PLACE: KING KAMEHAMEHA BEACH HOTEL (75 -5660 Palani Rd., Kailua -Kona) AGENDA INVOCATION Kaoiwi CALL TO ORDER Chair Whittemore called the meeting to order at ROLL CALL Absent APPROVAL OF AGENDA Kaoiwi /Sumja U STATEMENTS ON AGENDA ITEMS APPROVAL OF MINUTES July 18, 2008, regular and executive sessions. Sumja pointed out corrections to Ms. Pelayo. Sumja approved the minutes as corrected pointed out. Morimoto seconded the motion, and it carried unanimously. Lundkvist /Sumja U COMMUNICATIONS • Correspondence 08 -16, from Chief Mahuna, submittal of fiscal year 2008 -09 Final Budget. • Correspondence 08 -17, from Chief Mahuna, regarding memo from Mayor Kim on the State of the Fiscal Year 2008 -09 Budget and the implementation of the budget. • Minutes of the Honolulu Police Commission meeting of June 18 and July 2, 2008. • Minutes of the Maui Police Commission meeting of July 16, 2008. Commissioner Kaoiwi moved to approve the correspondence as listed. Commissioner Sumja seconded the motion, and it carried unanimously. COMMITTEE REPORTS • Budget and Finance (Whittemore / Kaoiwi): Commissioner Kaoiwi reported that he looked over the final budget for 2008 -09, and it looked okay. • Office Management and Staffing (Lass iter /Morimoto) • Rules and Policies (Behenna /Sumja): Sumja read his report. (Attachment A). Behenna stated that the revisions will be presented to the Corporation Counsel, the Chief, and the commissioners for their review. Behenna requested that the commissioners provide input by November 1. • Contractual Services (vacant): No report. • Public Relations /Information (Lassiter /Behenna): No report. CHIEF'S REPORT Including: • Crime: AC Tavares very briefly summarized the written report. Behenna asked for population of Area I and Area II. Tavares stated that he didn't know what the numbers were. Whittemore stated that the data was probably not set up according to police districts. • Traffic • Personnel • Finance • Commendations • Other Departmental Activities Hawaii County Police Commission Page 3 August 22, 2008 INVESTIGATION AND DELIBERATION OF COMPLAINTS (APPROXIMATELY 10.30 A.M.) STATEMENTS ON COMPLAINTS (open to the public) EXECUTIVE SESSION (closed to the public) To consider discipline and charges against officers or employees of the Hawaii County Police Department and to consider personal matters affecting the privacy of individuals for which an executive session has been requested by the individuals involved, pursuant to HRS 92 -5 (2) and Hawaii County Charter Section 13 -20 (b). • PERSONNEL REPORT • STATUS REPORT OF REFERRED AND EXTERNAL COMPLAINTS • STATEMENTS ON COMPLAINTS • INVESTIGATION AND DELIBERATION OF COMPLAINTS ➢ HPC 07 -47: Complainant was involved in an altercation and alleged that an officer cursed at him. The commission found insufficient evidence to prove his allegations (December 2007). The complainant now requests that the commission considers additional information. ➢ HPC 08 -14: Complainant alleged that she was still in her drive -way when an officer cited her for driving in his path. She also alleged that the officer told her to shut up. ➢ HPC 08 -17: Complainant alleged that he was injured during his arrest. (The complaint was received 19 months from the date of the incident.) ➢ HPC 08 -19: Complainant alleged that while investigating a neighbor's complaint, an officer did not keep his judgment to himself. ➢ HPC 08 -20: Complainant alleged that while investigating a neighbor's complaint, an officer aggravated the situation. ➢ HPC 08 -24: Complainant was involved in a hit - and -run. He complained about the manner in which the officer conducted himself. ACTION ON EXECUTIVE SESSION MATTERS STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS ANNOUNCEMENTS • The Police Commission's next monthly meeting will be on September 19, 2008, at 9:00 a.m. at the Department of Liquor Control in the Hilo Lagoon Centre, 101 Aupuni St., Suite 230, Hilo.
