PLACE: Ohana Keauhou Beach Resort, 78 -6740 AM Drive, Kona AGENDA CALL TO ORDER ROLL CALL APPROVAL OF AGENDA STATEMENTS ON AGENDA ITEMS - Open to the public (Corporation Counsel to give an explanation of statements ) STATEMENTS ON AGENDA ITEMS (EXECUTIVE SESSION) - Closed to the public To consider discipline and charges against officers or employees of the Hawai i County Po /ice Department where consideration of matters affecting privacy will be involved and a closed session is requested and to consult with Corporation Counsel on questions and issues pertaining to the commission's powers, duties, privileges, immunities, and liabilities pursuant to HRS 92 -5 (2) and Hawai i County Charter Section 13 -20 (b). APPROVAL OF MINUTES • August 26 and September 10, 2004, regular and executive sessions. PERSONNEL ORDERS • Nos. 2004 -105 to 2004 -121. (Including but not limited to work assignments, training assignments, promotions, reallocations, severance from service, automobile allowances, and appointments.) COMMUNICATIONS • Correspondence 04 -49, from Lisa J. Sims - Hulsey requesting that the commission reopen her complaint (deferred at last meeting). • Correspondence 04 -62, from Chief Mahuna, his comments to the commission's recommendations on investigating complaints. • Correspondence 04 -63, County Council's Resolution No. 224 -04 requesting that the mayor develop a transition and implementation plan for conversion from subsidized private vehicles in police service to a county -owned fleet of police vehicles commencing in fiscal year 2006 -07. Hawaii Police Commission Page 2 October 15, 2004 • Correspondence 04 -64, from Marya Baker protesting her termination of employment as a dispatcher at the Hawaii County Police Department. • Correspondence 04 -65, from Paul M. de Silva informing that he has asked the prosecuting attorney to investigate Commissioner Dwight Manago for testifying before the county council in support of the police department's budget. • Correspondence 04 -66, from Mayor Kim regarding complaint by Janene Caracaus and that his belief that commission badges are ornamental in nature. • Correspondence 04 -67, police commission's proposed 2005 -06 fiscal year budget. • Correspondence 04 -68, from the Honolulu Police Commission regarding the questionnaire that they send to HPD personnel for use in evaluating the police chief. • Correspondence 04 -69, from Chief Mahuna informing that the department will discontinue the practice of issuing badges to police commissioners. • Correspondence 04 -70, from the Big Island Press Club regarding the police commission's executive session meeting on August 13 and reasons for going into executive session. • Correspondence 04 -71, from the Sheep Producers Association of Hawaii requesting that the police commission deputize their agents with the authority to assist with predator control problems. • Correspondence 04 -72, revised police commission complaint forms. Sims - Hulsey requesting that the commission reopen her complaint. NEW BUSINESS • Review of chief of police evaluation form for chief's evaluation in December. Investigation and Deliberation of Complaints. HPC 04 -36: Complainant alleged that when he called the police station, officers slammed the phone on him. HPC 04 -37: Complainant alleged that an officer told him he would be arrested for fighting and called him a drug dealer. HPC 04 -28: Complainant alleged that from 1988 to 2004, officers have failed to perform their duties when he made noise nuisance complaints.
