COMMITTEE REPORTS • Budget and Finance (Frazier /Morimoto) • Office Management and Staffing (Lundkvist /Mitchell) • Rules and Policies (Kaoiwi) • Contractual Services (Robinson) • Public Relations (Lassiter /Politano Steckel CHIEF'S REPORT Including: • Crime • Traffic • Personnel • Finance • Commendations • Commander's meeting minutes of August 10 and September 19, 2006. • Other departmental activities NEW BUSINESS Chair Lassiter's report on the NACOLE (National Association for Civilian Oversight of Law Enforcement) Conference. 10:30 P.M.: INVESTIGATION AND DELIBERATION OF COMPLAINTS STATEMENTS ON COMPLAINTS (open to the public) EXECUTIVE SESSION (closed to the public) To consider discipline and charges against officers or employees of the Hawaii County Police Department where consideration of matters affecting privacy would be involved and a closed session is requested and to consult with Corporation Counsel on questions and issues pertaining to the commission's powers, duties, privileges, immunities, and liabilities pursuant to HRS 92 -5 (2) and Hawaii County Charter Section 13 -20 (b). • Statements on Complaints. • Internal Affairs' Status Report of Referred Complaints. • Investigation and Deliberation of Complaints. ➢ Complaint HPC 06 -13: Complainant alleged that she was forced to the ground and injured because she refused a ride from a police officer. ➢ Complaint HPC 06 -14: Complainant alleged that an officer was discourteous, rude, and overbearing. She also alleged that the officers would not accept her copy of a TRO and told her they would wait for their copy to come in the mail. Hawaii County Police Commission Page 3 October 20, 2006 ➢ Complaint HPC 06 -17: Complainant alleged that an officer did not inform him of his rights when he was arrested on a bench warrant. When he went to court, the judge told him there was no bench warrant on him. ➢ Complaint HPC 06 -18: Complainant alleged that an officer insisted on searching their home without a search warrant, had him go to the police station, and then arrested him for something else. ➢ Complaint HPC 06 -19: Complainant alleged that when she went to the police station to pickup a stolen propane tank, an officer scolded her for using a cart from a local store without their permission. ➢ Complaint HPC 06 -21: Complainant alleged that officers' oath of office were improperly administered, and they should not have conducted traffic stops. ➢ Complaint HPC 06 -23: Complainant alleged that during a traffic stop, an officer was rude, pulled her hair, and told her to sign the ticket or else she would be arrested. The officer also punched her boyfriend twice in the head. • Review of the Police Commission's investigatory process. Includes Correspondence 06 -24.1, 06 -24.2, and 06 -24.3 from Corporation Counsel Ashida regarding improvements to the investigatory process involving complaints against the Police Department and police officers. These are privileged and confidential attorney - client communications.
