SWICK SPECIAL PERMIT APPLICATION (PL-SPP-2025-000103) THOMAS SCHAGER AND JOSEPH SWICK are requesting a Special Permit to allow the establishment of a 1-bedroom bed and breakfast operation within an existing farm dwelling on an approximately 1.8-acre parcel of land in the State Land Use Agricultural District. The subject property is located at 31-190 Hawaii Belt Road, approximately 50 feet east of its intersection with Leopolino Road, Kama`e`e & Wailua Government Tract, North Hilo, Hawaii, TMK: (3) 3-1- 001:051. APPLICANTS' REQUEST 1.Request: The applicants are requesting a Special Permit to establish a 1-bedroom bed and breakfast operation within an existing 640-square foot, 1-bedroom farm dwelling. The applicants reside in an existing, 3,234 square-foot, 2-bedroom additional farm dwelling and will act as on-site operators of the bed and breakfast. The bed and breakfast will provide overnight accommodation and breakfast for a maximum of 4 guests. 2.Reason for Request: According to the applicants, they would like to operate a bed and breakfast to generate supplemental income by offering a room to short-term guests. The current property owners and applicants manage the majority of agricultural activities on the property themselves and no longer require the use of the primary dwelling for farm labor housing. 3.Staffing/Employees: The bed and breakfast establishment will be operated by the applicants. 4.Parking: Off-street parking is available as the applicants have designated 2 parking stalls for guests of the bed and breakfast. 5.Hours of Operation: The bed and breakfast will operate daily,with quiet hours from 9:00 PM to 8:00 AM. 6.Definition of"Bed and Breakfast Establishment": According to Section 25-1-5 of the Zoning Code, a "bed and breakfast establishment" means any single-family dwellings and/or guest houses (pursuant to section 25-4-9), which have been permitted on a building 1- site, in which overnight accommodations and only breakfast meals are provided to a maximum of ten guests, for compensation, for periods of less than thirty days. 7.Landowners: Thomas L. Schager and Joseph B. Swick. 8.Supportive Information: A Special Permit is required to operate a bed and breakfast establishment in the State Land Use Agricultural District. The applicants have submitted the attached in support of the request. (Planning Department Exhibit 1—Special Permit Application dated August 4,2025,and Additional Information dated October 7,2025) BACKGROUND INFORMATION 9.Building Permits: According to records on file with the Building Division, the following building permits have been issued and completed for the subject property: Building Permit No. B2010-1073: Completed on September 1, 2011, for a 2- bedroom First Farm Dwelling. Building Permit No. B2010-1615: Completed on September 1, 2011, for a 1- bedroom Additional Farm Dwelling. Building Permit No. PW.B2025-003886: Issued on October 23, 2025, for 66- panel solar PV system. 10. Additional Farm Dwelling (AFD) Agreement (FDA-10-000279): An AFD was issued for the subject property on August 26, 2010, and recorded on October 6, 2010. The Planning Department approved the applicants' request to swap the designations of the two dwellings by letter dated September 17,2025. See Exhibit B of Applicant's Additional Info dated October 7, 2025. STATE & COUNTY PLANS 11. State Land Use District: Agricultural. 12. General Plan Land Use Pattern Allocation (LUPAG)Map: The General Plan LUPAG map classifies the subject property as Important Agricultural Land (IAL) which refers to land that has better potential for sustained high agricultural yields because of soil type, climate, topography, or other factors. 13. County Zoning: Agricultural-20 acres (A-20a). 14. Hamakua Community Development Plan (HCDP): The HCDP was originally adopted by the Hawaii County Council as Ordinance 2018-078 in August 2018. The HCDP objective is to promote,preserve and enhance a diverse, sustainable, local economy and to 2- encourage the increase and diversity of employment and living options for residents, including living wage jobs and entrepreneurial opportunities that allow residents to work and shop close to home and that complement Hamakua's ecology, rural character, and cultural heritage. 15. Special Management Area (SMA): The property is within the County's Special Management Area. The two dwellings were reviewed under SMA Assessment SAA-10- 000576 and SMA Minor Permit SMM-10-000160 was issued by the Planning Department. 16. Coastal Zone Management: The entire State of Hawaii lies within the Coastal Zone Management area. DESCRIPTION OF SUBJECT PROPERTY AND SURROUNDING AREA 17. Subject Property: The subject, 1.869-acre property is improved with a 640 square-foot, 1-bedroom first farm dwelling and a 3,234 square-foot, 2-bedroom additional farm dwelling (AFD). The applicants state that agricultural uses on the property consist of ongoing cultivation of a variety of fruit trees, including bananas, citrus, Brazilian cherry, papaya, soursop and coconut. 18. Surrounding Zoning/Land Uses: Properties surrounding the subject property are zoned Agricultural-20 acres (A-20a), with uses consisting of agriculture, farm dwellings, and vacant lands. The closest residence to the subject property is located approximately 20 feet to the west. 19. U.S.D.A. Soil Type: Soils on the subject property are classified Hilo hydrous silty clay loam, 0 to 10 percent slopes. 