NEW BUSINESS Correspondence 05 -58, request for legal counsel by Officers Lorenzo Artienda, Robert Pule, and David Reis in Civil No. 05 -1 -0392. 10:30 P.M.: INVESTIGATION AND DELIBERATION OF COMPLAINTS • Complaint HPC 05 -07A, B, C: Complainant alleged that an officer threw his flashlight at complainant's moving vehicle and broke his windshield. • Complaint HPC 05 -28: Complaint alleged that when he was stopped for DUI, an officer did not read him his rights and did not give him a field sobriety test at the scene. He also complained about the manner in which he was treated at the police station. Hawaii County Police Commission Page 3 January 20, 2006 • Complaint HPC 05 -31: Complainant alleged that an officer's report was incorrect. • Complaint HPC 05 -33: Complainant alleged that an officer was not impartial when he conducted his investigation. • Complaint HPC 05 -34: Complainant alleged that an officer was disrespectful, rude, and intimidating when he questioned her and her husband about a complaint made by their neighbor. STATEMENTS ON COMPLAINTS (open to the public) EXECUTIVE SESSION (closed to the public) To consider discipline and charges against officers or employees of the Hawaii County Police Department and to conduct an employee evaluation where consideration of matters affecting privacy would be involved and a closed session is requested and to consult with Corporation Counsel on questions and issues pertaining to the commission's powers, duties, privileges, immunities, and liabilities pursuant to HRS 92- 5 (2) and Hawaii County Charter Section 13 -20 (b). • Status report of complaints referred to Police Chief Mahuna. • Statements on complaints. • Investigation and deliberation of complaints. • Annual performance evaluation of Police Chief Lawrence Mahuna.
