NOTICE IS HEREBY GIVEN of the following matters to be considered by the Banyan Drive
Hawaiʻi Redevelopment Agency in accordance with the provisions of Chapters 91, 92, and 53,
Hawai‘i Revised Statutes and Section 2-35-1 of the Hawaiʻi County Code.

NOTICE REGARDING INTERACTIVE CONFERENCE TECHNOLOGY (ICT): Banyan
Drive Hawai`i Redevelopment Agency members and members of the public may participate in
this meeting via the Zoom interactive video conference platform or in person. A meeting held by
interactive conference technology shall be automatically recessed for up to thirty (30) minutes to
restore communication when audiovisual communication cannot be maintained with all
members participating in the meeting or with the “in-person” location identified in this agenda.
The meeting may reconvene when either audiovisual communication is restored, or audio-only
communication is established after an unsuccessful attempt to restore audiovisual
communication. If it is not possible to reconvene the meeting as provided in this section within
thirty (30) minutes after an interruption to communication, the meeting shall be automatically
terminated.

STATEMENTS FROM THE PUBLIC – Pursuant to HRS 92-3 interested persons that want to
provide oral testimony may do so either at the time the board takes public statements on the agenda
or at the time the specific agenda item is called or as otherwise allowed at the sole discretion of the
Chair.
BUSINESS OF THE AGENCY
1. Agency to evaluate and determine a position regarding the following state legislation for
purposes of submitting public testimony to the State legislature:
SB3288 SD1, Relating to the Country Club Apartment Building, Hilo, Hawaii.
SB2692 SD1, Relating to Public Land.
HB2616 HD1, Relating to the Banyan Drive-Makaokū Community Development
District.
HB1847, Relating to the Banyan Drive Community Development District.
SB2001, Relating to the Banyan Drive Community Development District.
SB2599 SD1, Relating to Development.
2. Agency to delegate authority to one or two Agency members to submit legislative
testimony, talk with legislators, and attend legislative hearings on behalf of the Agency.
ADMINISTRATIVE MATTERS
1. Approval of meeting minutes from the December 19, 2025, Banyan Drive Hawaiʻi
Redevelopment Agency meeting.
2. Scheduling of the next meeting date.

Submitting Written Testimony: Pursuant to § 92-3, HRS, interested persons who want to provide oral
testimony may do so either at the time the committee takes public statements on the agenda, or at the time
the specific agenda item is called. Please note that public testimony may be limited to three (3) minutes
in length per agenda item. Those wishing to testify in person should register with the Commission
Secretary at the in-person location at the meeting. Those submitting written testimony at the meeting
should bring 6 copies for distribution. Testimony may be submitted by (1) mail to Hilo Planning
Department at 101 Pauahi Street, Suite 3, Hilo, Hawaiʻi 96720; or (2) by email to
planning@hawaiicounty.gov. In order for the Commissioners to timely receive written testimony and
to be in compliance with Chapter 92, HRS, any interested person who wants to submit written testimony
should submit his/her/their written testimony, which shall be received by the Commission, by Monday,
February 23, 2026, by 10:00 A.M. Please submit separate testimony for each item. Timely written
testimony will be distributed to the Commissioners by February 23, 2026, by 3:00 p.m. All oral and
written testimony will be public record.

Hawai‘i.
Notice to Lobbyists: If you are a lobbyist, you must register with the Hawai‘i County Clerk within
five days of becoming a lobbyist \[Article 15, Section 2-91.3 (b), Hawai‘i County Code\]. A lobbyist
means “any individual engaged for pay or other consideration who spends more than five hours in
any month or $275 in any six-month period for the purpose of attempting to influence legislative or
administrative action by communicating or urging others to communicate with public officials.”

If you need an auxiliary aid/service or other accommodation due to a disability, contact the Planning

The purpose of the public hearings is to afford all interested persons a reasonable opportunity to be
heard on the above matters.