20. Land Study Bureau's Detailed Land Classification System: Soils within the project site are classified as "C" or"Fair" for agricultural productivity. 21. Agricultural Lands of Importance to the State of Hawai'i (ALISH): Majority of the property is classified as Prime Agricultural Lands and the remaining 10% is Unclassified. 22. Flood Insurance Rate Map (FIRM): The property is classified as Flood Zone"X," (Area of Minimal Flood Hazard) according to the FEMA Flood Insurance Rate Mapping system. 23. Flora/Fauna Resources:No formal flora/fauna study was conducted. The subject property was previously cleared for construction of the existing dwellings and previously used for extensive sugar cane cultivation. Vegetation on the property primarily includes fruit trees that make up the majority of the applicants' agricultural products. These include Bananas 3- Musa acuminata), Oranges (Citrus sinensis), Tangerines (Citrus reticulata), Tahitian Lime (Citrus X latifolia), Finger Lime (Citrus australasica), Lemon (Citrus limon), Calamondin (Citrus X microcarpa), Brazilian Cherry (Eugenia uniora), Papaya (Carica papaya), Fig (Ficus carica), Soursop (Annona muricata), Pineapple (Ananas comosus), Dragon fruit (Selenicereus undatus), and Coconut (Cocos nucifera). Several types of flowers and other plants are also grown on the property, including Anthurium (Anthurium andraeanum), Bromeliad (Bromeliaceae), Orchid (Orchidaceae), Heliconia (Heliconia spp.), Bird of Paradise (Strelitzia reginae), Protea(Protea cynaroides), and Ti (Cordyline fruticosa). In addition, animal species consist of dove, Japanese White-eye, house finch and myna which are common in the area. Domestic animals such as cats, dogs, goats, chickens and other animals such as rats and feral pigs are also common and are not considered endangered. It is possible that the Hawaiian Hawk (Buteo solitarius) and Hawaiian owl (Asio flammeus sandwichensis) may use the area. The endemic Hawaiian hoary bat(Lasiurus cinereus semotus) also may utilize the site as they are far ranging and utilize diverse habitats across the island. 24. Archaeological/Cultural/Historical Resources: No archaeological and cultural study was conducted of the property as the subject property has been previously impacted by ground-disturbing activities associated with previous agricultural and residential development. By letter dated October 24, 2025, the State Historic Preservation Division SHPD) notes that no historic properties will be affected by the proposed use. Although there is no proposed construction, the applicant states that in the event any inadvertent discoveries are made during any land disturbance activity relating to this project,work will cease and the applicants will immediately notify the Planning Department and SHPD and secure their clearances before proceeding any further. 25. Public Access: The subject parcel is a shoreline parcel. However, no public shoreline access will be affected by this request as there is no safe public shoreline access in the area due to the steep cliffs. PUBLIC UTILITIES AND SERVICES 26. Access/Parking/Traffic: Access to the subject property is from a shared access easement from Hawaii Belt Road. The access easement is a 50-foot-wide right-of-way with a 14- foot-wide pavement. Guests will utilize an existing concrete driveway to cross the subject 4- property and access guest parking stalls. According to the Hawaii County Zoning Code Section 25-4-51(a)(2), a bed and breakfast establishment must provide one parking stall for each guest bedroom and one stall for the dwelling, which the applicant will comply with. According to the applicant, traffic impacts are not anticipated to be significant and would remain consistent with current levels, given the small scale of the proposed 1- bedroom bed and breakfast and that traffic will be limited to registered guests. 27. Water: The subject property is not served by the existing county water system and presently utilizes a well to meet residential and agricultural water needs. 28. Wastewater: The subject property is not served by the existing county sewer system;thus, the applicant shall follow Department of Health (DOH) regulations for wastewater. The application states that the project will continue to use the existing cesspools currently serving the primary farm dwelling and the additional farm dwelling. 29. Solid Waste: According to the Department of Health(DOH), solid waste shall be properly recycled or disposed of at DOH-permitted solid waste facilities. 30. Food Service Operations: By definition, bed and breakfast establishments may only provide breakfast meals to guests. The Department of Health (DOH) has noted that a food establishment permit will be required if meals are to include "potentially hazardous food" or if the number of guests exceeds 6. If the bed and breakfast will only offer commercial cereal,pastries,breads,fruits, coffee,tea, andjuice,then a food establishment permit is not required. 