Aloha Commissioners,
I am writing in strong opposition to the special permit application by Teppy Mountain LLC(PL-SPP-2024-000075). Beyond the clear zoning violations, I am writing to address the
critical issue of accountability and the equal application of the law. As a community, we recently saw the swift and firm legal action taken against the individual
who harassed the monk seal "Lani." That case demonstrated that Hawaii does not tolerate thedisrespect of our natural resources or our laws. The same standard of accountability must
apply here. The applicant has already held this event multiple times without a permit, accumulating over
$34,000 in fines which they are now appealing while simultaneously asking for a permit.Allowing a permit to be issued to a "bad actor" who has shown a pattern of disregard for our
rules sends a message that environmental and zoning laws are optional for those with enoughland or resources.
Furthermore: Acreage Discrepancy: The use of 14.7 acres on a 1,400-acre parcel is a transparent attempt to
bypass the 15-acre threshold for a more rigorous review. Infrastructure Stress: Our rural roads and Highway 19 cannot safely support the traffic and
noise associated with an event of this scale.Our roads in general cannot safely withstand the increase of residents over the years. Let alone
the fatalities due to all the driving under the influence. How many more lives must be takenbefore enough is enough?
Precedent: Granting this permit would set a dangerous precedent that it is easier to "ask forforgiveness" via a permit after the fact than to follow the law from the beginning.
I urge the Commission to uphold the integrity of our laws and the protection of ouragricultural lands by denying this application.
