lifestyle, the times and values. As generations change, so do their relationships with drinking." Some key points included how the different generation's view alcohol, with 72% of Baby Boomers having consumed alcohol vs Generation Z, "Zoomers", drinking 20% less per capita as alcohol concerns surge. Generation Z, "Zoomers", are known more for being the "sober -curious" generation, while the older Baby Boomer generation drinks freely and openly. These generational shifts are reshaping the industry, driving Diageo and other global beverage brands to innovate and adapt. Some of the actionable strategies to combat this in the alcohol industry include enhancing appeal through health -conscious marketing, flexible consumption, investing in no/low alcohol drinks, reflecting moderation trends, and using consumer research to anticipate generational shifts, while still ensuring responsible advertising to Gen Z (half of whom are not of legal drinking age yet). Session 2 was "Beyond the Bouncer: Modern Tools for Preventing Underage Sales." The panel was moderated by Roger Clayton, Partner, Stike Kerr & Johns, and the panelists were Robert de Ruyter, Assistant General Counsel, California Department of Alcoholic Beverage Control; Ben Halpert, Head of Regulated Products, Corporate Compliance, Go Brands; Patrick Maroney, President, Maroney Consulting Services. Key discussions included the rise in ID scanning apps, digital IDs, and biometrics across the states, and how this may Hawai'i County is an Equal Opportunity Provider and Employer Page 2 affect alcohol regulation. Regulators are seeing a rise in the use of scanner Apps, such as Intellicheck ID checking App, which allows a retailer or licensee to scan a barcode on the physical ID to check if it's either valid or fraudulent, however, this method is not foolproof and can give retailers a false sense of protection because they aren't even looking at the picture in some cases to ensure the person on the ID is the person standing in front of them. One of the positives that comes with the introduction of digital IDs for regulation is that they are extremely difficult to fake, so anyone trying to create a fraudulent ID will steer clear of digital IDs, however, some of the state -approved digital driver's licenses only provide a QR code, without the name, date of birth, description and picture of the ID holder as required for alcohol regulation. In those states that have amended their rules to explicitly allow for digital IDs or biometrics, a state -approved App must be used, the format of the ID within the Apps can vary, and other states can't access secure databases that the ID's are attached to for out-of-state Us. Retailers rely on their employees to watch customers open the state approved App, and customers are worried about their data privacy which can lead to confrontation and customer friction. Looking forward, states will inevitably continue to adopt the usage of digital IDs, and a uniform approach will be needed in the alcohol industry so that retailers and regulators can ensure compliance all around. Session 3 was "Keep Calm and Plan (Way) Ahead: Making Sense of Multistate Permitting for Manufacturers with M&A and Corporate Changes". This presentation was moderated by Erin Kelleher- Partner, Hinman & Carmichael LLP, and panelists included Kristin Carlton, Director of Compliance, Penrose Hill/Firstleaf; Janelle Christian- Director, Office of Outreach, Alcohol & Tobacco Tax & Trade Bureau (Janelle was unable to attend due to the government shut down); and Theresa Barton Cray- Associate, Dickenson Peatmen & Fogarty. Key discussions included the different types of corporate events including asset sales, entity conversions, and stock sales, and how difficult these may be to manage in the alcohol industry because of different permitting requirements from the TTB and between states. The panel discussed TTB's perspective on the Change in Proprietorship and the problem it presents with the IRCs and FAA Act having separate permitting obligations, one requiring pre -qualification (plant registry) and the other permitting a post -event application (basic permit). The somewhat awkward solution for compliance to the change in proprietorship are "Transitional Services Agreements" where the seller keeps permits active, and continues to produce, report and pay taxes, hires the buyer to perform services related to the operations, and agrees where the money flow is coming from. On top of the differing federal requirements, different states also have different requirements for the Change in Proprietorship, including but not limited to a temporary license being issued to the buyer to continue operations while the Sale and Transfer is being completed, and issuance of a new license upon completion in the buyer's entity name. Because everything must now be associated with the new operating entity, and this can take months up to years in some states and federally to obtain liquor licenses and TTB permits, it's pertinent to loop in compliance team early on in deal discussions to assess the implications and consider options for streamlining disclosure. Session 4 was "What Regulators Wish Industry Members Knew". This presentation was moderated by Shauna Barnes, Founding Partner, Barnes Beverage Group, and panelists included Rodrigo Diaz, Executive Director, Pennsylvania Liquor Control Board; Nicole Sanders, Industry Education Manager, Illinois Liquor Control Commission; Thomas Philpot, Shareholder, Gray