31. Essential Utilities and Services: Electrical, telephone and internet services are available to the subject property. The nearest fire and police stations are located in Hilo which is approximately 14 miles from the subject property. AGENCY COMMENTS 32. The property is located at 31-190 Hawaii Belt Road in Kamae`e in North Hilo, Hawaii. It is accessed from Hawaii Belt Road via Easement 5-A over the neighboring property and consists of 1.869 acres of land (Figure 1). The property contains an existing permitted single-family dwelling as well as an additional farm dwelling. According to Real Property Tax records, both homes were constructed in 2010. The first single-family dwelling was permitted under Building Permit No. B2010- 1073H and consists of 3,234 square feet, three (3) stories, and contains two (2)bedrooms, 3.5 bathrooms, a garage, and associated features and serves as the applicants' primary residence. The second dwelling was permitted under Building Permit No. B2010-1615H and consists of two (2) stories containing an agricultural equipment storage area on the ground floor and approximately 640 square feet of living space on the second floor containing one (1) bedroom, a family room and two (2) bathrooms. The applicants have opted to designate the dwelling constructed under B2010-1073H as the additional farm dwelling and the dwelling constructed under B2010-1615H as the primary farm dwelling. Both dwellings were constructed prior to the applicants' purchase of the property. As the applicants are able to manage the farm work on the property themselves, the agricultural activities on the property do not necessitate the usage of both dwellings for farm worker housing. The applicants have thus been offering the primary farm dwelling as hosted transient accommodations for up to four(4) guests. However, they would like to permit these transient accommodations as a bed and breakfast. They believe the bed and breakfast designation better aligns with the accommodations offered as the accommodations are offered for periods of less than thirty days and guests are provided with a light breakfast option featuring fruit from their orchard. Thus, the applicants wish to obtain a Special Permit in order to permit the dwelling as a bed and breakfast with one (1) guest bedroom available for rent to a maximum of four(4)guests. No new construction is proposed and the applicants will continue to live in the additional farm dwelling on the property. An Additional Farm Dwelling Agreement(FDA-10-000279)was issued to a previous property owner in August of 2010. The agreement outlined the necessity for additional farm employees to manage the agricultural activities on the property. Ongoing agricultural activities include cultivation of a variety of fruit trees, including bananas, citrus, Brazilian cherry,papaya, soursop and coconut. The current property owners and applicants manage the majority of the agricultural activity themselves and no longer require the use of the primary dwelling for farm labor housing. Thus, they request a Special Permit in order to permit the dwelling as a bed and breakfast. It is noted that the two dwellings were built and permitted under Special Management Area Permit Nos. 05-000105 and 10-000160. Project Concept and Components The applicants respectfully request a Special Permit to operate a bed&breakfast on the subject 1.869-acre, agriculturally zoned property. The bed and breakfast will be located within the existing primary farm dwelling and no new construction is proposed. The site plan, floor plan and elevation drawings of the dwelling are attached as Figures 2-4. The applicants propose the following elements as part of the Special Permit: 1. The existing 1-bedroom, approximately 640 square-foot dwelling will be operated as a bed and breakfast for up to 4 guests. 2. The bed and breakfast will be operated by the applicants, who will continue to live in the existing 2-bedroom dwelling on the property. 3. Breakfast may be provided only to registered guests and no other meals will be provided. 4. Two designated on-site parking stalls are available to guests of the bed and breakfast in the driveway. 5. Water: Water is provided to both dwellings from an existing well on the property. 6. Access: Access will be via an existing shared access easement from Hawaii Belt Road. Guests will utilize the existing concrete driveway to reach the guest parking stalls. 7. Guests will observe quiet hours from 9:00 p.m. to 8:00 a.m. 8. Existing fruit trees and landscaping will mitigate potential noise and visual impacts to surrounding properties. 311. Subject Property Description The subject site, identified as TMK (3) 3-1-001:051, consists of 1.869 acres zoned A-20a Figure 5). The property is located at 31-190 Hawaii Belt Road in Kama`e`e in North Hilo, Hawaii. This area of the North Hilo District is designated as Lava Zone 8, on a scale ranging from 9 to 1 (least hazardous to most). The site is located along the coastline and at an elevation of approximately 180-200 feet above sea level. It is not within a Conservation District but is within the Special Management Area. Special Management Area approval was granted for the construction of both existing dwellings on the property. The Land Use Pattern Allocation Guide (LUPAG) designates this property as important agricultural lands (Figure 6). The Land Study Bureau classifies its soils as "C", or"fair" Figure 7). Under the Agricultural Lands of Importance to the State of Hawaii (ALISH) classification system, the majority of the subject property is considered prime (Figure 8). The U.S. Department of Agricultural Natural Resource Conservation Service (NRCS) has designated the soil type for the property as Hilo hydrous silty clay loam with 0 to 10 percent slopes. This soil type is formed by ash fields on lava flows. The soil is considered well drained with a medium runoff class. The property contains two single-family dwellings, one of which is an additional farm dwelling. The two (2)bedroom additional farm dwelling was permitted under Building Permit No. B2010-1073H and consists of approximately 3,234 square feet of living space. The 1-bedroom dwelling was permitted under Building Permit No. B2010-1615H and contain approximately 640 square feet of living space. The applicants are requesting to utilize the 1-bedroom dwelling as the bed and breakfast. No new construction is proposed as a part of the Special Permit request. The applicants wish to operate the bed and breakfast solely within the existing 1-bedroom dwelling. The bed and breakfast will provide the applicants with a supplemental source of income and support their small-scale agricultural activities. 