The interior consists of kitchen facilities, separate interior and lanai dining areas, a bar area with stools, storage space, and separate men and women restrooms for its customers and employees. For further information, refer to the floorplan attached as Exhibit 4. Street parking is limited, however there are several nearby parking lots available along Ali `i Drive. KIND OF BUSINESS: Applicant continues to operate as a contemporary casual restaurant offering a variety of fresh seafood, steaks and island cuisine. Applicant is open seven (7) days a week from 10:00 a.m. — 9:00 p.m. Employment consists of approximately fifty-one (51) employees, twelve (12) of which are certified by the Department of Liquor Control to supervise the sale, service and consumption of liquor. Applicant currently has live entertainment in the form of a soloist once or twice a week during inner hours. MANNER OF OPERATION: The current licensee, Wind & Sea Restaurants, Inc. dba Kona Inn Restaurant has had no violations and has operated in a reputable manner. ASSIGNMENT AND ASSUMPTION OF LEASE: This Assignment and Assumption of Lease ("Assignment and Assumption Agreement"), dated March 25, 2026, by and among Wind & Sea Restaurants, Inc., ("Assignor"), Kona Inn Restaurant, LLC ("Assignee") and Kailua Kona Village Development Group LLC ("Landlord"), hereby sells, assigns, transfers, and sets over unto Assignee all of Assignor's right, title and interest in, to and under the Restatement and Amendment of Lease dated November 17, 2014 ("Lease"), by and between Assignor and Landlord, for certain premises located at 75 -5 744 Ali `i, Kailua-Kona, HI. The restaurant has an area of approximately 1,760 square feet which includes a dining room, liquor room, service bar, storage room, kitchen, and separate restrooms for both men and women. Applicant would like to incorporate a dance floor, as needed, that will front the live entertainment within the restaurant. The lawn area fronting the licensed premises identified as Area A on the sketch and the lawn area located between the new addition and the original licensed premises identified as Area B on the sketch (attached as Exhibit 4) will be used for special functions only. 2. Service to the guest rooms within the licensed premises shall be to adults only, as requested, by individual drinks and full bottle service only. 3. Service of intoxicating liquor in Building 4 which contains seven guest rooms and a lounge shall be limited to guest rooms and is not permitted in the lounge. The lounge was excluded as Commissioners were concerned about the lack of supervision in this area over the consumption of intoxicating liquor as required by the Rules and Regulations of the Liquor Commission and Chapter 281, HRS, as amended. DETAILS OF THE CHANGE IN CATEGORY: Applicant currently does not have live entertainment or dancing, therefore they would like to offer this to their customers who are enjoying a meal within the restaurant.
