SIMON, being first duly sworn on oath deposes and says that: <br /> 1. I am a Partner in the law firm of Carlsmith Ball LLP, representing 1250 <br /> Oceanside, LLC ("Oceanside"), who is appealing two Declaratory Orders issued by the Planning <br /> Director dated April 29, 2024 (the "Declaratory Orders"). The Declaratory Orders were issued in <br /> response to petitions for declaratory ruling filed by Oceanside and C & J Coupe Family Limited <br /> Partnership, which relate to the Hokuli'a project in Kealakekua, North and South Kona, Hawai'i. <br /> 2. Pursuant to Board of Appeals Rule 8-11(d), your Affiant compiled a list of names <br /> and addresses of property owners taken directly from the County of Hawai'i Real Property Tax <br /> Office website. A copy of said list is attached hereto as Exhibit "A". <br /> 3. On September 20, 2024, a Notice of Public Hearing was mailed to all said <br /> property owners from Carlsmith Ball LLP's office in Hilo, Hawai'i.