3C. Institutional Considerations State Land Use The subject site is designated State Land Use Agricultural(Figure 9) and the property is 1.869-acres. As such, no State Land Use Commission action is required. The County of Hawaii can process the Special Permit request. As mentioned above, based on the Land Study Bureau Overall Master Productivity Rating, soils on the subject property are classified as "C", or"fair" (Figure 7). Under the Agricultural Lands of Importance to the State of Hawaii (ALISH) classification system, the majority of the property is considered"prime" and the rest is unclassified (Figure 8). Granting of this request would promote the effectiveness and objectives of Chapter 205, Hawaii Revised Statutes, as amended. In the case of the Agricultural District, the State Land Use Law is intended to preserve or keep lands of high agricultural potential in agricultural use. In this case, the requested use will be located within an existing dwelling and will be subordinate and incidental to the principal use of the property as the applicants' residence and farm. The bed and breakfast use will not diminish the ongoing agricultural activities or the agricultural potential of the property. Therefore, the use will not adversely affect the preservation and agricultural use of the property and is not contrary to the objectives sought to be accomplished by the State Land Use Law and Regulations. Special Management Area The subject property is within the designated Special Management Area and the two existing dwellings were constructed in accordance with SMA regulations. The Special Permit requests to utilize existing improvements and no new construction is proposed under the Special Permit request. Thus, no impacts to the Special Management Area are expected. County Zoning and General Plan The subject property is zoned A-20a (Figure 5). The County General Plan Land Use Pattern Allocation Guide (LUPAG) map designates the parcel as Important Agricultural Land(Figure 6).Relative to this designation, the General Plan allows consideration for a"Special Permit" on agricultural land where the requested use meets certain criteria as outlined in Section 4 of the permit application and Chapter 205 of the Hawaii Revised Statutes as amended. General Plan Discussion The Hawaii County General Plan serves as a guide for decision-makers in land use matters. The proposed project is conducive to the General Plan's guidelines as it conforms to the following goals,policies, and standards of the General Plan. Economic Elements: 2.2 Goals Provide residents with opportunities to improve their quality oflife through economic development that enhances the County's natural and social environments. Economic development and improvement shall be in balance with the physical, social, and cultural environments ofthe island ofHawai`i. Strivefor diversity and stability in the economic system. 16 Provide an economic environment that allows new, expanded, or improved economic opportunities that are compatible with the County's cultural, natural and social environment. Strivefor an economic climate that provides its residents an opportunityfor choice ofoccupation. Strivefor diversification ofthe economy by strengthening existing industries and attracting new endeavors. 2.3 Policies Encourage the development ofa visitor industry that is in harmony with the social,physical, and economic goals ofthe residents ofthe County. Environmental Elements: 4.2 Goals Define the most desirable use of land within the County that achieves an ecological balance providing residents and visitors the quality oflife and an environment in which the natural resources of the island are viable and sustainable. Land Use Elements: 14.1.2 Goals Designate and allocate land uses inappropriate proportions and mix and in keeping with the social, cultural, and physical environments ofthe County. 14.1.3 Policies Encourage the development and maintenance ofcommunities meeting the needs ofits residents in balance with the physical and social environment. 