STATEMENTS ON AGENDA ITEMS (Executive Session) To consider discipline and charges against officers or employees of the Hawai'i County Police Department where consideration of matters affecting privacy will be involved and a closed session is requested and to consult with Corporation Counsel on questions and issues pertaining to the commission's powers, duties, privileges, immunities, and liabilities. (Pursuant to HRS 92 -5 (2) and Hawai'i County Charter Section 13 -20 (b). APPROVAL OF MINUTES • October 25, 2002 PERSONNEL ORDERS • Nos. 2002 -152 to 2002 -167 COMMUNICATIONS • Honolulu Police Commission minutes of October 16, 2002 • Maui Police Commission minutes of September 18 and October 16, 2002 • Correspondence 67, from the Salary Commission, informing that the salary increase for the Chief of Police and Deputy Chief of Police will take effect upon appointment of the new Chief and Deputy Chief. • Correspondence 68, from Deputy Corporation Counsel Joseph K. Kamelamela, informing the commission of Civil No. 02 -00500 HG /BMK brought by Edwin- Dean: Macomber:J. and their request for a jury trial. • Correspondence 69, from Alan J. Pratt, Ph.D., of West Hawaii Crime Stoppers, asking that his correspondence and list of board members be distributed to all commission members. He also has questions for the police chief candidates. Hill, thanking the commission for selecting him as a semi- finalist for the position of Police Chief. Investigation and Deliberation of Complaints Complaint HPC 02 -47: Complainant filed a report of fraudulent use of credit card. She alleged that she called an officer four times, but he never returned her calls. Complaint HPC 02 -48: Complainant alleged that when responding to a call of a domestic disturbance, the officer influenced what she reported and wrote down things that were not true. Complaint HPC 02 -49: Complainant's daughter was involved in a traffic accident. He alleged that when he went to the scene, an officer responded in an overbearing and egotistical manner, did not show compassion for the injured, and was not impartial. Police Commission Meeting Page 3 November 29, 2002 Complaint HPC 02 -53: Complainant alleged that he was assaulted, but he was the one that was charged with assault. He also alleged that the officer left him in a hot car, didn't respond when he asked for medical assistance, and refused to take his complaint. Complaint HPC 02 -54: Complainant alleged that an officer interrogated his 17 -year old daughter at school over a personal matter without his permission. Complaint HPC 02 -55: Complainant was stopped during a DUI roadblock. He alleged that two officers used profanity many times and threatened to put him in jail if he made any noise when he drove away. He also alleged that the only reason he was treated this way was because he was driving a Honda. Complaint HPC 02 -57: Complainant alleged that during a traffic stop, an officer was impartial, tried to provoke an argument, and brought up prior domestic disputes rather than just issuing the citations. Complaint HPC 01 -43: Complainant alleged that she called 911 three times, but the police failed to respond. She was subsequently assaulted and alleged that if the police had responded, the situation could have been averted. An officer was charged with standard of conduct, performance of duty, and duty to report all offenses. (Akal Security investigated the complaint.) Complaint HPC 02 -09: Complainant alleged that following the recovery of his stolen motor home, three officers failed to follow proper procedures and failed to arrest the alleged suspect. An officer told him to take the TV and VCR, which did not belong to him. The officers were charged with standard of conduct and performance of duty. (Akal Security investigated the complaint.) ACTION ON EXECUTIVE SESSION MATTERS ANNOUNCEMENTS • The commission will be having a meeting to take testimony from the public on the Chief of Police finalists on November 29, 2002, at 6:00 p.m., at the Keauhou Beach Resort. • A meeting to select the Chief of Police will be on December 9, 2002, at 10:00 a.m., in the County Council Room in Hilo. • The next monthly meeting is scheduled for December 13, 2002, at 10:00 a.m., at the Hilo Police Station.