Robinson, former Director of the Florida Division of Alcoholic Beverages and Tobacco; Audra Shughart, Licensing Manager, Kansas Alcoholic Beverage Control. This session focused on some of the challenges Regulators face when dealing with liquor licensees, including an increase in market saturation and last-minute requests coupled with Page 3 limited staffing which makes it difficult to properly educate on alcohol safety, and/or get to applications under tight deadlines in some states. Misinformation from the public causes confusion and often non-compliance that is further complicated by outdated systems and decade old laws. It is important for us regulators to clarify our roles as being responsible for enforcing laws but not necessarily creating them as this is often misunderstood by the public. Early, transparent communication is essential to navigate complex political realities while maintaining positive relationships with our licensees. Session 5 was "And Now for the Rest of the Story: Hot Topic Regulatory Updates". This panel was moderated by Adam Stapen, Partner, Dill, Dill, Carr, Stonbraker & Hutchings, PC, and panelists included Mary Clarke, Assistant General Counsel, Wine & Spirits Wholesalers of America; Parker Conover, Attorney, Godfrey & Kahn; Christopher Curtin, Director of Regulatory Affairs, Republic National Distributing Company; and Geralyn Lasher, Director, Great Lake States, Wine Institute. This discussion focused on Interstate shipping, Bottle Deposit Laws, and Hemp derived products. Direct Wine Shipping is a 4-billion-dollar industry that allows wineries to ship directly to consumers, in essence, circumventing the three-tier system, so how do we, as regulators, monitor it or know when products are being shipped in illegally? The panel reviewed which states allow it, where it's prohibited, and how it is regulated. In some states, like Indiana, Wyoming, and Louisiana, shipping wine direct to consumers is only allowed if the product is not in wholesale distribution. Other states allow shipping beer and/or spirits directly to consumers as well. A Bottle Deposit law largely occurs at the retail level, where a deposit is paid by the customer/consumer and the deposit is refunded when the container is returned to a designated redemption center or recycling facility, in essence, incentivizing the recycling of materials, but where does the money that isn't redeemed go? In California, any unredeemed deposits can only be used on furthering CA's recycling efforts. Lastly, the United States is seeing a rise in Hemp derived products containing Delta-9 THC. In many states there is still no legislation regulating intoxicating hemp products. In other states, regulations are being given to alcoholic beverage agencies. Kentucky uniquely incorporated the regulatory framework of "cannabis -infused beverages" into its existing alcohol regulatory framework allowing wholesalers to obtain a "cannabis -infused beverage distributor's license" which may be supplementary to a distributor or wholesaler license. Session 6 was "Laboratories of Libation: Craft Policy Experiments in the States." This panel was moderated by Jeff Giametta, Counsel, Davis Wright Tremaine LLP, and panelists included Michael Walker, State Policy Advisor, American Craft Spirits Association; Matthew Bolting, Principal Attorney, Law Office of Matthew D. Bolting; Jesse Scheitler, Co- Founder/CEO of Lost Cabin Ber Company in rapid City and Head of South Dakota Craft Brewers Guild; Dwayne Kratt, Vice President- External Affairs, Johnson Brothers. This panel focused on craft beers and spirits, the policies being experimented, and the perspectives from regulatory agencies, wholesalers, and brewmasters. What is "Craft" in the liquor industry? Craft has been defined as smaller production, independent ownership, not corporate, and does not apply to wine- only spirits or beers. There are over 2000 craft distillery's nationwide, however, 90% of craft sales occur in -state due to restrictions on selling direct to consumer in other states. In 2017, craft brewers fueled the legislative changes to allow direct sales to consumers, self -distribution, and increased allowance amounts in the state of South Dakota. This has caused somewhat of a stir with wholesalers and some regulatory agencies who think this isn't fair to other retailers who pay a lot to carry and sell certain products, and those who are strong proponents of the 3-tier system where manufacturers can only sell to wholesalers, who then distribute to retail for consumers. Some of the questions surrounding the rise of the small craft industry are `What happens when craft distillers start making more quantitatively?' Page 4 `Will they become more of a brewery or beer manufacturer and not be allowed to sell direct -to - consumer anymore?' `Should small craft producers stay small and keep their privileges, or do they choose to grow and get certain privileges taken away?' `Will Small Craft Brewers/Distillers try to change the legislation again?' `What defines success for a craft distillery or brewery?' Session 7 was "Can ChatGPT be your new associate? The Ethics of Al." This panel was moderated by Alva Mather, Partner, McDermott Will & Schulte, and panelists included Kristina Dickens, Counsel, Foster Garvey; and William Tomaszewski, Regulatory Advisor. This session discussed the use of Al and ChatGPT in regulatory work, and some of the concerns that come with ChatGPT. Artificial Intelligence is using computers to complete