14.2.3 Policies Encourage other compatible economic uses that complement existing agricultural andpastoral activities. Discussion: Approval of the requested Special Permit would be in line with the aforementioned economic, environmental and land use goals and policies of the General Plan by providing an opportunity for the applicants to utilize an existing dwelling to generate supplemental income through the operation of a bed and breakfast. The applicants believe that the bed and breakfast will not detract from the agricultural activities established on the property, but will enhance them by generating supplemental income and additional opportunities to market 17 agricultural products. Additionally, this agricultural parcel will provide an enriching and peaceful backdrop for guests to enjoy, while the ability to host overnight accommodations will help the applicants utilize the existing dwelling. Hamakua Community Development Plan The subject property is located within Kama`e`e Homesteads in North Hilo. This area is included in the Hamakua Community Development Plan (HCDP). The HCDP attempts to further define the General Plan and serve as a guide for decision-makers. The proposed Special Permit request is conducive to the following objectives outlined in the HCDP: Objective 2:Protect and restore viable agricultural lands and resources. Protect and enhance viewscapes and open spaces that exempla Hdmdkua's rural character. Objective 8:Promote,preserve and enhance a diverse, sustainable, local economy. Objective 9:Encourage the increase in diversity ofemployment and living options for residents, including living wagejobs and entrepreneurial opportunities that allow residents to work and shop close to home and that complement Hdmdkua's ecology, rural character, and cultural heritage. Objective 13:Promote appropriate rural tourism that welcomes guests,for an alternative visitor experience. Promote Hawaii's host culture and Hdmdkua's heritage, including historic roads and plantation towns, andfestivals that celebrate our rich multi-cultural music, art, and agriculture. Discussion: Approval of the subject Special Permit request will allow the applicants, who currently operate the 1-bedroom dwelling on the property as a hosted transient accommodation, to more appropriately market their rental as a bed and breakfast. The bed and breakfast will not impair the ongoing agricultural use of the property. Rather, the applicants intend for their bed and breakfast to provide an opportunity to promote Hamakua agriculture and to complement the agricultural activities on the property by providing an entrepreneurial opportunity to utilize the existing dwelling on their property to diversify their income streams. 3D. Surrounding Zoning and Land Uses The subject parcel and surrounding parcels in all directions are zoned Agricultural 20- acre (A-20a) (Figure 5) and generally range in size from 1.5 - 5 acres. The properties immediately adjacent are of similar sizes to the 1.869-acre subject parcel. With the exception of the 26+-acre Botanical World Adventures parcel offering zipline tours just northwest of the subject property, the surrounding area contains a mixture of residential 18 and small-scale agricultural uses, with other properties offering transient accommodations in the immediate neighborhood. The Special Permit request would remain in keeping with the surrounding residential and agricultural uses and would only allow overnight accommodations for up to 4 individuals. The impacts from such a small number of guests would be minimal. Additionally, vegetation will serve to buffer views from nearby properties and the highway. 3E. Flood Insurance Rate Map The Federal Emergency Management Agency's Flood Insurance Rate Map (FIRM) designates the subject property to be in Flood Zone X (areas outside of the 500-year flood) (Figure 10). 3F. Archaeological Resources It is unlikely any archaeological or historic resources will be encountered on the property. The requested Special Permit area has been previously cleared and used for residential and agricultural purposes for many years, as documented in the aerial photo of the area from 1965 attached as Figure 11. No archaeological resources were discovered during the SMA process and construction of both dwellings on the property and this area also has a history of extensive sugar cane cultivation. Additionally, no construction is proposed under the Special Permit request. Nevertheless, in the event any inadvertent discoveries are made during any land disturbance activity relating to this project, work will cease, and the applicants will immediately notify the Planning Department and the State Department of Land and Natural Resources and secure their clearances before proceeding further. 3G. Valued Cultural Resources In view of Hawaii State Supreme Court's "PASH" and "Ka Pa`akai O Ka Aina" decisions, the issue relative to native Hawaiian gathering and fishing rights must be addressed. Specifically, there must be a discussion of the cultural, historical and natural resources and associated traditional and customary practices of this site. The requested action involves utilizing an existing 1-bedroom dwelling on the property as a bed and breakfast. No archeological, historical or cultural resources are known to be located on the property. It is not known whether the subject site or immediate surrounding area was ever used for traditional and customary rights by native Hawaiians. Since the site has been used extensively for residential and agricultural purposes for the last several decades, it would appear unlikely that the site would serve such a purpose today and/or in the recent past. Furthermore, the bed and breakfast dwelling is located more than 100 feet from the top of the sea pali and thus will not affect any coastal access or traditional practices. Additionally, the property does not contain any trails to mauka forested areas for gathering or hunting. As no new land clearing or construction is proposed by the Special Permit request, the proposed use makes the discovery of new resources unlikely. However, in the event any archeological resources were to be