Bertsch, Chair Also Present James A. Frazier, Member Louis Kaoiwi, Member Betsy Mitchell, Member Melvin S. Morimoto, Member Kaloa R. N. Robinson, Member Anita Politano Steckel, Member Absent: Pudding Lassiter, Vice Chair Karolyn P. Lundkvist, Member A quorum was present. Harry S. Kubojiri, Deputy Chief James Day, Assistant Chief Ronald Nakamichi, Assistant Chief Paul Ferreira, Major Kay Nishibayashi, Accountant Lincoln S. Ashida, Corporation Counsel Josie Pelayo, Secretary The purpose of the public hearing was to afford all persons the opportunity to submit data, views, or arguments, orally or in writing, to the Police Commission for its consideration prior to the adoption of the proposed amendments to Rule 3, 4, and 8. There was no testimony from the public. The following actions were taken: RULE 3 Commissioner Robinson moved and Commissioner Frazier seconded to amend Rule 3 to read as follows: The commission shall: (c) Submit an annual report to the mayor, managing director, and the council. RULE 4 Commissioner Robinson moved and Commissioner Frazier seconded to amend Rule 4 to read as follows: (b) The regular meeting of the commission shall be on the third Friday of each month at 9:00 a.m. in the County Council Room or other site accessible to the public as announced in the previous meeting. Hawaii County Police Commission Public Hearing Minutes October 21, 2005 Page 2 RULE 8 After discussion on the usage of words, and at the recommendation of Corporation Counsel Ashida, action was taken. Under Sufficient Evidence, Commissioner Robinson moved and Commissioner Frazier seconded to change the word "support" to "prove" and under Insufficient Evidence, to delete "or" and "disprove." The motion carried unanimously. Commissioner Robinson moved and Commissioner Frazier seconded to amend Rule 8 to read as follows: (e) Classification of Case Findings. (1) Sufficient Evidence. There is sufficient evidence to prove the complainant's allegations. (2) Insufficient Evidence. There is insufficient evidence to prove the complainant's allegations.
