STATEMENTS ON AGENDA ITEMS — Closed to the public (executive session) To consider discipline and charges against officers or employees of the Hawai'i County Police Department where consideration of matters affecting privacy will be involved and a closed session is requested and to consult with Corporation Counsel on questions and issues pertaining to the commission's powers, duties, privileges, immunities, and liabilities pursuant to HRS 92 -5 (2) and Hawai'i County Charter Section 13 -20 (b). COMMUNICATIONS • Honolulu Police Commission minutes of February 19, 2003. • Maui Police Commission minutes of February 19, 2003. • Commanders' meeting minutes of March 18, 2003. • Correspondence 03 -18, copy of letter from Corporation Counsel to Office of Information Practices requesting an opinion regarding executive meetings. • Correspondence 03 -19, from Mayor Kim, acknowledging the commission's opposition to the Cost of Government's recommendation to combine the Fire and Police Commissions into one Police Commission Meeting Page 2 April 11, 2003 Public Safety Commission and his appreciation to the commission for relocating its meetings away from the police station. • Correspondence 03 -20, copy of letter from the Fire Commission to the Committee on Finance opposing the Cost of Government's recommendation to combine the Fire and Police Commissions into one Public Safety Commission. • Correspondence 03 -21, copy of letter from Alan Pratt of West Hawaii Crime Stoppers to SHOPO informing of a study on the feasibility of replacing the present subsidized vehicle program with a fleet of marked police cars. • Correspondence 03 -22, copy of letter from Corporation Counsel to Alan Pratt of West Hawaii Crime Stoppers pointing out that his contact with SHOPO is on his own accord and not as an agent of the County. • Correspondence 03 -23, to Police Chief Lee Donohue expressing condolences for the loss of Officer Glen Gaspar. • Correspondence 03 -24, from the Kauai Police Commission informing of its support to raise the minimum starting salary of police officers to $3,000 per month. • Correspondence 03 -25, from Representation Bob Herkes, informing of House Bill No. 297, to create and fund a drug strike force pilot project in the County of Hawaii. • Correspondence 03 -26, from Lilian Beaufrere of Solutions 2003, Neighborhoods in Action, informing of its annual seminar scheduled for May 17, 2003, at the Waikoloa Beach Resort. • Correspondence 03 -27, copy of memo from the County Clerk to Mayor Kim informing of the approval of James A. Frazier as new police commissioner representing Council District 9. Police Commission Meeting Page 3 April 11, 2003 EXECUTIVE SESSION To consider discipline and charges against officers or employees of the Hawai'i County Police Department where consideration of matters affecting privacy will be involved and a closed session is requested and to consult with Corporation Counsel on questions and issues pertaining to the commission's powers, duties, privileges, immunities, and liabilities pursuant to HRS 92 -5 (2) and Hawai'i County Charter Section 13 -20 (b). • Status Report of Complaints Referred to the Police Chief. Investigation and Deliberation of Complaints. Complaint HPC 02 -65: Complainant was arrested for violating a TRO. She alleged that she should not have been arrested and should be reimbursed for costs incurred during the incident. The case was deferred at the last meeting in order for the commission to review additional documents. Complaint HPC 02 -45: Complainant alleged that he had reported his vehicle stolen, but when it was located, an officer declared it as abandoned then issued him a citation. Akal Investigations investigated the complaint. Complaint HPC 01 -27: Complainant was arrested during a DUI stop. She alleged that an officer used excessive force during the arrest. Akal Investigations investigated the complaint. Complaint HPC 95 -18, 18A, 18B: Complainants requested assistance from the commission in an investigation and answering of their questions regarding a shooting incident. The case was deferred pending completion of the investigation. ACTION ON EXECUTIVE SESSION MATTERS STATEMENTS FROM THE PUBLIC ANNOUNCEMENTS The next monthly meeting is scheduled for May 16, 2003, at 10:00 a.m., at the Ohana Keauhou Beach Resort. The annual State of Hawaii Police Commissioners' Conference will be held April 24 -25 in Honolulu.