found on the property, all uses of the land would cease, and the Department of Land and Natural Resources State Historic Preservation Division would be contacted immediately. Based on the above, it does not appear that the project would have any potential adverse impact relating to the cultural and historical resources in the area. 3H. Flora and Fauna Resources Although there was no professional survey of the floral and faunal resources of the site, the parcel has been developed for residential and agricultural use for several years and has a prior history of extensive use for sugar cane cultivation. As such, the applicants do not believe that any rare or endangered floral or faunal resources are likely to be found on the site. Thus, it is unlikely that this project would cause any adverse faunal impacts. Introduced bird species such as dove, Japanese White-eye, house finch and myna are common in the area. Domestic animals such as cats, dogs, goats, chickens and other animals such as rats and feral pigs are also common and are not considered endangered. It is possible that the Hawaiian Hawk (Buteo solitarius) and Hawaiian owl (Asio flammeus sandwichensis) may use the area. The endemic Hawaiian hoary bat(Lasiurus cinereus semotus) also may utilize the site as they are far ranging and utilize diverse habitats across the island. However, no new construction is proposed. Thus,potential impacts to native birds and the Hawaiian hoary bat should be negligible. Vegetation on the property primarily includes fruit trees that make up the majority of the applicants' agricultural products. These include Bananas (Musa acuminata), Oranges Citrus sinensis), Tangerines (Citrus reticulata), Tahitian Lime (Citrus X latifolia), Finger Lime (Citrus australasica), Lemon (Citrus limon), Calamondin (Citrus X microcarpa), Brazilian Cherry (Eugenia uniora), Papaya(Carica papaya), Fig (Ficus carica), Soursop (Annona muricata), Pineapple (Ananas comosus), Dragon fruit Selenicereus undatus), and Coconut(Cocos nucifera). Several types of flowers and other plants are also grown on the property, including Anthurium (Anthurium andraeanum), Bromeliad(Bromeliaceae), Orchid (Orchidaceae), Heliconia(Heliconia spp.), Bird of Paradise (Strelitzia reginae), Protea(Protea cynaroides), and Ti (Cordyline fruticosa). Again, as the requested use proposes no new land clearing, the project does not anticipate an impact on floral resources. 22 3I. Public Access The subject parcel is located proximate to the shoreline. However, no public shoreline access will be affected by this request as there is no safe public shoreline access in the area due to the steep cliffs. 3J. Description of Access The parcel is located on the east side of Hawaii Belt Road, a state road with a 100-foot right-of-way. The property is accessed via easement 5-A through the neighboring parcel TMK (3) 3-1-001:016) and easement 6-A on the subject property. These easements were established when the property was created under Subdivision No. 7550 in May of 2002. Upon entering the property, guests will utilize the existing concrete driveway to access the designated parking area for the bed and breakfast accommodations. 3K. Traffic Impacts Traffic would likely not be affected. The Special Permit would only result in an increase of two guest vehicles at most and does not propose any additional construction. Once operational, traffic generated from the bed and breakfast would remain consistent with the current residential and agricultural levels. Thus, the proposed use will not represent a significant increase in traffic. 3L. Availability of Utilities HELCO power is available and connected to the site. Water is available through an existing well on the property. Wastewater is disposed of via existing permitted cesspools. All other necessary utilities (i.e. phone, cable, internet) are available to the site. III. REGULATORY ANALYSIS 4A. Coastal Zone Management The proposed use is not contrary to Chapter 205A, Coastal Zone Management as the existing dwellings were permitted through the Special Management Area process. There are no public access, scenic or open space resources on the subject site. 313. Impacts to Surrounding Properties The proposal to operate a bed and breakfast on the subject property will not have a significant adverse impact on the surrounding properties. Several properties in the immediate neighborhood also operate similar short-term accommodations. The bed and breakfast will be limited to up to 4 guests and will be operated within an existing permitted dwelling. There will likely be no visual or noise impacts to surrounding 23 properties due to existing vegetation and the small scale of the proposed bed and breakfast operation. The proposed use will not create a significant increase in traffic. The applicants reside on the property and will be available to address any guest needs as well as to ensure that guests adhere to the "Good Neighbor Policy" as outlined in the Hawaii County Zoning Code by requiring quiet hours from 9:00 p.m. to 8:00 a.m. and that guest vehicles are parked in the designated on-site parking areas. 4C. Impacts to Public Agencies The proposed project will not unreasonably burden public agencies to provide roads and streets, sewers, water, drainage, school improvements, and police and fire protection. The subject site is accessible via Hawaii Belt Road and no additional utilities will need to be provided by public agencies. The applicants assume the responsibility to provide water to the property for potable use and fire suppression. 