tasks that usually require human intelligence. Al "learns" by looking at training data, user inputs and outcomes, and isn't always correct! An attorney used ChatGPT when writing a case and presented false information which led to a lawsuit and other consequences. ChatGPT comes off very confident, however, we must be very careful, fact -check the laws, make sure they're up to date and find the most current laws and changes in legislation. There are also ethical concerns with an attorney' s use of Al for research and writing up documents. Are they able to charge the same amount of time for their research that takes less than half the time? Confidentiality is a concern when inputting client information into public Al uploads as well. The takeaway was that essentially, Al is guessing, and regulators can't and shouldn't rely on Al or ChatGPT to present us with factual evidence. Al is a tool, not a substitute and we, as regulators, are responsible for the final work product. Session 8 was "Kickoff to FIFA World Cup 2026". This panel was moderated by Claire Mitchell, Principal, Foster Garvey, and panelists included Rebecca Smith, Director Licensing and Regulation, Washington Liquor and Cannabis Board; Russ Elliott, Deputy Director, Colorado Liquor Enforcement Division; Dacia English, Outreach & Education Coordinator, Montana Cannabis and Alcohol Regulation Division; and Elizabeth Kruis, Senior Vice President Legal — Food & Beverage, Live Nation. This panel focused on licensing and regulation at large public events specifically for the upcoming FIFA World Cup. Different states require different licensing for large outdoor public events and must coordinate with businesses and other regulatory agencies across states. For example, Colorado has a "festival permit" that licensees can apply for and host a festival off -premises, while Washington and Montana (much like Hawaii) have a "Catering Permit" that allows their brick -and -mortar licensee to apply for catering off premises at large events like this. Washington state went as far as having to change the law to allow for expanded outdoor alcohol services in public areas for the FIFA events which are expected to draw 750,000 visitors to Seattle, and Seattle will apply for a liquor license for the entire city. As a requirement with all of these applications to liquor regulatory agencies, there must be an adequate site plan submitted for ingress/egress, parking spaces, ride share plan, weather plan, adequate police presence, communications, etc. Some of the challenges seen with these large outdoor events are monitoring alcohol consumption - wrist -banding, no re-entry policies, and limiting the number of drinks per transaction all help to limit overconsumption and consumption by minors. Conversations for large events like this are initiated up to two years prior to the event itself with officials, including the mayor, city council, police, liquor control and other regulatory agencies to ensure as smooth an event as possible. Session 9 was "Sturgis After Hours: Understanding the Impact Beyond the Ride". This panel was moderated by Jason Evans, Deputy Secretary, South Dakota Department of Revenue and panelists included Aaron Jordan, Sturgis City Administrator; Katie Sieverding, Executive Vice President, South Dakota Beer Distributors Association; Geody VanDewater, Sturgis Chief of Police; and Brad Strain, Sales Manager, Quality Brands. This panel focused Page 5 on the 85th annual Sturgis Motorcycle Rally, known as the largest motorcycle rally in the world, the history of the Rally, the economic impact to the small community of Sturgis and the surrounding areas, and some of the adverse effects of the large crowds during this massive 10-day event. Way back in 1938, J.C. "Pappy" Hoel and the Jackpine Gypsies Motorcycle Club hosted a Gypsy Tour through South Dakota's beautiful Black Hills. That summer event known as "The Black Hills Motor Classic" would grow into America's most famous motorcycle rally. The first rally drew just 200 participants, while the 75th anniversary of Sturgis in 2015 brought 739,000 attendees from all 50 states to Sturgis, South Dakota. Over time, Sturgis turned into a huge "Spring Break" type party rather than just a motorcycle event. Today, over $1 Million dollars in sales tax is generated in 10 days during Sturgis, and over $2 Million in taxable revenue. The worst or least busy day of the rally is still the best day of the year for businesses in Sturgis, SD. One of the challenges this presents for a small town built for a population of 7200 people is the infrastructure is not built for that many people. Leading up to Sturgis, the city currently sets up temporary stop signs and traffic lights to control the flow of traffic. During the event, early each morning garbage collection and beer drop off from distributor trucks occurs at 2am while the streets are empty. The Sturgis Police Department is a 21-person department, so every year law enforcement is flown in from all over the nation to ensure proper presence at the 10-day event. There is a motorcycle gang presence each year with Hells Angels, Bandidos, Pagans and Outlaws, however, according to Chief VanDewater the gangs know how to behave at Sturgis and there haven't been many issues lately. Unfortunately, due to the influx of people, more drivers on the road lead to more casualties and injuries on the roads, but with the best practices being followed the city is prepared to have a well -run and safe rally this year.
