CATEGORY BI: Category B 1 allows the licensee to provide recorded music and live entertainment within its licensed premises. APPLICANT: The applicant, The Hidden Nene, LLC, is a domestic limited liability company, registered with the Department of Commerce and Consumer Affairs, State of Hawai` i, on October 24, 2022. REDUCTION IN LICENSED PREMISES FOR PUNA CHOCOLATE COMPANY: Under New Business, Puna Chocolate Company is concurrently applying for a Reduction in Licensed Premises to its Restaurant General liquor license of approximately 944 square feet, which includes approximately 764 square feet of bar seating, restrooms, booth seating, and stairwell space, and approximately 180 square feet of storage space. DETAILS OF PREMISES: The proposed licensed premises consists of approximately 1,084 square feet, on the basement level of the three and one half -story building, which includes approximately 764 square feet of bar seating, booth seating, restrooms, and stairwell space, and approximately 180 square feet of storage space, plus an additional 140 square feet of storage formerly occupied by Hilo Tattoo shop. The entrance to the proposed licensed premises is located off Furneaux Lane and is completely separate from the upstairs (street level) Puna Chocolate Company entrance. Applicant has three designated parking stalls shared with Puna Chocolate Company for their customers in the parking lot located behind the proposed licensed premises, as well as curbside parking along Keawe Street and Furneaux Lane. BarSeating Interior Booth Seating Liquor Commission The Hidden Nene, LLC dba The Hidden Nene Page 3 KIND OF BUSINESS: Applicant is currently open and operating as a speakeasy type venue under Puna Chocolate Company's liquor license, selling craft cocktails and mocktails, bar bites, tapas, charcuterie board items, and desserts. Applicant is open seven (7) days a week, from 12:00 p.m. — 12:00 a.m. the following day. Employment consists of approximately twelve (12) employees, (10) of whom are certified by the Department of Liquor Control to supervise the sale, service and consumption of liquor. Applicant currently has live entertainment in the form of a soloist or duo to play jazz music or cover acoustics. Since the proposed licensed premises is small enough, they do not use amplification for their live entertainment. COMMERCIAL LEASE AGREEMENT: This Commercial Lease Agreement ("Lease") was executed on January 1, 2024, by and between Puna Chocolate Company of 74-54606 Pawai PI, Ste 8, Kailua-Kona, HI 96740, USA ("Landlord") and The Hidden Nene, LLC, ("Tenant"), with the term of said Lease commencing at 12:00 noon on January 1, 2024, and ending at 12:00 noon on December 31, 2029. ZONING: Downtown Hilo Commercial. SURROUNDING AREA: Survey of the surrounding area reveals that there is one church, Central Christian Church, and one temple, Taishoji Soto Mission, located within 500 feet of the proposed licensed premises. There are no schools and no liquor licenses with the same class and kind located within 500 feet of the licensed premises. At the present time there are 64 of the same class and 58 of the same kind of liquor licenses being lawfully exercised in the County of Hawaii. The lawn area fronting the licensed premises identified as Area A on the sketch and the lawn area located between the new addition and the original licensed premises identified as Area B on the sketch (attached as Exhibit 4) will be used for special functions only. 2. Service to the guest rooms within the licensed premises shall be to adults only, as requested, by individual drinks and full bottle service only. 3. Service of intoxicating liquor in Building 4 which contains seven guest rooms and a lounge shall be limited to guest rooms and is not permitted in the lounge. The lounge was excluded as Commissioners were concerned about the lack of supervision in this area over the consumption of intoxicating liquor as required by the Rules and Regulations of the Liquor Commission and Chapter 281, HRS, as amended. We have complied with all requirements and checklists and have every single approval needed with the exception of the Building Department. We have gone through many rounds of comments that we have addressed from intake and have finally gotten through intake and are now addressing issues that arose from two departments (DOH Wastewater and Building). There were 8 other departments that it passed through without issue. We have been working with an architect to dig into the code and clarify and address outstanding comments made by the Building Department and then re -submit the updated plans. What we understand is that, even though we are not physically altering the space in any way, a Change of Occupancy requires that we upgrade many elements to comply with current standards pertaining to the new occupancy (even though the building has been used for retail the past few years and will continue to be used for retail). Issues we are addressing after many months of back and forth on minor issues include ADA accessibility, electrical requirements, lighting, ventilation, structure, wastewater and a few others. We hired a contractor to begin work on the ADA compliance issue, however ran into setbacks requiring the involvement of an engineer and are back in discussions now. The process has been tedious and time consuming, therefore we are asking for an extension on our application as we are still very much actively working on this.