4D. Unusual Conditions In recognizing that lands within Agricultural districts might not be best suited for agricultural activities and yet classified as such, and in recognition that certain types of uses might not be strictly agricultural in nature, yet reasonable in such districts, Hawaii Revised Statutes §205-6 allows County Planning Commissions to permit certain unusual and reasonable uses within the Agricultural and Rural districts other than those for which the district is classified. The subject property is in the Agricultural district and is classified by the Land Study Bureau Overall Master Productivity Rating as containing"C" or"fair" soils but the small size of the property makes it largely unsuitable for large scale productive agriculture. Alternative visitor experiences are in high demand in Hawaii. Many visitors to Hawaii are looking for accommodations and experiences outside of the typical resort environment, especially in the Hamakua area where resorts are not available. Bed and breakfast accommodations provide alternative lodging sites for visitors seeking a more personal experience in Hawaii. Approval of the applicants' request to utilize an existing dwelling to operate a bed and breakfast will allow them to earn supplemental income with the unusual, yet reasonable,proposed bed and breakfast accommodations. Additionally, operating a bed and breakfast on their property will allow the applicants an opportunity to promote Hamakua agriculture. Thus, the Special Permit seeks to establish a bed and breakfast on this property while keeping with the intent of the agricultural district. Therefore, it is reasonable that the applicants be permitted to pursue this unusual use in the Agricultural district. 24 4E. Land Suitability for Permitted Use As mentioned above, according to the Land Study Bureau Overall Master Productivity Rating, the subject property is classified as "C" or"fair". Thus, the soils on the property are suitable for the agricultural uses being proposed. However, the agricultural output is not high and not likely to generate significant income. Thus, the agricultural uses proposed on the property would be aptly supported with the alternate income stream provided by the proposed bed and breakfast. 4F. Land Character and Present Use The proposed use will not substantially alter or change the essential character or use of the land. The bed and breakfast will be established within an existing dwelling and no new construction or land disturbance is proposed under the Special Permit request. The agricultural use of the property would be supported under the proposed request as the proposed bed and breakfast would complement the existing agricultural uses in a manner that is unusual, reasonable and mutually beneficial to both. Thus, the use of the property as a bed and breakfast will be subordinate and clearly incidental to the principal use of the property as a farm and the applicants' residence. Therefore, the Special Permit request will not alter or be detrimental to the essential character of the land or surrounding area; rather, it will assist the landowners in realizing the property's potential through the addition of an unusual, yet compatible and reasonable use. 4G. Relationship to General Plan The proposed use will not be contrary to the goals,policies, and standards of the General Plan or the Hamakua Community Development Plan. As discussed in Section 3C, the proposed use conforms to the General Plan's economic, environmental and land use goals and policies. The project will provide the applicants with an entrepreneurial opportunity to utilize the existing dwelling as a bed and breakfast. 4H. Unusual and Reasonable Use The proposed use is an unusual and reasonable use of the land, which would not be contrary to the objectives sought by Land Use Law and Regulations, which, for the Agricultural District, seek to preserve or keep the land of high agriculture potential in agriculture usage. Lands in the Agricultural District include areas with a high capacity or potential for agricultural uses but also lands which are surrounded by or contiguous to agricultural lands and which are not suited to agricultural uses by reason of topography, soils or other related characteristics. The soils on the subject property are moderately well suited for agricultural use as they are classified by the Land Study Bureau as "C" or"fair". However, the size of the parcel makes intensive commercial agriculture difficult. Thus, it is the landowners' intent to continue to farm a portion of the parcel while optimizing the overall use of the land by operating a bed and breakfast in one of the existing dwellings. In so doing, they will be 25 able to maximize the usability of the existing structures on the property while also promoting Hawaiian agriculture to guests. In response to your request for additional information pertaining to the subject application we offer the following: 1. Please provide a property deed to show proofoflegal access on the access drive. Please find the deed showing proof of legal access to the property from Hawaii Belt Road attached herein (Exhibit A). 2. Please clam ifthe applicant proposes that allfour Bed and Breakfast guests will be accommodated in the single permitted bedroom? The applicants are proposing to offer the bed and breakfast dwelling to only one party at a time consisting of a maximum of 4 guests. One bed will be provided in the bedroom and a pull-out sofa will be provided in the family room. A roll-away cot can also be made available upon request. 