HomeMy WebLinkAbout2002-03-15 Police Commission AgendaMEETING NOTICE HAWAI'I COUNTY POLICE COMMISSION DATE: Friday, March 15, 2002 TIME: 10:00 a.m. PLACE: Hilo Police Department Training Room, 349 Kapiolani St., Hilo AGENDA CALL TO ORDER ROLL CALL APPROVAL OF AGENDA STATEMENTS ON AGENDA ITEMS (Open to the Public) STATEMENTS ON AGENDA ITEMS (Executive Session) To consider discipline and charges against officers or employees of the Hawaii County Police Department where consideration of matters affecting privacy will be involved and a closed session is requested, and to consult with Corporation Counsel on questions and issues pertaining to the commission's powers, duties, privileges, immunities, and liabilities. (Pursuant to HRS 92 -5 (2) and Hawai'i County Charter Section 13 -20 (b). APPROVAL OF MINUTES February 22, 2002, regular and executive sessions. PERSONNEL ORDERS Nos. 2002 -028 to 2002 -039. COMMUNICATIONS • Corresp. 10, from the Board Ethics, regarding Petition No. 2002 -03, complaint by Del Pranke that he has been the recipient of unfair and unethical treatment by the Police Commission. • Corresp. 11, Corporation Counsel Lincoln Ashida's response to Del Pranke's complaint to the Board of Ethics against the Police Commission. Mr. Ashida concludes that the complaint is unfounded, and that the Police Commission exercised its responsibilities appropriately. • Corresp. 12, Council Chairman James Arakaki nomination of Peter L. Hendricks of Council District 9 to the Police Commission. • Corresp. 13, from Lilian Beaufrere of Solutions 2002, Neighborhoods in Action, informing of their first annual seminar with all Neighborhood Watch Programs on the Big Island to be held on April 27, 2002. NEW BUSINESS • Evaluation of Chief of Police James Correa EXECUTIVE SESSSION To consider discipline and charges against officers or employees of the Hawaii County Police Department where consideration of matters affecting privacy will be involved and a closed session is requested, and to consult with Corporation Counsel on questions and issues pertaining to the commission's powers, duties, privileges, immunities, and liabilities. (Pursuant to HRS 92 -5 (2) and Hawai'i County Charter Section 13 -20 (b). • Request for legal counsel by Officer John Weber in Civil CV 02 00069. • Investigation and Deliberation of Complaints Complaint HPC 02 -01: Complainant alleged that while responding to a call from a local bar, the officers would not listen to his story, threw him against his car, told him to leave, and would not give him their names. Complaint HPC 02 -03: Complainant alleged that while responding to a call of two guys ripping off, an officer pointed a gun at his son and friend who were in front of his house. Complaint HPC 02 -04: Complainant alleged that an officer spoke to her in a condescending and sarcastic tone, hung up on her, was untruthful, slandered her, and yelled at her. She also alleged that another officer was not truthful. Police Commission Meeting Page 3 March 15, 2002 Complaint HPC 02 -05: Complainant alleged that when she called 911 for assistance, a dispatcher refused to send help. Complaint HPC 02 -08: Complainant alleged that an officer cited him for parking on the curb. The law does not prohibit parking on the curb. Complaint HPC 01 -19: Complaint was a victim of abuse of a family member. She alleged that the officers did not perform their lawful duties, did not follow proper procedures in conducting their investigation, was untruthful in their police report, and was impartial when exercising their authority. The complaint was referred to the commission's investigator, and the investigative report will be reviewed. Complaint HPC 01 -26: Complainant was a victim of abuse of a family member. She alleged that officers did not follow proper procedure in the course of the investigation, failed to pursue the arrest of the assailant, failed to complete investigative reports, and failed to serve a TRO. The complaint was referred to the commission's investigator, and the investigative report will be reviewed. • Status report of complaints referred to Chief Correa.
