HomeMy WebLinkAbout2010-04-23 Police Commission Agenda PHNOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN of a public hearing to be held by the Police Commission, County of Hawaii, in accordance with the provisions of Chapter 91 of the Hawaii Revised Statutes. Date: April 23, 2010 Time: 9:00 a.m. Place: Old Mayor's Office Conference Room 75 -5706 Kuakini Hwy., Suite 103, Kailua -Kona The purpose of the public hearing is to afford all persons the opportunity to submit data, views, or arguments, orally or in writing, to the Police Commission for its consideration prior to the adoption of the proposed amendments to its rules and regulations as summarized below. All written comments should be filed with the Police Commission at 101 Pauahi Street, Suite 9, Hilo, HI 96720, by April 13, 2010. The Police Commission may make a decision to adopt these amended rules during this public hearing or at its monthly meeting immediately following the public hearing. The following is a summary of the substantive changes proposed by the Police Commission: • Addition of a mission statement. • Addition to powers, duties, functions to be in line with the County Charter. • Addition of description of duties and functions of standing committees. • Deletion of contractual services committee. • Extends the time limit for filing a complaint from 60 to 90 days from date of incident. • Addition to allow the commission to accept a complaint for any reason it deems acceptable. • Addition to classification of findings, adding referral to the chief for further investigation by internal affairs or other appropriate division. • Addition to classification of findings, adding referral to the chief for customer service, procedural, operational, administrative, or jurisdictional concerns. • Addition of a burden of proof statement when investigating and evaluating complaints. • Addition of subpoena powers. • Deletion of office of chief of police as a location for obtaining information. • Addition to counsel for police officers, that the commission may assign a non - police investigator. • Addition to contested case procedures, that the presiding officer shall be designated by the commission. • Addition of a confidentiality statement for disclosure of information. • Addition of a statement that the rules shall be posted on the internet at a website endorsed by the County of Hawaii.