3. Real property tax square footage records do not match the permitted record for the current AFD dwelling (ie, the I bdrm dwelling proposed to convert into a B&B). Has the lower level of the AFD been finished out as living space, as noted by RPT records? The applicant should be aware that building permits would be requiredfor any unpermitted living area that is part of the proposed B&B. The lower level of the dwelling consists only of storage space and laundry facilities and is not used as living space. This storage area will not be available to guests of the bed and breakfast. 4. The application notes that the applicants have already been offering the current AFD as a rental for transient accommodations. This appears to be in conflict with condition No. I ofthe AFDA, which specified: "The AFD shall only be used toprovide shelterfor persons involved in the agricultural or farm -related activity on the building site. Family members who are not engaged in agricultural orfarm -related activities are allowed to reside in the farm dwelling. "As such, the applicants should discontinue use ofthe AFD for transient rentals until a Special Permit is secured. The landowners did not know that the AFD designation was particular to one or the other of their dwellings. As soon as they learned that the AFD designation applied to the dwelling used for transient accommodations, they immediately requested to swap the designation so that the dwelling they live in is designated as the additional farm dwelling and the dwelling their guests stay in is designated as the primary farm dwelling. Formal acceptance of this request was received from the Planning Department and is attached here (Exhibit B). 5. Since this property has two farm dwellings and a recordedAFD agreement, commercial agricultural activity is required, equivalent to that depicted in the farm plan submitted with the original AFD application. The site plan submitted with the Special Permit application appears to show no areas ofagricultural activity on the subject property. Furthermore, the applicant states that the amount ofagricultural activity on the property is minimal enough that additional farm workers are no longer needed. Please provide a site plan and discussion showing that ag activity is consistent with the approved farm plan for the AFD or provide an updated farm plan to justify the existing AFD. The applicants purchased the subject property in late 2018, after a prior landowner had obtained FDA-10-000279. Since purchasing the property, the applicants have continued to actively maintain and farm it, although their current agricultural activities differ somewhat from the original farm plan submitted by the prior owners in 2010. During the first few years owning the farm, the applicants had to invest significant time and resources in cleaning up the farm, removing invasive trees which had been shading out the fruit trees and installing an irrigation system. Until recently, they struggled to obtain successful harvests as many of the fruit trees suffered from rust and other pathogens. The applicants tried to save the trees by hiring a professional tree service to selectively prune the diseased limbs, but some of the most unhealthy trees had to be removed in order to avoid further spread of pathogens into healthy trees. Additionally, some of the coconut trees had been planted too close to the applicants' dwelling and had to be removed in order to avoid damage to the dwelling. Since purchasing the property, the applicants have planted new trees in their place and are now beginning to see more productive harvests. They hope to soon sell some of their produce to local businesses in the area, such as the Papa`aloa Country Store. Current fruit crops include bananas, citrus, Brazilian cherry,papaya, fig, soursop,pineapple, dragon fruit and coconut. In addition to the fruit trees on the property, the applicants have also begun to cultivate rare ornamental proteas. Growing the proteas required initial trial and error to determine how to grow them successfully at the applicants' elevation and climate. While difficult to cultivate, they are very valuable and the applicants have begun taking cuttings from the better established plants which they hope will be worth as much as $25 each, once ready for sale. As noted above, the applicants' current agricultural activities described above differ somewhat from those described in the Additional Farm Dwelling Agreement issued to the prior landowner, which included guava, coconut, lychee, banana,passion fruit and citrus. It appears that some of those crops were either never planted or else did not survive. Additionally, the prior owner's plan to operate a roadside farm stand is not feasible or an efficient use of time for the current landowners. This property is accessed from a quiet,private road that does not get enough traffic to make a roadside stand feasible, nor would setting up a stand along the highway be feasible. For these reasons, the applicants are pursuing wholesale sales of their agricultural products to small local businesses for resale. Otherwise, and with the addition of the ornamental plants, the applicants' farm plans are generally similar to those represented by the prior landowner.
