Commissioner Sumja gave an invocation.
CALL TO ORDER
Chair Whittemore called the meeting to order at 9:05 a.m.

APPROVAL OF AGENDA
Commissioner Ono moved to approve the agenda. Commissioner Sumja seconded, and
the motion carried unanimously.
STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS
EDDIE CORDEIRO (Correspondence 2010 -11) stated that he has respect for everyone
there expect for the police officers. He went to court twice and won his case. After the
Police Commission's meeting in Hilo, he was stopped for his blue license plate cover.
Police officers use tinted license plate covers. He showed a tinted gray cover that police
officers use. He won about using the blue tinted cover. The officer who stopped him was
really nice, but not Sergeant Koi. Randy also gave him attitude. There area lot of officers
with attitude. He got a letter from the Chief that they do monthly and annual inspections.
The Chief said he would talk to his supervisors. He asked if he can put his license plate
cover back. The first time he won in court he asked the lady if he could put his license
plate cover back on, she said, "I guess." So he put it back on but got a ticket again. He
will give it a month, and if he sees officers with covers, he will go to the newspaper.

APPROVAL OF MINUTES
Commissioner Victorine moved to approve the regular session minutes of September 30,
2010. Commissioner Sumja seconded, and it carried unanimously. Ms. Pelayo stated that
the executive session minutes were not yet completed.
COMMUNICATIONS
• Correspondence 2010 -11, from Eddie Cordeiro regarding tinted license plate covers.
Commissioner Ono moved to accept, Commissioner Victorine seconded, and it carried
unanimously.
Honolulu Police Commission Minutes of September 1, 2010. Commissioner Victorine
moved to accept, Commissioner Ono seconded, and it carried unanimously.
COMMITTEE REPORTS
• Budget and Finance (Mende, Ono): No report.
• Office Management (Whittemore): No report.
• Rules and Policies ( Sumja, Victorine): No report.
• Public Relations (Ignacio, Pe`a- Ferrari): No report.
CHIEF'S REPORT
• Crime: Assistant Chief Tavares summarized the written report. He reported that the
Triathlon went well. They had 137 officers committed to the event at various times all
the way up to Kohala. They restricted traffic on Queen K Highway by giving out less
passes than previous years. Burglaries in Area I and II have increased. A lot of times
the spike is caused by a group of individuals.
Traffic: Assistant Chief Pacheco summarized the written report. Crashes and
fatalities are down. DUI arrests are up. Each district makes its own schedule for
seatbelt enforcement. At the end of the month, if they still have money left over, they
could do more enforcement. There is no concentrated enforcement on the ban of using
electronic control devices while driving like they do with seatbelt enforcement.
• Personnel: Deputy Chief Ferreira reported having 18 sworn and 18 civilian vacancies.
They are now screening for the 79th recruit class.
Finance: Deputy Chief Ferreira summarized the written report. The first draft of the
2012 budget is due on November 1St. If they receive a grant in mid -year, they have to
go to the County Council for approval to accept.
Chair Whittemore asked for their list of CIP projects.

• Commendations: Deputy Chief Ferreira reported receiving 13 commendations since
the last meeting.
• Other Departmental Activities: Deputy Chief Ferreira reported that he, the Chief, and
the Assistant Chiefs participated in the fundraiser "Walk a Mile in Her Shoes."
Deputy Chief Ferreira stated that they have not been officially asked to participate in
the APEC Conference on O'ahu. Planning is still in the works. Pre and post
expenditures will probably come out of their pockets. Commissioner Ono expressed
concern that heads of states will be attending pre and post conference.
EXECUTIVE SESSION
Commissioner Sumja moved to meet in executive session to consider discipline and
charges against officers or employees of the Hawaii Police Department where
consideration of matters affecting privacy will be involved and to consult with Corporation
Counsel on questions and issues pertaining to the commission's powers, duties, privileges,
immunities, and liabilities pursuant to HRS 92 -5 (2) (4) and the Hawaii County Charter
Section 13 -20 (b). Commissioner Victorine seconded. The motion carried with a
unanimous roll call vote.
Executive session convened at 9:52 a.m.
Regular session reconvened at 12:20 p.m.
ACTION ON EXECUTIVE SESSION MATTERS
• Complaint HPC 10 -23: Complainant made a complaint about the manner in which she
was arrested in 2008. The commission will only determine whether or not to accept the
complaint because it was received one year and nine months from the date of the
incident. Commissioner Victorine moved to decline acceptance because the complaint
did not meet the 90 -day rule for filing. Commissioner Ono seconded, and it carried
unanimously.
Complaint HPC 10 -27: Complainant alleged that an officer pulled him over without
just cause which made him feel threatened. Commissioner Victorine moved that there
was insufficient evidence to prove the complainant's allegations. Commissioner Ono
seconded, and it carried unanimously.
• Complaint HPC 10 -28: Complainant alleged that he has been humiliated when
making reports at the Kona police station and that an unidentified officer in an
unmarked car yelled at him. Commissioner Sumja moved that there was insufficient
evidence to prove the complainant's allegations. Commissioner Victorine seconded,
and it carried unanimously.

ANNOUNCEMENTS
• Chair Whittemore announced that the Police Commission's next monthly meeting will
be on Wednesday, November 24, 2010, at 9:00 a.m., in the Aupuni Center Conference
Room, 101 Pauahi St., Hilo (across street from Hawaii County Building).
• Collection of files and documents — Done.
ADJOURNMENT
The meeting was adjourned at 12:30 p.m.
